07-13-1972 VC PH2-MMINUTES OF PUBLIC HEARING OF THE VILLAGE COUNQIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, JULY 13, 1972 ' Present: H. Mallory Privett, Jr_, Mayor Ronald B. Cadby, Vice Mayor Robert W. Martin, Councilman Thomas B. Rhodes, Councilman Robert F. Slater, Councilman Herbert L. Gildan, Village Attorney Lawrence J. Robbins, Village Manager Dolores R. Walker, Village Clerk Mayor Privett called the Public Hearing to order at ROLL CALL 7:49 p.m. and asked the Clerk to call the roll, all members being present. The purpose of the Public_Heasing was to hear the com- PURPOSE OF ments of the public with regard to Bill No. 159.- This PUBLIC HEARING bill amends Chapter 45 of the Village Code by amending the rear and side yard setback regulations in Zoning District C-1. Clerk read legal notice of this Public Hearing which was LEGAL NOTICE published in the Palm Beach Post on June 28, 1972 and READ posted as required by Village Charter. Clerk read Bill No. 159, as placed on first reading BILL 159 ' June 22, 1972,, in full. This bill is entitled: READ IN FULL AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 45 OF-THE VILLAGE OF NORTH PALM BEACH CODE, BY AMENDING THE YARD SPACE REGULATIONS IN ZONING DISTRICT C-1 TO RE- QUIRE SINGLE FAMILY AND MULTIPLE FAi~tILY RESIDENTIAL DWELLING STRUCTURES TO HAVE THE SAME YARD SPACE REGULATIONS AS IS REQUIRED IN ZONING DISTRICT R-1 AND R-3, RESPECTIVELY ____ Clerk then read the amended portion of Bill No. 159 AiMENDED as follows: PORTION OF BILL 159 "(a) For single family and for multiple family READ residential structures, there shall be rear yard and side yard setbacks the same as set forth in the R-1 and R-3 zoning districts, respectively, provided, however, that on corner lots intersecting U. S. Highway #1 where the front of the building is on the intersecting street and the side yard of the building is on U. S. Highway #1, the minimum side yard setback on U. S. Highway #1 shall be 100 feet measured from the street line to the side building line and only for structures in excess of twenty stories in height shall 5-feet be added to the required side yard for each story added to the building in excess of twenty. All other yard space', regulations shall apply to such buildings." Attorney Ronald Sales, representing the developers of DEVELOPERS Old Port Cove, spoke in opposition to Bill No. 159. OF OLD PORT He stated this bill would limit the density of Old Port COVE OPPOSED Coves tract of land, and urged that consideration of this TO BILL 159 bill be postponed until the Planning and Zoning Advisory Board had a chance to review it. L Minutes of Public Hearing Held Thursday, July 13, 1972 Page 2 Mr. Eugene Potter, speaking in behalf of Old Port Cove, stated he was opposed to this bill and felt it should be tabled until a professional study could be made on it. Attorney Luther Taylor, representing MAC Development Company, the developers of Waterway Condominiums, stated that Waterway Condominiums is protesting this bill, and that he felt an in-depth study by a professional should be made before adopting this proposed ordinance. At this point in the Public Hearing, upon Mayor Privett asking for further comments from the public .on this bill, Mrs. Harry Boyer, speaking in behalf of the owners of Village Garden Apartments, read a.petition requesting the officials of the Village to enforce the ordinance passed by the Village Council, placing a speed limit on the Earman River. Mayor Privett informed Mrs. Boyer that this Public Hearing was to hear comments on Bill 159 only,-but that her petition would be con- sidered at a regular meeting of the Village Council. Mrs. Boyer left the petition with the Village Clerk.
