06-09-1994 VC REG-M1 J MINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, JUNE 9, 1994 Present: Gail H. Vastola, Mayor Jeffrey H. Atwater, Vice Mayor Tom Valente, Councilman Larry Kelley, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Kathleen F. Kelly, Village Clerk Absent: ROLL CRLL V. A. Marks, M. D. , President Pro Tem Mayor Vastola Called the meeting to order at 7:30 p.m. All members of Council were present except President Pro Tem Marks, who was out of town. A11 members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Mayor Vastola gave the invocation, and Councilman Kelley led the public in the Pledge of Allegiance to the Flag. BILL 747 ENACTED 1 STTHSTATION Councilman Valente moved that Bill 747 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH GENERAL FUND BUDGET FOR FISCAL YEAR 1993-94 TO APPROPRIATE FUNDS FOR THE CONTRACTUAL SERVICES WITH BETHSSDA AMBULANCE SERVICE, INC. AT THE SUB-STATION NORTH be placed on second reading and read by title alone. Councilman Kelley seconded the motion, and all present voted aye. Councilman Valente moved that Bill 747 be enacted as ordinance 10-94. Vice Mayor Atwater seconded the motion, and all present voted aye. BILL 7 P.U.D. AND I. ORD. 10-94 - APPROP ON ING - MARINA Vice Mayor Atwater moved that Bi11 749 entitled: ' AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING ORDINANCE NO. 6-94 WHICH CREATED A PLANNED UNIT DEVELOPMENT KNOWN AS 2 Minutes of Regular Session Held Thursday, June 9, 1994 "HARBOUR POINT MARINA" BY APPROVING AN INCREASE IN LANDS COMPRISING THE PLANNED UNIT DEVELOPMENT FROM 11.314 ACRES, MORE OR LESS, TO 13.66 ACRES, MORE OR LESS, LOCATED WITHIN THE VILLAGE AND MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED AND MADE A PART HEREOF; PROVIDING FOR RELOCATION OF THE ACCESS ROAD WITHIN THE PLANNED UNIT DEVELOPMENT IN ACCORDANCE WITH THAT CERTAIN PLAN DRAWN BY ARCHITECTURAL DESIGN ASSOCIATES DATED AUGUST 20, 1993, AS REVISED APRIL 29, 1994, CONSISTING OF ONE (1) SHEET ATTACHED AS EXHIBIT "B" AND EXPRESSLY MADE A PART HEREOF; REVISING SECTION 4 OF ORDINANCE NO. 6-94 PROVIDING FOR AN INCREASE IN THE CASH CONTRIBUTION AND PROVIDING FOR TERMS OF PAYMENT; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE be placed on first reading and read by title alone. Councilman Kelley seconded the motion, and all present voted aye. RESOLUTION 22-94 ADOPTED - APPOINTING MEMBERS TO THE EQUITY STUDY COMMISSION By consensus, the Village Council agreed to accept the seven applications received for membership on the Equity study Commission, and entered the following names into Resolution 22-94: Charles Isiminger Melissa Nieminen Rick Morgan J. Terence McManus Jim Pittard Bill Wadsworth Stanley Weiss Thereafter, Vice Mayor Atwater moved that Resolution 22-94 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING SEVEN MEMBERS TO THE EQUITY STUDY COMMISSION be adopted. Councilman Kelley seconded the motion, and all present voted aye. 3 Minutes of Regular Session ' Held Thursday, June 9, 1994 APPOINTMENT MADE TO PALM BEACH COUNTYWIDE BEACHES AND SHORES COUNCIL Vice Mayor Atwater moved to appoint Mort Levin as the North Palm Beach representative to the Palm Beach Countywide Beaches and Shores Council. Councilman Valente seconded the motion, and all present voted aye. BUDGET TRANSFER APPROVED FOR CC RESTAURANT ICE MACHINES Councilman Valente moved that the budget transfer request for $3,908.00 from L3900-0915d~(Reserve-Capital Contingency) to L8053- 66490 (Restaurant-Capital Machinery & Equipment) for the purchase of two ice machines for the North Palm Beach Country Club Restaurant be approved. Councilman Kelley seconded the motion. During discussion, Vice Mayor Atwater moved to amend the motion to take the funds from Country Club Contingency (L8070-49910) instead of Reserve-Capital. Councilman Kelley seconded the motion. The motion to amend passed 3-1, with Vice Mayor Atwater, Councilman Kelley, and Mayor Vastola voting aye, and Councilman Valente voting nay. Thereafter, the original motion, as amended, passed 4-0_ BUDGET TRANSFER APPROVED - GENERAL EMPLOYEES' PENSION FUND Councilman Kelley moved to approve a budget transfer for $6,400.00 from A5540-49911 (Council Contingency) to various departments' Pension accounts, per Ordinance 9-94. Vice Mayor Atwater seconded the motion, and all present voted aye. BUDGET TRANSFER APPROVED - GENERAL EMPLOYEES' PENSION FUND/COUNTRY CLUB vice Mayor Atwater moved to approve a budget transfer for $1,600.00 from L8070-49910 (Country Club Contingency) to various departments' Pension accounts, per ordinance 9-94. Councilman Kelley seconded the motion, and all present voted aye. CALENDAR APPROVED FOR ANNEXATION OF SOUTHWEST NEIGHBORHOOD Councilman Kelley moved to adopt a calendar for annexation of the "Southwest Neighborhood", the area known generally as west of Prosperity Farms Road, north of Northlake Boulevard, east of the FEC Railroad and south of the C-17 canal. Vice Mayor Atwater seconded the motion, and all present voted aye. 4 Minutes of Regular Session Held Thursday, June 9, 1994 BUDGET TRANSFER APPROVED FOR POOL LIGHTING Vice Mayor Atwater moved that a budget transfer request for $15,000.00 from L8070-49910 (Country Club Contingency) to L8051- 66210 (Pool Construction & Major Renovation) to upgrade the surface lighting at the North Palm Beach Country Club Swimming Pool be approved. Councilman Kelley seconded the motion, and all present voted aye. ADJOURNMENT There being no further business to come before the Council, the meeting adjourned at 8:50 p.m. C ~~ ~ 5
