ROLL CALL
Mayor Gardner called the meeting to order at 7:35 p.m. All members
of Council were present. All members of staff were present.
The Regular session immediately recessed until after the Public
Hearing, and reconvened at 7:42 p.m.
INVOCATION AND PLEDGE OF ALLEGIANCE
Vice Mayor Pierman gave the invocation, and Councilman Kelsey led
the public in the Pledge of Allegiance to the Flag.
APPROVAL OF MINUTES

REPORT OF THE MAYOR
Mayor Gardner read into the record a letter from Public Safety
Director Bruce Sekeres to Paramedic Paul Giuffre, Sergeant Thomas
Parks, and PSO Donald Zimmerman, commending them for their job
performance in delivering Baby Girl Shibley at the Village Hall on
November 5, 1991. A copy of this letter is attached to the
official copy of these Minutes.
A question was addressed to the Manager concerning the hiring
freeze policy, which was tabled on November 14, 1991, but not shown
on this agenda. The Manager stated that more time is needed for
review of the draft policy.
' Vice Mayor Pierman moved to continue tabling of the hiring freeze
policy until the next meeting, and President Pro Tem Marks seconded
the motion. All present voted aye.

Vice Mayor Pierman moved that Resolution 45-91 entitled:
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA, ESTABLISHING A SPECIAL
REFERENDUM ELECTION ON JANUARY 6, 1992, AT WHICH TIME THE
QUALIFIED ELECTORS OF THE VILLAGE MAY VOTE TO DETERMINE
WHETHER OR NOT ORDINANCE NO. 29-91 AND ORDINANCE NO. 32-
91, RESPECTIVELY, ADOPTED BY THE VILLAGE COUNCIL SHOULD
BE REPEALED; DIRECTING THE VILLAGE CLERK TO PUBLISH
NOTICE OF THE SPECIAL REFERENDUM ELECTION TO BE HELD ON
JANUARY 6, 1992; NAMING THE TIME AND PLACE WHERE SUCH

(COUNTYWIDE PLANNING COUNCIL] OF THE CHARTER OF PALM
BEACH COUNTY, FLORIDA; URGING SUPPORT FROM OTHER LOCAL
GOVERNMENTS; PROVIDING FOR DISTRIBUTION; AND PROVIDING AN
EFFECTIVE DATE
be adopted. Councilman Grinn seconded the motion, and all present
voted aye.
JACKIE WINCHESTER - VILLAGE'S REPRESENTATIVE FOR L & A TESTING
President Pro Tem Marks moved to designate Jackie Winchester,
Supervisor of Elections, or her designee, as the Village's
representative for the Logic and Accuracy testing of the tabulating
equipment for Friday, January 3, 1992 at the Palm Beach
Governmental Center, for the special referendum election of January
6, 1992. Councilman Kelsey seconded the motion, and all present
voted aye.
' BUDGET TRANSFER - AIR PACK UNIT5 UPGRADE
President Pro Tem Marks moved that Public Safety's request to
transfer $1,218.00 from A4902-34010 (Travel) to A6416-34650 (R & M-
Machinery) to upgrade air pack units be approved. Councilman
Kelsey seconded the motion. The motion passed 4-1, with President
Pro Tem Marks, Councilman Kelsey, Vice Mayor Pierman and Mayor
Gardner voting aye, and Councilman Grinn voting nay.
BOAT MOTOR DECLARED SURPLUS EQUIPMENT
Vice Mayor Pierman moved to approve the declaration of the patrol
boat motor as surplus, and to authorize staff to use it as trade-in
on a new motor. Councilman Grinn seconded the motion, and all
present voted aye.
BUDGET TRANSFER FOR PAY TELEPHONE SUBSIDY - ACTION POSTPONED
President Pro Tem Marks moved to transfer funds in the amount of
$1,090.20 from A5540-49911 (Council Contingency) to various
accounts for the purpose of subsidizing the cost of selected
locations for pay telephones. Councilman Kelsey seconded the
motion.
John Murray, a representative of Southern Bell branch office in
Fort Lauderdale, was present to explain that Southern Bell must

remove certain pay telephones within the Village because revenues
from said pay stations were below the minimum required.
After discussion, Councilman Grinn moved to amend the original
motion by transferring $782.00 from A4902-34010 (Travel) to Council
Contingency (A5540-49911). Councilman Kelsey seconded the motion.
The motion to amend failed 2-3, with Councilman Grinn and
Councilman Kelsey voting aye, and President Pro Tem Marks, Vice
Mayor Pierman and Mayor Gardner voting nay.
Upon further discussion, Mr. Murray consented to continue an
analysis of revenues from the pay phones, and to postpone removal
of the stations until an itemized list of calls could be presented
to the Council at the next Regular Session of January 9, 1992.
Thereafter, the original motion and second were withdrawn, pending
additional information from Southern Bell.
INSURANCE DEDUCTIBLE - KELLY RILEY CASE
President Pro Tem Marks moved to authorize staff to expend the
balance of the insurance deductible of $4,027.75 to FIRMA, from
A5105-33112 for the purpose of rounding out the $10,000 deductible
in satisfaction of the Kelly Riley lawsuit. Mayor Gardner passed
the gavel to Vice Mayor Pierman and seconded the motion.
The motion passed 5-0, and Vice Mayor Pierman returned the gavel to
Mayor Gardner.
ARBITRATION HEARING PROSPECTIVE SETTLEMENT
President Pro Tem Marks moved to deny an increase of 9~ and 5% for
pay increments for Fire, EMT and Paramedics certification. Mayor
Gardner passed the gavel to Vice Mayor Pierman and seconded the
motion.
After discussion concerning the arbitration hearing scheduled for
January 16, 1992, President Pro Tem Marks moved to table his
original motion until January 9, 1992. Mayor Gardner seconded the
motion to table, and all present voted aye.
With no further business to come before the Council, the meeting
