08-10-2000 VC REG-M• MINUTES OF THE REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, AUGUST 10, 2000 Present: Joseph A. Tringali, Mayor Dr. Edward M. Eissey, Vice Mayor Charles R. O'Meilia, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Kathleen F. Kelly, CMC, Village Clerk Absent: David B. Norris, President Pro Tem Donald G. Noel, Councilman ROLL CALL: The meeting was called to order at 7:30 p.m. All members of the Council were present except President Pro Tem Norris and Councilman Noel, who were out of town.. All members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Vice Mayor Eissey gave the invocation, and Mayor Tringali led the public in the Pledge of Allegiance to the Flag. APPROVAL OF MINUTES "I'he following Minutes were approved as written: Minutes of Regular Session held 7/27/00 REPORT OF THE MAYOR Discussion was held concerning obtaining a Village Flag, possibly one of the Village's ship's wheel Staff was directed to look into this and report back to the Council. CONSENT AGENDA APPROVED Vice Mayor Eissey moved to take Item 7.f. from the Consent Agenda. Councilman O'Meilia seconded the motion, and all present voted aye. Item 7.f was placed under 14.a. Thereafter, Vice Mayor Eissey moved to approve the Consent agenda, as amended. Councilman O'Meilia • seconded the motion, and all present voted aye. The following items were approved: Minutes of Regular Session Held Thursday, August ]0, 2000 • Received for file the Minutes of the Code Enforcement Board Meeting held 7/10/00 Received for file the Minutes of the Library Advisory Board Meeting held 7/25/00 Approved budget transfer in the amount of $5,400 from A5540-49911 (Council Contingency) to A5206-33120 (Engineering/Planning) to fund Conroy Drive water main design Approved budget transfer in the amount of $3,000 in the Public Safety Dept., from A6416-11210 (Regular Pay) to A6416-11420 (Training-Overtime) to cover shortage in account Approved budget transfer in the amount of $10,000 in the Public Safety Dept., from A6416-11210 (Regular Pay) to A6416-11400 (Overtime Pay) to cover shortage in account Approved budget transfer in the amount of $15,000 in the Public Safety Dept., from A5711-11110 (Executive Salaries) to A5711-11400 (Overtime Pay) to cover shortage in the account Received for file the recommendation of the Library Advisory Board to relocate the Village Historian into the Village Hall building VILLAGE MANAGER'S REPORT Village Manager Dennis Kelly reported that the Town of Lake Park would be available for a joint meeting on Thursday, September 7, 2000. The Village Clerk will poll the Council regarding this date. BILL 995 -POLICE AND FIRE PENSION PLAN AMENDMENT -ENACTED AS ORDINANCE 20-2000 Councilman O'Meilia moved that Bill 995 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING DIVISION 4, OF ARTICLE V OF CHAPTER 2 OF THE CODE OF ORDINANCES OF THE VILLAGE, RELATING TO FIRE AND POLICE RE7'1REMENT PLAN, PROVIDING FOR OPTIONAL BENEFITS FOR DISABILITY RETIREES; PROVIDING FOR PRESUMPTIVE ILLNESSES; PROVIDING FOR SPECIFIC OPTIONAL BENEFITS; PROVIDING FOR PENALTIES FOR FALSE AND MISLEADING STATEMENTS; AND, PROVIDING FOR AN EFFECTIVE DATE • Be placed on second reading and read by title alone. BILL 976 -AMENDING COMPREHENSIVE PLAN -ENACTED AS ORD. 21-2000 Councilman O'Meilia moved that Ordinance 976 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING AN AMENDED COMPREHENSIVE PLAN FOR THE VILLAGE OF NORTH PALM BEACH, FLORIDA, THAT INCORPORATES THE EVALUATION AND APPRAISAL REPORT (E.A.R.) RECOMMENDATIONS, IN ACCORDANCE WITH THE LOCAL GOVERNMENT COMPREHENSIVE PLANNING AND LAND DEVELOPMENT REGULATION ACT, AS AMENDED, BEING SECTIONS 163.3161 ET. SEQ., FLORIDA STATUTES, WHICH AMENDED COMPREHENSIVE PLAN ]S ATTACHED AS EXHIBIT "A"; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE Be placed on second reading and read by title alone. Vice Mayor Eissey seconded the motion, and all present voted aye. Councilman O'Meilia moved that Bill 976 be enacted as Ordinance 21-2000. BILL 999 AMENDING SIGN CODE -PLACED ON FIRST READING Councilman O'Meilia moved that Bi11999 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, FLORIDA, AMENDING SUBSECTION (C) (1) B OF SECTION 6-115, PERMITTED PERMANENT ACCESSORY SIGNS, OF CHAPTER 6 OF THE CODE OF ORDINANCES OF THE VILLAGE, BY CHANGING THE MINIMUM SIGN SETBACK, MAXIMUM SIGN HEIGHT AND MAXIMUM SIGN FACE AREA FOR GROUND SIGNS FOR COMMERCIAL OCCUPANCY; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE Be placed on first reading and read by title alone. Councilman O'Meilia stipulated that his motion includes an effective date of January 1, 2001. Vice Mayor Eissey seconded the motion, • and all present voted aye. 3 Minutes of Regular Session Held Thursday, August 10, 2000 RESOLUTION 50-2000 ADOPTED -AUTHORIZING DESIGN DRAWINGS FOR WATER MAIN ON CONROY DRIVE Vice Mayor Eissey moved that Resolution 50-2000 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AUTHORIZING LBFH, INC. TO PREPARE THE DESIGN AND CONSTRUCTION PLANS FORA SIX INCH WATER MAIN EXTENSION ALONG CONROY DRIVE BETWEEN PROSPERITY FARMS ROAD AND ALTERNATE AlA WITI~IN THE VILLAGE IN ACCORDANCE WITH THE SCOPE OF SERVICES ATTACHED AS EXHIBIT "A" FOR THE SUM OF FIVE THOUSAND FOUR HUNDRED DOLLARS ($5,400.00); PROVIDING FOR A COMPLETION DATE FOR THE SCOPE OF SERVICES TO BE NINETY (90) DAYS FROM ISSUANCE OF A PURCHASE ORDER BY THE VILLAGE; AND, PROVIDING FOR AN EFFECTIVE DATE Be adopted. Councilman O'Meilia seconded the motion, and all present voted aye. BUDGET TRANSFER APPROVED PUBLIC SAFETY DEPT. Councilman O'Meilia moved to approve a budget transfer in the Public Safety Department in the amount of $8,000 from A5711-11210 (Regular Pay) to A5711-11410 (Holiday Overtime) to cover shortage in the account.
