09-12-1974 VC REG-MMINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, SEPTEMBER 12,1974 Present: Walter N. Colbath, Jr:, Mayor M. C. Love, Jr., Vice Mayor William A'Greeley, Councilma n Ronald L. Heraty, Councilman Robert F. Slater, Councilman Will Nason, Village Attorney Lawrence J. Robbins, Village Manager Dolores R: Walker; Village C lerk Mayor Colbath called the Regular Meeting to order at ROLL CALL 8:01 p.m. All members of the Council were ',present. Councilman Greeley gave the invocation and Councilman _ INVOCATION Slater led the Council and the public in the Pledge & PLEDGE DF of Allegiance to the Flag. On motion of Vice Mayor Love, seconded by Councilman B1hL-213 _ Heraty, all present voting aye, Bill No. 213 entitled: PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PAIM BEACH, FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE BY AMENDING YARD: SPACE REGULATIONS IN ZONING DISTRICT R-3 BY REQUIRING -- 100 FOOT MINIMUM FRONT YARD SETBACKS FOR PROPERTY _ _ FACING U. S. HIGHWAY #1 AND 25 FOOT MINIMUM SIDE YARD SETBACKS WHERE SAID PROPERTY HAS A SIDE YARD ' ON AN INTERSECTING STREET was placed on second reading and read by-title alone.- On motion of Vice Mayor Love, seconded by Councilman BILL-213 Heraty, all present voting aye, Bill No. 213 was ADOPTED AS adopted_as Ordinance No. 17-74. ORD. 17-74 Minutes of Regular Meeting Held Thursday, September 12, 1974 Page 2 On motion of Councilman Heraty, seconded by Councilman RES. 51-74 Greeley, all present voting aye, proposed Resolution No. ADOPTED 51-7~F entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF 'NORTH PALM ' BEACH, FLORIDA, AMENDING RESOLUTION N0: 184 WHICH CREATED THE BEAUTIFICATION COMMITTEE BY REDUCING THE NUMBER OF MEMBERS ON SAID COMMITTEE AND BY PROVIDING FOR THE APPOINTMENT OF ALTERNATE MEMBERS OF SAID COMMITTEE was read in full and adopted as read as Resolution No. 51-74. On motion of Vice Mayor Love, seconded by Councilman RES. 52-74 Heraty, all present voting aye, proposed Resolution No. ADOPTED 52-74 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING FIRST AND SECOND ALTERNATE MEMBERS TO THE BEAUTIFICATION COMMITTEE',OF THE VILLAGE OF NORTH PALM BEACH i was read in full and adopted as read as Resolution No. 52-74. On motion of Councilman Slater, seconded by~,Councilman RES. 53-74 Heraty, all present voting aye, proposed Resolution No. ADOPTED ' 53-74 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH , FLORIDA, ACCEPTING THE BID OF FLORIDA HASCO, INC. FOR 150 MODEL 5-23 SIDE CHAIRS IN THE, AMOUNT OF $6,022.50 was read in full and adopted as read as Resolution No. 53-74. Mayor Colbath, on behalf of the Village of North Palm AWARDS OF Beach, presented Awards of Merit to Dwight Brooks and MERIT PRE- Robert Larrabee for valiant effort rendered',to the victims SENTED TO D. of an accident that occurred on State Road 7,03 on July BROOKS & R. 26, 1974, which resulted in saving one victim's life. LARRABEE On motion of Vice Mayor Love, seconded by Councilman 20% INCREASE Greeley - 4 to 1, Councilman Heraty opposed - Council IN MEMBERSHIP approved a 20% increase in all membership fees of FEES AT NPBCC the North Palm Beach Country Club. APPROVED Councilman Greeley moved. that the Cart Fees and the MOTION TO Greens Fees at the North Palm Beach Country Club APPROVE CART be approved as follows: FEES &_GREENS FEES AT NPBCC Cart Fees - $10.00 for non-members _ 7.00 for members ' - Greens Fees $10.00 in season 5.00- non=season The motion was seconded by Councilman Heraty;and passed 4 to 1, with Mayor Colbath opposed. Vice Mayor Love, being on the prevailing side, moved MOTION TO RE- to reconsider the vote on the motion for Cart Fees CONSIDER and Greens Fees because he misunderstood what the motion was. Minutes of Regular Meeting Held Thursday, September 12, 1974 Page 3 Vice Mayor Love moved to amend the motion as follows: I Greens Fees - $10.00 for non-residents in season 8.00 for residents iri season 8.00 for non-residents non-season 5.00 for residents non-season The motion to amend was seconded by Councilman Heraty and failed 3 to 2, with Mayor Colbath, Councilman Greeley and Councilman Slater opposed. Thereafter Council voted on the main motion which passed 3 to 2, with Mayor Colbath and Vice Mayor Love opposed. Councilman Greeley moved that as of October~l, 1974. Golfing and Full Club Memberships are closed, and they will not be reopened until the Golfing and Fu11 Club Memberships reach 649, at which time the membership is open for one member. The motion was seconded by Councilman Slater. MOTION TO .AMEND FAILED 3 T0~~2 MAIN MOTION PASSED 3 TO 2 MOTION TO CLOSE GOLFING & FULL CLUB MEMBERSHIPS AS OF 10/1/74 Vice Mayor Love moved to amend the main motion as follows: MOTION TO That we hold the 650 membership limit and accept members AMEND MAIN into the Club until October 1, 1974 in the Following MOTION DIED order: (1) current members; (2) resident non-members FOR LACK OF who wish to become members; and (3) non-resident re- A SECOND newals. The motion died for lack of a second. ' Vice Mayor Love moved to amend the main motion as MOTION TO follows: That the membership cap of 650 not be in- AMEND MAIN stituted prior to January 1, 1975. The motion died MOTION DIED for lack of a second. FOR LACK OF A SECOND Thereafter Council voted on the main motion which passed _ MAIN MOTION 4 to 1, with Vice Mayor Love opposed. PASSED 4 TO 1 Vice Mayor Love instructed the Village Clerk to include VLCE MAYOR the following statement for the record in the minutes LOVES $TATE- of this meeting: ~ MENT FOR THE RECORD The primary reason for my opposition to 'the membership cap is because it is discriminatory against the residents of North Palm Beach, since we still have non-resident members. It will also --- hinder the attraction of new residents to North Palm Beach. Councilman Greeley moved that any foursome of greens MOTION ON fees players, not accompanied by a member or;g-uest GREENS FEES of a member, must take a cart, and that greens fees PLAYERS DIED players, playing with a member, may walk if they so FOR LACK OF A desire..-The motion died for lack of a second.
