C. Love, Jr., Vice Mayor William A: Greeley, Councilman Ronald L. Heraty, Councilman Robert F.;Slater, Councilman- Herbert L. Gildan, Village Attorney Lawrence J. Robbins, Village Manager Dolores R. Walker, Village Clerk - i Mayor Colbath reconvened the Regular Meeting of Thursday, ROLL CALL June 13, 1974 at 7:35 p.m. All members of ahe Council -- were present. On motion of Councilman Greeley, seconded liy Councilman AGENDA MODIFIED Heraty, all present voting aye, that we modify the agenda and take-up "Resolutions" at this time. On motion of Councilman Heraty, seconded by, Councilman RES_ 42-74 Greeley, all present voting aye, proposed Resolution ADOPTED No. 42-74 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF. NORTH PAIM ' BEACH, FLORIDA, PROHIBITING THE BUILDING OFFICIAL OF THE VILLAGE OF NORTH PALM BEACH FROM ISSUING A BUILDING PERMIT FOR ANY PROPOSED BUILDINGS WHICH EXCEED SIXTEEN STORIES IN THE AREA LYING NORTH OF THE INTRACOASTAL WATERWAY AND WEST OF U. S HIGHWAY N0. 1, FOR ANY BUILDINGS WHICH EXCEED TWENTY STORIES WHICH LIE NORTH OF THE INTRACOASTAL WATERWAY;AND EAST OF U. S. HIGHWAY N0. 1, FOR ANY BUILDINGS;WHICH EXCEED THIRTEEN STORIES WHICH LIE SOUTH OF THE INTRACOASTAL WATERWAY AND EAST OF U. S. HIGHWAY N0.;1, AND FOR ANY BUILDINGS WHICH EXCEED FOUR STORIES WHICH LIE SOUTH AND WEST OF THE INTRACOASTAL WATERWAY AND WEST OF U. S. HIGHWAY N0. 1 -- was read in full and adopted as read as Resolution No. 42-74. On motion of Vice Mayor Love, seconded by Councilman AGENDA Greeley, all present voting aye, that we modify the agenda MODIFIED and take up "Ordinances" at this time. On motion of Councilman Heraty, seconded by ;Councilman BILL 206 Greeley, all present voting aye, Bill No. 20:6 entitled: PLACED ON 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, ' FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE ZONING CODE ,; BY SETTING BUILDING HEIGHT RESTRICTIONS THROUGHOUT, THE VILLAGE OF NORTH PALM BEACH was placed on first reading and read by title only. Minutes of Regular Meeting Recessed 6/13/74 Held Tuesday, June 18, 1974 Page 2 1 J On motion of Councilman Heraty, seconded by Vice Mayor - BALANCE OF Love, all present voting aye, that we approve Item (b) TREE PLANTING under T'Miscellaneous Business" on the agenda to allow PROGRAM the Public Works Department to go along with this tree ~PEROVED planting program. Vice Mayor Love instructed the Village Clerk to include VICE MAYbR the following statement for the record in the minutes COVETS of this_meeting: STATEMENT FOR THE RECORD ON TMI am for development o~'a recreational facility on ST. CLARE the St. Clare property as indicated by my vote in LEASE favor of Resolution No. 40-74. This statement ex- presses my objection to the procedures used in the lease negotiation and Council approval: 1. The lease agreement obligates the Village for 25 years and was not discussed at a Council meeting. 2. The Village Council has not been provided with the amount or schedule of funds required for the Village to fulfill our obligation. 3. The Village Council had not seen a copy of the final lease which we-were asked to approve. 4. The lease negotiation had advanced to a_poirit, at the time the Council was asked to approve, that the Council had the choice: to approve (as we did) or to abandon devel'.opment of this facility since the Archbishop had expressed that he would not sign another__agreement. 5. I feel that the Council approved this program- in ignorance, and I hope that Council diligence_ will prevenf a future occurrence of this nature."
