ROLL CALL
Mayor Vastola called the meeting to order at 7:30 p.m. All members
of Council were present except Councilman Kelley, who was out of
town. All members of staff were present except Village Manager
Dennis Kelly, who was out of town. Chief Sekeres was present as
Acting Village Manager
' INVOCATION AND PLEDGE OF ALLEGIANCE
President Pro Tem Marks gave the invocation, and Councilman Valente
led the public in the Pledge of Allegiance to the Flag.
REPORT OF THE MAYOR
Mayor Vastola proclaimed August 15-19, 1994 as "Florida Water and
Pollution Control Operators Week" in the Village of North Palm
Beach. Lee Kraft, Director of Florida water & Pollution Control
Operators Association, Inc., Region 6, was present to accept the
Proclamation.

Councilman Valente moved that the recommendation of the Country
Club Administrative Board that Council "charge nominal rent, $100
per month, to Mr. Goeltz, for use of the tennis shop and facility"
be accepted for file only. President Pro Tem Marks seconded the
motion, and all present voted aye.
Councilman Valente moved that the recommendation of the Country
Club Administrative Board that Council " extend the rent reduction
to the Pool Director, Mr. Cavanah" be accepted for file only.

aye.
BILL 750 ENACTED AS ORDINANCE 13-94 - AMENDING SIGN CODE
Vice Mayor Atwater moved that Bill 750 entitled:
AN ORDINANCE OF THS VILLAGE OF NORTH PALM BEACH, FLORIDA,
AMENDING THE VILLAGE CODE, CHAPTER 6, ARTICLE V, SIGNS
AND OUTDOOR DISPLAYS, SECTION 6-111-G-2, MAINTENANCE,
SECTION 6-113-B-23, VEHICLE SIGNS, SECTION 6-115-C-2,
BUILDING WALL SIGNS; PROVIDING FOR CAPTIONS; PROVIDING
FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR INCLUSION IN THE VILLAGE CODE; AND,
PROVIDING FOR AN EFFECTIVE DATE

Vice Mayor Atwater moved that Bill 750 be enacted as
Ordinance 13-94. Councilman Valente seconded the motion, and all

ORDINANCES AT CHAPTER 17, ARTICLE II, OCCUPATIONAL
LICENSES; BY AMENDING SECTION 17-24, RELATING TO TRANSFER
OF LICENSE TO NEW OWNER; BY AMENDING CHAPTER 17-25,
RELATING TO TRANSFER OF LICENSE TO NEW LOCATION; BY

Councilman Valente moved that Ordinance 16-94 (Bill 753) entitled:
AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA,
ANNEXING TO THE VILLAGE CERTAIN AREAS OF PROPERTY;
PROVIDING A LEGAL DESCRIPTION OF THE PROPERTY PROPOSED TO
BE ANNEXED; REDEFINING THE BOUNDARIES OF THE VILLAGE TO
INCLUDE SAID PROPERTY; CALLING FOR A REFERENDUM ELECTION
IN THS VILLAGE AND WITHIN THE ARER PROPOSED TO BE
ANNEXED; DIRECTING THE VILLAGE CLERK TO PUBLISH NOTICE OF
THE REFERENDUM; AND PROVIDING FOR AN EFFECTIVE DATE

Mayor Vastola announced that an Information Meeting for the public
has tentatively been scheduled for Tuesday, August 23, 1994 to
address the proposed annexation.
RESOLUTION FOR SPECIAL CONSULTANT TABLED UNTIL 8/25/94
Vice Mayor Atwater moved to table a proposed resolution authorizing
and directing the Mayor and Village Clerk to enter into a
Consulting Agreement with Charles R. O'Meilia for consulting
services on municipal matters until the next Regular Session on
August 25, 1994. President Pro Tem Marks seconded the motion.
Councilman Valente declared a conflict of interest on this issue,
his daughter being married to Mr. O'Meilia's son. Mr. Valente
abstained from voting.
Thereafter, the motion passed 3-0.
RESOLUTION 32-94 ADOPTED - LABOR CONSULTANT
Vice Mayor Atwater moved that Resolution 32-94 entitled:
A RESOLUTION OF THE VILLAGE COUNCIL OF THB VILLAGE OF
NORTH PALM BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE
MAYOR AND VILLAGE CLERK TO ENTER INTO R LABOR RELATIONS
CONSULTANT AGREEMENT WITH PATRICIA I. TAYLOR, P. A.,
ATTACHED AS EXHIBIT "A"; AND PROVIDING FOR AN EFFECTIVE
DATE
be adopted. President Pro Tem Marks seconded the motion, and all
present voted aye.
RESOLUTION 33-94 ADOPTED - SPECIAL ASSESSMENT PUBLIC HEARING
Councilman Valente moved that Resolution 33-94 entitled:
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA, ESTABLISHING AND SETTING A
PUBLIC HEARING ON THS PROPOSED IMPROVEMENTS OF
CONSTRUCTION OF PUBLIC POTABLE WATER LINES ALONG WABASH
DRIVE, CIRCLE AIRS SUBDIVISION, AN UNRECORDED PLAT, WITH
' THE VILLAGE OF NORTH PALM BEACH; AND PROVIDING FOR AN
EFFECTIVE DATE

be adopted. President Pro Tem Marks seconded the motion, and all
present voted aye.
PLANNING COMMISSION RECOMMENDATION DENYING AMENDMENT TO ZONING CODS

Vice Mayor Atwater moved to accept the Planning Commission's
recommendation to deny application for awning structures in C-1
Commercial Zoning District as an accessory use for a service
station. Mayor Vastola passed the gavel to President Pro Tem Marks
and seconded the motion.
During discussion, Attorney Dan Corbett spoke on behalf of the
applicant, North Palm Beach Texaco, and asked the Village Council
to consider a proposed amendment to Code that he submitted to the
Planning Commission.
Thereafter, the motion failed 2-2, with Vice Mayor Atwater and
Mayor Vastola voting aye, and President Pro Tem Marks and
' Councilman Valente voting nay.
President Pro Tem Marks returned the gavel to Mayor Vastola.
PUBLIC SAFETY DEPT. FORFEITURE EXPENDITURE FOR TARGETS APPROVED
President Pro Tem Marks moved to approve Public Safety Dept.'s
request to spend $1,100 from Law Enforcement Trust Fund account
A5714-35296 (Ammo & Gun Parts) to purchase eight metal targets to
be used for firearms training. Councilman Valente seconded the
motion, and all present voted aye.
PUBLIC SAFETY DEPT. FORFEITUR$ EXPENDITURE .FOR COMPUTER SYSTEM
UPGRADE APPROVED
Councilman Valente moved to approve Public Safety Dept.'s request
to spend $11,211.24 from Law Enforcement Trust Fund account A5714-
66415 (Computer Hardware & Software) to upgrade the in-house
computer system to allow expanded capabilities. Vice Mayor Atwater
seconded the motion, and all present voted aye.
BUDGET TRANSFER APPROVED FOR PUBLIC SAFETY DEPT. PAYROLL ACCOUNT
Councilman Valente moved to approve the Public Safety Dept.'d
request to transfer $5,000 from A5711-11210 (Regular Pay) to
' A5711400 (Overtime Pay); $1,100 from A5711-11410 (Holiday Overtime)
to A5711-11420 (Training Overtime); and $2,600 from A6416-11210
(Regular Pay) to A6416-11400 (Overtime Pay) for the purpose of

covering unanticipated shortages in payroll accounts. Vice Mayor
Atwater seconded the motion, and all present voted aye.
