IN GENERAL Sec. 24.17, Refilling, tamping by excavator; resurfacing by village. Secs. 24.1, 24.2. Reserved. Editor's note — Ordinance No. 10 -80, § 1, adopted May 22, 1980, repealed §§ 24 -1 and 24.2, relative to placing banners, etc., across streets and street numbers required in the village, respectively. Section 24.1 derived from Code 1970, § 24.9; § 24.2 derived from Code 1970, § 6.2 and Ord. No. 14 -75, § 1, adopted Sept. 25, 1975. Sec, 24.3. Sodding of swale areas required in certain instances. It shall be the obligation of the owner of any residential property in the village where a resi- dence is under construction to sod the area be- tween the lot line thereof and the street pave- ment, in a manner to be approved by the village engineer before the building inspector shall be authorized to issue an occupancy permit for the residence upon such lot. (Code 1970, § 35 -35) Sec, 24 -4. Cost of changing or removal of public utilities. The applicant for a permit to make alterations as provided by this chapter shall pay for the changing or removal of all public utilities occa- sioned by the construction covered by such permit, and shall post an additional deposit in an amount equal to the village engineer's estimates of the cost of same. (Code 1970, § 35 -33) Secs. 24.5 - 24.15. Reserved. ARTICLE II. EXCAVATIONS DIVISION 1. GENERALLY Sec. 24.16. Definition. As used in this article, "excavation work" shall mean the excavation and other work permitted under an excavation permit and required to be performed under this chapter. (Code 1970, § 35.1(1)) Cross reference —Rules of construction and definitions gen- erally, § 1.2. 1519 (a) The person making any excavation in any street, under a permit as provided in this article, shall immediately upon the completion of the work of such excavation, refill, puddle and tamp the backfill in a good and workmanlike manner so that such street is in the same condition as it was before such excavation was made, in all respects, save that of resurfacing the surface thereof. (b) Resurfacing shall in all cases be made by the village. The cost of resurfacing shall be paid for by the person opening such street and the cost thereof, as estimated by the village manager, shall be collected when the permit fee is paid and be- fore the permit is issued. (Code 1970, § 35 -13) Sec. 24.18. Equipment to be guarded. It shall be unlawful for the permittee to suffer or permit to remain unguarded at the place of excavation or opening any machinery, equipment or other device having the characteristics of an attractive nuisance likely to attract children and hazardous to their safety and health. (Code 1970, § 35 -14) Sec. 24.19. Protective measures. (a) The permittee shall erect such fence, railing or barriers about the site of the excavation work as shall prevent danger to persons using the vil- lage street or sidewalks and such protective bar- riers shall be maintained until the work shall be completed or the danger removed. (b) At twilight, there shall be placed upon the place of excavation and upon any excavated ma- terials or structures or other obstructions to streets, suitable and sufficient lights which shall be kept burning throughout the night during the maintenance of such obstruction. (Code 1970, § 35.15) Sec. 24.20. Liability of village. SIDEWALKS AND sued hereunder. DRIVEWAYS (Code 1970, § 35 -16) DIVISION 1. GENERALLY Secs. 24.21 - 24.27. Reserved. DIVISION 2. PERMIT Sec. 24.28, Required. Any person intending to make any installation, construction, alteration, extension or repair, or otherwise do any work, either necessary or inci- dental, which shall require any excavation in, upon, under or through any street within the vil- lage shall, before making any such excavation, make written application to the building official upon blanks to be furnished by the village and receive from the building official a permit to do the work so intended and to make such excava- tion, (Code 1970, § 35.11) Sec. 24.29. Fees. A person making application for permit required by this division shall, as a condition precedent thereto, pay to the village at the time of making such application a fee therefor as follows: (1) For excavation in an unimproved street, av- enue, alley or thoroughfare, three dollars ($3.00). (2) For excavation in an improved street, alley or thoroughfare where the top surface thereof is of asphalt, oil or like substance, five dollars ($5.00). (3) For excavation in an improved street, av- enue, alley or thoroughfare where the top surface thereof is of cement, concrete or a like substance, five dollars ($5.00). (Code 1970, § 35.12) Secs, 24.30 - 24.40. Reserved. Sec. 24.41. Sidewalks— Construction re- quired in certain cases. (a) Before a building permit shall be issued for .the erection of any structure upon any plot of land in the village not improved by a paved and usable sidewalk fronting such plot, the plans for such construction must include provisions for construc- tion concurrently with the construction of the building of a sidewalk in accordance with specifi- cations as set forth in section 24.43. Subject to the approval of the village engineer, such sidewalk shall be built at the expense of the owner of such property. No certificate of occupancy shall be is- sued as to such building unless and until such sidewalk is completed. (b) The provisions of this section shall also apply to permits for the repairs of existing buildings upon any plot of land not improved by such a paved and usable sidewalk in the case where the total cost of such repairs, as determined by the building inspector, shall equal or exceed twenty -five (25) percent of the last assessed village tax valuation of the buildings to be repaired. (c) Where a sidewalk would have to be con- structed under paragraph (a) of this section in that it fronted on a.dedicated public street, and where a portion of such public street had not yet been constructed, the provisions of such paragraph shall be waived and the property owner shall deposit with the village a sum of money equal to the cost of constructing a sidewalk. The cost of constructing such sidewalk shall be determined by the building inspector securing three (3) bona fide bids and taking the lowest such bid as the determination of cost. It shall not be necessary in acquiring these bids to publicly advertise for same in a news- paper. The monies acquired by the village in lieu of the construction of a sidewalk under this sub- section may be added to the general fund and no- tation made thereof on the building permit for such property.
