ROLL CALL
Mayor Gardner called the meeting to order at 7:30 p.m. All members
of Council were present. All members of staff were present.
INVO-CATION AND PLEDGE OF ALLEGIANCS
Councilman Kelsey gave the invocation, and President Pro Tem Marks
' led the public in the Pledge of Allegiance to the Flag.

REPORT OF THE MAYOR
Mayor Gardner moved Item ll.a of the agenda forward at this time.
Vice Mayor Pierman moved that Resolution 36-91 entitled:
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA, TO COMMEMORATE ALFRED J.
MCKENNR, TO OFFER CONDOLENCES TO HIS FAMILY AND TO
RECOGNIZE THE CONTRIBUTION MADE BY HIM TO THE VILLAGE;
AND PROVIDING FOR AN EFFECTIVE DATE HEREOF
' be adopted. Councilman Grinn seconded the motion, and all present
voted aye.

The Village Clerk was directed to send a copy of the Resolution to
Mr. McKenna's family, as well as a copy to Marge Nevala, a friend
of the family and a member of the North Palm Beach Community Band.
Discussion was held concerning residency cards which are now
available at the country Club Administration office. The current
newsletter article is to be rewritten for the next issue to make it
clear that the residency card is not mandatory, but optional and
voluntary. Additionally, further explanation of the benefit of the
residency card is needed.

BILL 663 - AMENDING ORDINANCE 39-90 (CCAB) PLACED ON FIRST READING
President Pro Tem Marks moved that Bill 663 entitled:
AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA,
AMENDING SUBSECTION C ENTITLED "FINANCES" OF SECTION 6 OF
ORDINANCE NO. 39-90 WHICH CREATED A COUNTRY CLUB
ADMINISTRATIVE BOARD; ADDING A SUBSECTION D ENTITLED
"PERSONNEL" OF SECTION 6 OF ORDINANCE NO. 39-90;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN
EFFECTIVE DATE
be placed on first reading and read by title alone. Councilman
Kelsey seconded the motion.
After lengthy °discussion regarding_-'the proposed changes to Bill
663, Councilman Grinn moved to call the question, which was
seconded by Councilman Kelsey. with a 2/3 vote required, the
motion failed 3-2, with Councilman Grinn, Councilman Kelsey and.
President Pro Tem Marks voting aye, and Vice Mayor Pierman and
Mayor Gardner voting nay.
1 After continued discussion, the original motion to place on first
reading passed unanimously.

BUDGET TRANSFER - LEGAL SERVICES (TABLED 9/26). Village Attorney
George Baldwin addressed the Council regarding the requirement for
Pub11c Hearing on the settlement_o_f the Kelly Riley lawsuit. Mr.
Baldwin has not found any case law or Attorney General opinion
concerning this. Mr. Baldwin has written to the Attorney General
requesting his opinion, and requested that the Council postpone
their decision on this issue.
Councilman Grinn moved to take the budget transfer from the table,
with a second by Councilman Kelsey. The motion failed 2-3, with
Councilman Grinn and Councilman Kelsey voting aye, and President
Pro Tem Marks, Vice Mayor Pierman and Mayor Gardner voting nay.
With no further business to come before the Council, the meeting
adjourned at 8:28 p.m.
