03-12-1981 VC REG-MNLINUTFS OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, MARCH 12, 1981 1 1 Present: V. A. Marks, M. D., Mayor Tom Valente, Vice Mayor W. H. Brown, President Pro Tem Al Moore, Councilman Harriet Nolan, Councilwoman Herbert L. Gildan, Village Attorney Raymond J. Howland, Village Manager Dolores R. Walker, Village Clerk Mayor Marks called the Regular Session to order at 7:30 p.m. ROLL CALL A11 members of the Council and staff were present. President Pro Tem Valente gave the invocation and Councilwoman IlWOCATION & Nolan led the Council and the public in the Pledge of Allegiance PLEDGE OF to the Flag. ALLEGIANCE The organization of the Council is required by the Village COUNCIL ORGANIZATION Charter to be done at the next regular session of the Council following the election of arty Cotimci7man. Therefore, Council proceeded with its organization in accordance with Article III, Section 3, of the Village Charter. Councilman. Brown nominated V. A. Marks for the office of Mayor V. A. MARKS of the Village of North Palm Beach. There being no further ELECTID MAYOR nominations, V. A. Marks was elected Mayor. Councilwoman Nolan nominated Al Moore for the office of Vice TOM VALENTE Mayor of the Village of North Palm Beach. Mayor Marks nominated ELECTED VICE MAYOR Tom Valente. Council then voted by ballot on the nominations for Vice Mayor. Tom Valente received three votes and Al Moore received two votes; therefore, Tom Valente was elected Vice Mayor of the Village of North Palm Beach. The ballots shall be spread upon the minutes of the Cotmcil. President Pro Tem Valente n~+nated Al Moore for the office NOMINATION FOR of President Pro Tem of the Village of North Palm Beach. PRESIDENT PRO TEM Al Moore declined the nomination. A. Marks as PLACEMENT' OF NAMES Mayor; Tom Valente as Vice Mayor; and W. H. Brown as ON_PROPOSID RES. The Village Clerk administered the Oath of Office to Mayor Marks, Vice Mayor Valente and President Pro Tem Brown. These oaths shall be spread upon the minutes of the Council. The Minutes of Regular Session held Thursday, February 26, 1981 stand as corrected. OATHS OF OFFICE APPROVAL OF MINUTES 1 n ~~~ Mr. Joe B. Wise, Vice President of William R. Hough & Co., presented his offer to purchase bonds and the conditions that they offer. Councilwoman Nolan nmved that we accept the purchase proposal of William R. Hough & Co. (for $1,170,000 Iuq~rovenrxit Revenue Bonds, Series 1981). The motion was seconded by President Pro Tem Brown and all present voted aye. Councilman Moore read the following statement into the record: "During the past five years on the Council, I have often spoke alone on many subjects which I felt someone had to make in defense of the Village. Tonight I play that role again. The past twv months have been intolerable due to the many inaccurate newspaper articles about the Cable TV bulk rates. Nbst of the news on this subject has led the general public to ask, "Is there only one meunber of the Council -- *,~iiere are the other four members -- do they have their heads in the sand? Let's be fair to each other. Prior to the February 8th newspaper article locally, did each of you know about the bulk rate area? Did you have any phone calls from people in the bulk rate area? I'm sure that only one Council member can say yes to the first question and maybe only one can say yes to the second. I also ask, if you would have known, would you have held the information from the Council where 2,000 people for three months had paid a higher rate than they should have, or would you have presented it to the Coumcil when you first knew it? I also question why a Cancil member waited until February before he demanded action -- action through a local newspaper and a letter by the Village Manger to Perry Cable TV. Why didn't he ask the Council for help in December? I think the answer was plainly printed in distributed ca~aign literature recently passed out. PRESE~ATION OF BOND PURCHASE PROPOSAL ACCEPTANCE - PURCHASE PROPOSAL - Tn~I. R. HOUQ3 & CO. COUNCn MAN N~ORE' S STATH~fFT1T FOR THE RECORD Last night I heard a Councilman. swear for the third time to his Oath of Office. I was amazed at the ease with which he swore that he would faithfully, honestly, and impartially discharge his duties as a Councilman. The past two months haven't been very faithfully and impartially upheld. On February 26, 1981 I questioned him about the bulk rate and the publicity that was being held. I also asked him about breaking the trust which was agreed uzpon at a February 23rd meeting -- his statement to us on February 26th that the press had called him. He in turn had called Mr. Gildan about the call he received from the press and Mr. Gildan said, "tell the truth." At that meeting he also stated he called Mr. Perry anal Mr. Perry in turn had returned his call. On March 2, 1981, I called Deborah Caldwell at Channel 5 to determine how they were able to interview Minutes o£ Regular Session Held Thursday, March 12, 1981 Page 3 Mr. Brown at approximately 7:15 p.m. on February 23rd, which was roughly two hours after the meeting had broken up. The young lady in question told me someone had called, and suggested that she call Mr. Brown who wz~ul.d be glad to give an interview. I also called Mr. Perry on March 2, 1981. He stated he had not received a call on February 23rd from Mr. Brawn, nor had he placed a call. In fact, he had not seen or heard from him since ' the meeting of February 23rd. On March 2, a call was made to WeekDay to find out who gave them the information on the February 23rd meeting for their Wednesday, February 25, edition. The answer received was soneone had called in the story. Let's stop and think who attended the meeting. Who gave out the information -- Mr. Howland, Mr. Gildan -- they had nothing to gain. Mr. Perry or his attorney -- they had already lost quite a bit due to newspaper articles. Mrs. Tw-ney? No, she was already defeated. Who does that leave? Why did I make this statement? Quite simple -- Mr. Brown hasn't faithfully, honestly, or impartially discharged his duties as a Councilman. I move that the Council ask Mr. Brown to resign inmediately and accept his resignation." The motion died for lack of a second. President Pro Tem Brown replied that if the Council so desires, he NO COLM7ENTS FROM could answer that, or if the Council desires, he wouldn't. Mayor COUNCIL Marks stated he really didn't think it should be answered, and he asked the other members of the Cotmcil if they wanted to say anything. None of them did. The Minutes of Regular Meeting of North Palm Beach Gauntry Club Advisory Board held February 17, 1981 stand as corrected. The Minutes of Regular Meeting of 25th Anniversary Committee held March 4, 1981 stand as prepared. The Village Council took no action on the recomm~adation of the North Palm Beach Cotmtry Club Advisory Board concerninro the operation of the cotmtry club dining room and bar, since Council is in the process of negotiating a lease with Danner Associates, Inc. for the use of these facilities. The Co~mtry Club Advisory Board's recaumendation concerning the changir~ of the tee was placed on Council's 3/12/81 workshop session agenda. Councilwoman Nolan moved that we have up to $3,000 available (for the 25th Anniversary Commi.ttee's budget) to be expended from Account No. 61-519-99.11, Council Contingency. The trotion was seconded by Vice Mayor Valente and all present voted aye. On motion of Councilwoman Nolan, seconded by President Pro Tem Brown - 4-1, with Councilman. The~rotion was seconded by Counci]man Moore and all present voted aye. Councilwoman Nolan moved that we discuss the Valerie Delacorte Commtnv.ty Center. The motion was seconded by Vice Mayor Valente and all present voted aye. Steve Yeckes, Architect for the Valerie Delacorte Cnrmnmity Center, made a presentation to the Village Council on the conceptual drawings for the Center. Councilwoman Nolan moved that we authorize the architect (Steve Yeckes) to proceed with working drawings based on pre1~*~*~nary plans and elevations for the Valerie Delacorte ~~ m;ty Center. The motion was seconded by Vice Mayor Valente anal-a11 present voted aye.
