VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA

THURSDAY, JUNE 6, 1985

Mayor Valente called the Regular Session to order at 5:30 P.M.
All members of the Council and the staff were present.
The purpose of the Special Session was to have the Village
Council determine the appropriate action to be taken by them with
respect to judgments rendered against the Village in the cases of
Paul Gaines vs. the Village and Gerald Roberts vs. the Village.
Vice Mayor Moore moved that we determine the appropriate action
to be taken by the Village Council with respect to judgments
rendered against the Village Sn the cases of Paul Gaines vs. the
Village and Gerald Roberts vs. the Village. The motion was
seconded by Councilman Mundt and passed unanimously.
' After a lengthy discussion, and upon the advice of the Village
Attorney, President Pro Tem Nolan moved that we make a claim
against FIRMA (self-insurance program for Palm Beach County
municipalities) on the judgments in favor of Paul Gaines and
Gerald Roberts against the Village, and that we strongly recommend
that they seek to overturn the default and give the Village the
opportunity to provide defenses to the matters on which the
Village was sued. The motion was seconded by Councilman Mundt.
Vice Mayor Moore moved to amend the motion as follows: that we
file suit against Mr. Gaines and against Mr. Roberts with respect
to their going back to the pension plan that was in effect when
they were first hired by the Village. The motion died for lack
of a second.
Thereafter Council voted on the main motion which passed 3-2,
with Mayor Valente, President Pro Tem Nolan and Councilman Mundt
voting aye, and Vice Mayor Moore and Councilman Marks voting
nay.
There being no further business to come before the Council, the
Special Session was adjourned at 6:17 p.m.
