TUESDAY, MAY 25, 1976

Mayor Heraty called the Special Meeting to order at ROLL CALL
7:30 p.m, All members of the Council were present.
The purpose of this Special Meeting is _to discuss PURPOSE OF
Palm Beach County Utilities, Inc. SPECIAL MEETING
This Special Meeting was held this date because the
business at hand could not be held over until the next

On May 19, 1976 a letter from Marvin Rowland, Director DISCUSSION
of the Division of Environmental Sciences and Engineering CONCERNING
of the Palm Beach County Health Department, addressed -PALM BEACH
to the Building Official of North Palm Beach stated COUNTY UTILITIES,
that the sewage treatment facility serving North Palm INC.
Beach, Lake Park and adjacent unincorporated areas of Palm
Beach County is currently on a "no-connect" moratorium,
effective May 1, 1976, resulting-from the fact that
the facility does not meet State standards for effluent
disposal and is operating without a valid operating permit.
Mr. Nicoletti stated that the situation is such that it
would appear that the State Department of Environmental.
Regulation is unwilling to allow Palm Beach County Utilities,
Inc. to continue operating on a construction permit. They
will require them to seek a temporary operating permit.
He said he had indications that this can be accomplished
if everything goes as need be in approxirra tely one month's
time.
Mr. Umesh Asrani, an Engineer with the Palm Beach County
Health Department was present at the meeting.. A lengthy
discussion concerning this matter ensued and questions.
were posed to Mr. Asrani from members of the Council
to which he replied. Questions were also posed to
our Village Attorney relative to the situation.
After considerable discussion concerning the matter,
Councilman Love moved that we instruct our Village COUNCIL IN-
STRUCTS MGR.
Manager and our Village Attorney to attempt to talk & ATTY. TO
with Mr. MacArthur and owners or operators of Palm ATTEMPT TO TALK
Beach County Utilities, Inc. and come back to the Council TO MR. MAC
with sufficient information for the Council to determine ARTHUR & OWNERS _
the intent of the utility company, and to instruct the OR OPERATORS
Environmental Control Board and the Public Service OF UTILITY CO.
Commission to take all efforts they can to improve the _
plant while we are investigating it. The motion was
seconded by Councilman Marks and passed 4 to 1, with
Vice Mayor McIntyre opposed.

There being no further business to come before the Council ADJOURNMENT
at this Special Meeting, on motion of Councilman Marks,
seconded by Councilman Love, all present voting aye,
the meeting was adjourned at 8:35 p.m.
