04-25-1985 VC REG-MMINUTES OF REGULAR SESSION OF-THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, APRIL 25, 1985 Present: Tom Valente, Mayor Al Moore, Vice Mayor ' Harriet Nolan, President Pro Tem V. A. Marks, M. D., Councilman Craig Mundt, Councilman Raymond J. Howland, Village Manager Herbert L. Gildan, Village Attorney Dolores R. Walker, Village Clerk Mayor Valente called the Regular Session to order at 7:30 p.m. ROLL CALL All members of the Council were present except Councilman Marks who arrived at 7:40 p.m. Councilman Mundt gave the invocation and Vice Mayor Moore led the INVOCATION & Council and the public in the Pledge of Allegiance to the Flag. PLEDGE OF ALLEGIANCE The Minutes of Regular Session held Thursday, April 11, 1985 were APPROVAL OF approved as written. MINUTES The Minutes of Pension Board Meeting for General Employees held ACCEPTANCE OF March 11, 1985 stand as corrected. MINUTES Councilman Marks moved that Bill No. 461 entitled: BILL 461 PLACED ' ON SECOND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH BUDGET FOR FISCAL YEAR 1984-85 BY APPROPRIATION TRANSFERS (LONGEVITY PLAN) be placed on second reading and read by title alone. The motion was seconded by Vice Mayor Moore and passed 4-1, with Councilman Mundt opposed. Vice Mayor Moore moved that Bill No. 461 be adopted as Ordinance BILL 461 ADOPTED No. 4-85. The motion was seconded by Councilman Marks and passed AS ORD. 4-85 4-1, with Councilman Mundt opposed. Councilman Mundt moved that Bill No. 462 entitled: BILL 462 PLACED ON AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA FIRST READING AMENDING THE NORTH PALM BEACH BUDGET FOR FISCAL YEAR 1984-85 BY APPROPRIATION TRANSFERS (PRIOR YEAR'S SURPLUS) be placed on first reading and read by title alone. The motion was seconded by Councilman Marks and passed 4-1, with Vice Mayor Moore opposed. Councilman Mundt moved that Bill No. 463 entitled: BILL 463 PLACED ON t AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, FIRST READING AMENDING THE NORTH PALM BEACH BUDGET FOR FISCAL YEAR 1984-85 BY APPROPRIATION TRANSFERS (ROF) be placed on first reading and read by title alone. The motion was seconded by President Pro Tem Nolan and passed 4-1, with Vice Mayor Moore opposed. Minutes of Regular Session Held Thursday, April 25, 1985 Page 2 Councilman Mundt moved that Bill No. 464 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 19 OF THE VILLAGE OF NORTH PALM BEACH CODE BY ADOPTING CHAPTER 40E-21 OF THE FLORIDA ADMINISTRATIVE ' CODE, AS SAME MAY BE AMENDED FROM TIME TO TIME, AS THE WATER SHORTAGE PLAN FOR THE VILLAGE OF NORTH PALM BEACH. be placed on first reading and read by title alone. The motion was seconded by President Pro Tem Nolan and passed unanimously. Councilman Marks moved that Bill No. 465 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ANENDING CHAPTER 6 OF THE UILLAGE CODE (THE SIGN CODE) BY PERMITTING CERTAIN CHANGEABLE COPY PANEL SIGNS be placed on first reading and read by title alone. The motion was seconded by Councilman Mundt and passed unanimously. Deborah Diaz, Art Loreto, Jim Cleveland and Jim Green were nominated for appointment to the Country Club Advisory Board for a term ending May 1, 1987. After the ballots were counted, it was determined that Deborah Diaz, Jim Green and Jim Cleveland were appointed to the Country Club Advisory Board. Councilman Mundt moved that Resolution No. 13-85 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, ' FLORIDA, APPOINTING MEMBERS TO THE COUNTRY CLUB ADVISORY BOARD OF THE VILLAGE OF NORTH PALM BEACH be adopted. The motion was seconded by Councilman Marks and passed unanimously. Thelma Obert, Judy LaRue, Maureen Quinlan, Patricia Atwater, J. G. Daniels, James Weis, and Jacob Shapiro were nominated for appointment to the Library Advisory Board for a term ending May 1, 1987. After the ballots were counted, it was determined that James Weis, Patricia Atwater, J. G. Daniels and Thelma Obert were appointed to the Library Advisory Board. Vice Mayor Moore moved that Resolution No. 14-85 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBERS TO THE LIBRARY ADVISORY BOARD OF THE VILLAGE OF NORTH PALM BEACH be adopted. The motion was seconded by President Pro Tem Nolan and passed unanimously. Ivan Simmons, Jean Peterson, John Ridgway, Donald Small, Gail Vastola and Donald Foy were nominated for appointment to the Planning Commission. Council voted on the regular members and ' the alternate members at the same time. Three regular members were needed; however, one member, in accordance with the Village Code, must be a civil engineer, and no one with with that qualification applied for appointment to the Planning Commission, so that vacancy must remain until a civil engineer applies. Therefore, Council voted on two regular members and two alternate members. The two persons receiving the highest number of votes will be appointed as regular members. The member receiving the third highest number of votes will be appointed first alternate and the member receiving the least number of votes will be appointed second alternate. After the ballots BILL 464 PLACED ON FIRST READING BILL 465 PLACED ON FIRST READING APPOINTMENTS TO COUNTRY CLUB ADVISORY BOARD RES. 13-85 ADOPTED APPOINTMENTS TO LIBRARY ADVISORY BOARD RES. 14-85 ADOPTED APPOINTMENTS TO PLANNING COMMISSION Minutes of Regular Session held Thursday, April 25, 1985 Page 3 were counted, it was determined that Ivan Simmons and Donald Small were appointed to the Planning Commission as regular members for a term ending May 1, 1987. Donald Foy and John Ridgway were appointed first and second alternate members, respectively, for a term ending May 1, 1986. ' President Pro Tem Nolan moved that Resolution No. 15-85 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBERS TO THE PLANNING COMMISSION OF THE VILLAGE OF NORTH PALM BEACH be adopted. The motion was seconded by Vice Mayor Moore and passed unanimously. Neil Turney, Donald Ruffing, Louis Hamby III, and Gail Vastola were nominated for appointment to the Code Enforcement Board for a term ending May 1, 1988. After the ballots were counted, it was determined that Neil Turney and Louis Hamby III were appointed to the Code Enforcement Board. Vice Mayor Moore moved that Resolution No. 16-85 entitled: A RESOLUTION DF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBERS TO THE CODE ENFORCEMENT BOARD OF THE VILLAGE OF NORTH PALM BEACH be adopted. The motion was seconded by Councilman Mundt and passed unanimously. Agnes Rogers, Judy Pierman, Mitchell Beers, Judy LaRue and Jean Peterson were nominated for appointment to the Recreation Advisory Board for a term ending May 1, 1987. After the ballots were counted, it was determined that Judy Pierman, Mitchell Beers and Agnes Rogers were appointed to the Recreation Advisory Board. President Pro Tem Nolan moved that Resolution No. 17-85 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH FLORIDA, APPOINTING MEMBERS TO THE RECREATION ADVISORY BOARD OF THE VILLAGE OF NORTH PALM BEACH be adopted. The motion was seconded by Councilman Mundt and passed unanimously. Cooper Lansing, John Nossal, Samuel Frisch, Gail Vastola and Donald Ruffing were nominated for appointment to the North Palm Beach Board of Adjustment. Council voted on two regular members and two alternate members. The two persons receiving the highest number of votes will be appointed as regular members. The member receiving the third highest number of votes will be appointed ' first alternate and the member receiving the least number of votes will be appointed second alternate. After the ballots were counted, it was determined that John Nossal was appointed to the Board of Adjustment as a regular member for a term ending May 1, 1987, and Cooper Lansing was appointed as a regular member for a term ending May 1, 1986. RES. 16-85 ADOPTED APPOINTMENTS TO RECREATION ADVISORY BD. RES. 17-85 ADOPTED APPOINTMENTS TO NPB BOARD OF ADJUSTMENT t ~ Minutes of Regular Session Held Thursday, April 25, 1985 Page 4 F' ~ President Pro Tem Nolan moved that Resolution No. 18-85 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBERS TO THE NORTH PALM BEACH BOARD OF ADJUSTMENT AND SETTING FORTH THEIR TERMS OF OFFICE be adopted. The motion was seconded by Councilman Mundt and passed unanimously. William Young was nominated unanimously for the position of Village Historian. Therefore, he was appointed Village Historian fora term ending May 1, 1986. Vice Mayor Moore moved that Resolution No. 19-85 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, APPOINTING A PERSON TO THE POSITION OF VILLAGE HISTORIAN be adopted. The motion was seconded by Councilman Marks and passed unanimously. All the ballots will be attached to the minutes of this meeting. Councilman Mundt moved that Resolution No. 20-85 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA ACCEPTING THE BID OF ROGER WHITLEY CHEVROLET, TAMPA, FLDRIDA, FOR ONE 20 CUBIC YARD PACKER TRUCK IN THE AMOUNT OF $37,293.00 FROM PRIOR YEARS SURPLUS ' be adopted (contigent upon adoption of the budget ordinance for prior years surplus expenditures.) The motion was seconded by Councilman Marks and passed 3-2, with Vice Mayor Moore and President Pro Tem Nolan opposed. Councilman Marks moved that Resolution No. 21-85 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF DOWLING FIRE EQUIPMENT, SILVER SPRINGS, FLORIDA, FOR ONE FIRE PUMPER IN THE AMOUNT OF $99,428.00, AND THE EQUIPMENT BID AWARD TO BROWARD FIRE EQUIPMENT OF FT. LAUDERDALE, FLORIDA, IN THE AMOUNT OF $3,281.93, BOTH AMOUNTS TO BE EXPENDED FROM PRIOR YEARS SURPLUS be adopted (contingent upon adoption of the budget ordinance for prior years surplus expenditures.) The motion was seconded by Councilman Mundt. The meeting recessed at 9:15 p.m. and reconvened at 9:25 p.m. President Pro Tem Nolan moved to amend the motion as follows: that we reject the low bid (FMC Corporation, Tipton, Indiana) because they did not meet the specifications of the wheel base. The motion was seconded by Councilman Mundt and passed 3-2, with ' Vice Mayor Moore and Councilman Marks opposed. Thereafter Council voted on the main motion, as amended, which passed 4-1, with Vice Mayor Moore opposed.
