01-26-2017 VC REG-MMINUTES OF THE REGULAR SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA JANUARY 26, 2017 Present: David B. Norris, Mayor Doug Bush, Vice Mayor Darryl C. Gebbia, Councilmember Mark Mullinix, Councilmember Sarnia Janjua, Interim Village Manager Leonard Rubin, Village Attorney Melissa Teal, Village Clerk ROLL CALL Mayor Norris called the meeting to order at 7:30 p.m. All members of Council were present. All members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Vice Mayor Bush gave the invocation and Mayor Norris led the public in the Pledge of Allegiance. APPROVAL OF MINUTES The Minutes of the Regular Session held January 10, 2017 and Minutes of the Special Session held January 12, 2017 were approved as written. STATEMENTS FROM THE PUBLIC Florida Department of Transportation Project Manager Scott Thurman and Stanley Consultants representative Bill Evans gave an overview the I -95 at Northlake Boulevard Interchange Project. PUBLIC HEARING AND SECOND READING OF ORDINANCE 2017 -03 — CODE AMENDMENT — COMMUNICATIONS SERVICES A motion was made by Vice Mayor Bush and seconded by Councilmember Mullinix to adopt and enact on second reading Ordinance 2017 -03 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING COMPREHENSIVE REVISIONS TO CHAPTER 29, "TELECOMMUNICATIONS," AND RENAMING THE CHAPTER "COMMUNICATIONS SERVICES;" ADOPTING REVISED DEFINITIONS IN CONFORMANCE WITH STATE AND FEDERAL LAW; DELETING PROVISIONS SUPERSEDED BY STATE STATUTE; PROVIDING FOR WIRELESS COMMUNICATIONS FACILITIES AND DESIGN STANDARDS; PROVIDING FOR AN UPDATED AND REVISED PERMITTING PROCESS; REQUIRING DESIGN FEATURES FOR CERTAIN ABOVE GROUND FACILITIES; PROVIDING PARAMETERS FOR THE PLACEMENT OF WIRELESS COMMUNICATIONS FACILITIES IN RESIDENTIAL RIGHTS -OF -WAY; PROVIDING A WAIVER PROCESS; REVISING THE INSURANCE AND BOND REQUIREMENTS; INCREASING THE MAXIMUM FINE AMOUNT; PROVIDING FOR RESERVATION OF RIGHTS; PROVIDING FOR REGULATION OF PASS - THROUGH PROVIDERS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Mayor Norris opened the public hearing. There were no comments from the public. Mayor Norris closed the public hearing. Thereafter, the motion to adopt and enact Ordinance 2017 -03 on second reading passed unanimously. Minutes of Village Council Regular Session held January 26, 2017 Page 2 of 5 FIRST READING OF ORDINANCE 2017 -04 — WATER CLUB PUD AMENDMENT A motion was made by Councilmember Mullinix and seconded by Vice Mayor Bush to adopt on first reading Ordinance 2017 -04 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE WATER CLUB RESIDENTIAL PLANNED UNIT DEVELOPMENT AS APPROVED BY ORDINANCE NO. 2016 -03 TO MODIFY THE PLATTING CONDITION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Mrs. Janjua stated the Water Club Planned Unit Development was approved in two phases and the applicant was required to record an amended Plat, including the entire property, prior to issuance of the first building permit for Phase II. Mrs. Janjua reported the applicant cannot produce a final amended Plat because all of the easements have not yet been approved by the various utility providers. Mrs. Janjua stated the Village and applicant have agreed to amend Section 6(A) of Ordinance 2016 -03 to allow the applicant to prepare, submit, and record the final plat prior to the issuance of the first certificate of occupancy for Phase II of the project. Water Club Project Manager John Grimaldi reported Phase II of the project should break ground at the end of February 2017 and is expected to take 24 months to complete. Thereafter, the motion to adopt Ordinance 2017 -04 on first reading passed unanimously. CONSENT AGENDA APPROVED Vice Mayor Bush moved to approve the consent agenda. Councilmember Mullinix seconded the motion, which passed unanimously. The following items were approved: Resolution 2017 -04 amending Resolution 2017 -03 to reference the correct contract for the purchase of sanitation collection dumpsters Motion to grant a merit increase of 4.8% to the Village Cleric based upon the averaged score of the performance evaluations and directing Village administration to process same Receive for file Minutes of the Planning Commission meeting held 12/6/16 Receive for file Minutes of the Recreation Advisory Board meeting held 1/10/17 RESOLUTION 2017 -05 — HERITAGE DAY AMUSEMENT RIDES A motion was made by Councilmember Mullinix and seconded by President Pro Tem Aubrey to adopt Resolution 2017 -05 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA ACCEPTING THE PROPOSAL SUBMITTED BY BIG FUN, INC. TO PROVIDE AMUSEMENT RIDES FOR HERITAGE DAY 2017 AND AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE A CONTRACT FOR SUCH SERVICES; AND PROVIDING FOR AN EFFECTIVE DATE. Thereafter, the motion to adopt Resolution 2017 -05 passed unanimously. Minutes of Village Council Regular Session held January 26, 2017 Page 3 of 5 RESOLUTION 2017 -06 — JULY 4, 2017 FIREWORKS DISPLAY A motion was made by Councilmember Mullinix and seconded by President Pro Tern Aubrey to adopt Resolution 2017 -06 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA ACCEPTING THE QUOTE SUBMITTED BY PYRO ENGINEERING, INC. D /B /A BAY FIREWORKS FOR THE JULY 4, 2017 FIREWORKS DISPLAY AND AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE A CONTRACT RELATING TO SUCH SERVICES; AND PROVIDING FOR AN EFFECTIVE DATE. Thereafter, the motion to adopt Resolution 2017 -06 passed unanimously. RESOLUTION 2017 -07 — STREET SIGN BLADE PURCHASE A motion was made by Councilmember Mullinix and seconded by Vice Mayor Bush to adopt Resolution 2017 -07 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA APPROVING THE PURCHASE OF NEW VILLAGE STREET SIGNS FROM NATIONAL TRAFFIC SIGNS, INCORPORATED; AND PROVIDING FOR AN EFFECTIVE DATE. Mrs. Janjua described the proposal received from National Traffic Signs and requested approval to purchase a total of 429 sets of signs at a total cost of $29,026.14, not including installation. Mrs. Janjua advised that installation by a contractor was estimated to cost approximately $29,000.00 and would take three to four weeks. Mrs. Janjua stated having the signs installed by Public Works street staff would take about six months at an internal cost of approximately $9,000.00. Mrs. Janjua requested Council direction on whether to have the signs installed by Village employees or issue a Request for Proposals. Purchasing Manager Sharon Swan addressed Council questions regarding the signs, the fastening method, and the sign blade warranty. By consensus, Council directed that Village employees install the signs. Thereafter, the motion to adopt Resolution 2017 -07 passed unanimously. RESOLUTION 2017 -08 — AMENDMENT TO FINANCE SERVICES CONSULTING AGREEMENT A motion was made by Councilmember Gebbia and seconded by President Pro Tern Aubrey to adopt Resolution 2017 -08 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA APPROVING AN AMENDMENT TO A CONSULTING AGREEMENT WITH MERLE GOLDBERG FOR FINANCE SERVICES AND AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE THE AMENDMENT ON BEHALF OF THE VILLAGE; AND PROVIDING FOR AN EFFECTIVE DATE. Thereafter, the motion to adopt Resolution 2017 -08 passed unanimously. Minutes of Village Council Regular Session Held January 26, 2017 Page 4 of 5 RESOLUTION 2017 -09 — CONTRACT FOR BOND COUNSEL SERVICES VA motion was made by Councilmember Mullinix and seconded by President Pro Tem Aubrey to adopt Resolution 2017 -09 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA APPROVING AN AGREEMENT WITH GREENSPOON MARDER, P.A. TO PROVIDE BOND COUNSEL SERVICES FOR THE NEW COUNTRY CLUB CLUBHOUSE UTILIZING PRICING ESTABLISHED IN AN EXISTING AGREEMENT WITH THE CITY OF RIVIERA BEACH AND AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE THE CONTRACT ON BEHALF OF THE VILLAGE; AND PROVIDING FOR AN EFFECTIVE DATE. Mrs. Janjua explained the need to retain bond counsel to work with the Village's financial advisor to ensure the loan transaction for the construction of the new Country Club clubhouse complies with all state and federal regulations. Mrs. Janjua detailed the duties of the bond counsel. Mr. Rubin explained the bond counsel's fee is based on the amount of the loan. Thereafter, the motion to adopt Resolution 2017 -09 passed unanimously. RESOLUTION 2017 -10 — EMERGENCY PURCHASE OF TEMPORARY CHILLER A motion was made by President Pro Tem Aubrey and seconded by Councilmember Mullinix to adopt Resolution 2017 -10 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, CONFIRMING AND AUTHORIZING THE EMERGENCY PURCHASE OF A TEMPORARY CHILLER FOR THE NORTH PALM BEACH COUNTRY CLUB FROM CARRIER CORPORATION; AND PROVIDING FOR AN EFFECTIVE DATE. Mrs. Janjua reported the chiller unit at the Country Club was declared inoperable; therefore, Village Administration contracted with Carrier Corporation to provide temporary cooling services for a three -month period at a total cost of $19,231.00. Mr. Rubin clarified the Village would lease a temporary chiller, which in Carrier's terminology, means purchasing "cooling services." Thereafter, the motion to adopt Resolution 2017 -10 passed unanimously. VILLAGE COUNCIL MATTERS /REPORTS Discussion was held regarding the Benjamin School students' request for support of a ban on the use of plastic bags. Council declined to talce action on this matter. President Pro Tem Aubrey suggested Councilmember Mullinix represent the Village at meetings of the North County Intergovernmental Committee. The Village Council and Mr. Mullinix concurred. Councilman Gebbia noted the need to inform the Palm Beach County League of Cities by January 31, 2017 of the Village's intent to establish its own citizen oversight committee to provide for citizen review of the infrastructure surtax proceeds. Mr. Rubin will develop requirements for the committee and present them for Council discussion at an upcoming Workshop Session. Minutes of Village Council Regular Session held January 26, 2017 Page 5 of 5 Discussion took place concerning the Village's resolution supporting the purchase of land for Everglades restoration and whether this should be reconsidered in light of new information issued by the South Florida Water Management District and the Treasure Coast Regional Planning Council. It was suggested that SFWMD, TCRPC, and Everglades Law Center Attorney Lisa Interlandi be invited to give presentations on this issue. This item will be placed on a future agenda. Councilman Gebbia will provide Council with the Palm Beach County League of Cities legislative priorities and the issues on which the League is requesting municipal support. Councilmember Mullinix relayed a citizen complaint concerning the condition of the stop sign in front of Post Office. Councilmember Mullinix commented on debris left by persons cast netting from Village bridges. Councilmember Mullinix congratulated Recreation Department staff on the holiday trolley rides and suggested the Village consider giving an award for best Christmas lights. Councilmember Mullinix noted the passing of esteemed Village residents Fay Eissey and Joe Bova. Mayor Norris noted the evaluations of the Village Cleric conducted by Council and commended Mrs. Teal for her service. Mayor Norris commended Interim Village Manager Samia Janjua for doing a tremendous job in carrying out the manager's duties in addition to serving as Director of Finance. VILLAGE MANAGER MATTERS Police Chief Rick Jenkins presented the Police Department's Annual Report. Mrs. Janjua reported on conditions at the Country Club Pool and Village athletic fields, and the status of the U.S. Highway 1 landscaping project. Mrs. Janjua announced the Chili Cook -off and Car Show on Saturday, January 28, 2017 at Anchorage Park. Mayor Norris announced the public reception to meet the Village Manager candidates on Friday, January 27, 2017 at the North Palm Beach Country Club and the public interview meeting on Saturday, January 28, 2017 at 10:00 a.m. in the Council Chambers.
