01-28-2016 VC REG-MPresent: Absent: ROLL CALL MINUTES OF THE REGULAR SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA JANUARY 28, 2016 Robert A. Gebbia, Mayor David B. Norris, Vice Mayor Doug Bush, President Pro Tern Darryl C. Aubrey, Sc.D., Councilmember James P. Kelly, Village Manager Len Rubin, Village Attorney Melissa Teal, Village Clerk Mark Mullinix, Councilmember Mayor Gebbia called the meeting to order at 7:30 p.m. All members of Council were present, except Councilmember Mullinix, who was out of town. All members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE President Pro Tern Bush gave the invocation and Vice Mayor Norris led the public in the Pledge. APPROVAL OF MINUTES The Minutes of the Regular Session held January 14, 2016 were approved as written. PUBLIC HEARING AND SECOND READING OF ORDINANCE 2016 -04 — NPB SURGERY CENTER PUD A motion was made by Vice Mayor Norris and seconded by President Pro Tern Bush to adopt and enact on second reading Ordinance 2016 -04 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, CREATING A COMMERCIAL PLANNED UNIT DEVELOPMENT ON APPROXIMATELY 1.20 ACRES OF REAL PROPERTY LOCATED ON THE EAST SIDE OF U.S. HIGHWAY ONE APPROXIMATELY 450 FEET SOUTH OF THE INTERSECTION OF U.S. HIGHWAY ONE AND YACHT CLUB DRIVE, AS MORE PARTICULARLY DESCRIBED HEREIN; PROVIDING FOR THE DEVELOPMENT OF THE PROPERTY IN ACCORDANCE WITH THE PLANS, SPECIFICATIONS, WAIVERS AND CONDITIONS REFERENCED IN THIS ORDINANCE; PROVIDING PROCEDURES FOR FUTURE MODIFICATIONS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Mayor Gebbia opened the public hearing. Alison Harvey, 817 Anchorage Drive, asked if any variances to the property setbacks had been requested or approved and what changes had been allowed for this project. Tim Hullihan, 840 Country Club Drive, commented that 1.20 acres was very small for a PUD. There being no further comments from the public, Mayor Gebbia closed the public hearing. Thereafter, the motion to adopt and enact Ordinance 2016 -04 on second reading passed with all present voting aye. Councilmember Aubrey seconded the motion and all present voted aye. The following items were approved: Receive for file Minutes of the Golf Advisory Board meeting held 12/21/15 Receive for file Minutes of the Recreation Advisory Board meeting held 1/12/16 RESOLUTION 2016 -02 — REASONABLE ACCOMODATION PROCEDURE — TABLED 1/14/16 A motion was made by President Pro Tern Bush, seconded by Councilmember Aubrey, and passed by unanimous vote of those present, to take from the table Resolution 2016 -02: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ESTABLISHING A PROCEDURE FOR REASONABLE ACCOMMODATION REQUESTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Kelly reviewed the changes made to the procedure. Mr. Rubin explained the length of time allotted for review of applications was necessary due to the planning and legal analysis required for such requests. Thereafter, the motion to adopt Resolution 2016 -02 passed with all present voting aye. RESOLUTION 2016 -03 — LAW ENFORCEMENT TRUST FUND EXPENDITURE FOR LEX PROJECT A motion was made by Vice Mayor Norris and seconded by Councilmember Aubrey to adopt Resolution 2016 -03 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA APPROVING THE EXPENDITURE OF $4,800.00 FROM THE LAW ENFORCEMENT TRUST FUND FOR ASSET FORFEITURES TO FUND THE VILLAGE'S CONTINUED PARTICIPATION IN THE PALM BEACH COUNTY LAW ENFORCEMENT EXCHANGE PROJECT; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Kelly stated that Chief of Police Rick Jenkins certified the requested expenditure complies with the requirements governing the use of proceeds from the law enforcement trust fund. Thereafter, the motion to adopt Resolution 2016 -03 passed with all present voting aye. VILLAGE COUNCIL MATTERS /REPORTS President Pro Tern Bush noted the upcoming workshop concerning boats and recreational vehicles and requested that Mr. Kelly provide Council with information on this issue prior to the meeting on February 17, 2016. Mayor Gebbia reported on legislative matters discussed at the Palm Beach County League of Cities Board of Directors meeting, including 1) a proposed bill that would shift the cost to relocate utilities within public easements from the utility to the city, and 2) a project to facilitate boating in Palm Beach County that would allow passage between a chain of freshwater lakes and the Lake Worth Lagoon via a boat lift structure. Minutes of Village Council Regular Session held January 28, 2016 Page 3 of 3 VILLAGE MANAGER MATTERS /REPORTS Mr. Kelly announced the installation of Police Chief Rick Jenkins as the Vice President of the t ) Palm Beach County Association of Chiefs of Police. Mr. Kelly reviewed the schedule for the weeklong Charrette concerning the Village Master Plan and the Country Club clubhouse and amenities. Mr. Kelly distributed a summary of the key findings from the resident survey regarding the Country Club. Mr. Kelly announced the Chili Cook -off and Hot Cars event on Sunday and the Friends of the Library Annual Book Sale occurring daily through Sunday. Mr. Kelly introduced Rick Asnani, representing the Cultural Council of Palm Beach County, who gave an informational presentation regarding sales tax referendums being considered by the School District, Palm Beach County, and the Palm Beach County Firefighters.
