MINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, MAY 27, 1971 - 1 Present: H. Mallory Privett, Jr., Mayor Ronald B. Cadby, Vice Mayor Robert W. Martin, Councilman Thomas B. Rhodes, Councilman Robert F. Slater, Councilman.. Herbert L. Gildan, Village Attorney Lawrence J. Robbins, Village Manager Frances A. Fox, Village Treasurer Dolores R. Walker, Village Clerk Mayor Privett called the Regular Meeting to order at 8:30 p.m. and asked-the Clerk to call the roll; all members being present. Mayor Privett gave the invocation and Vice Mayor Cadby led the Council and the public in the Pledge of Allegiance to the Flag: On motion of-Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, the minutes of Regular Meeting held Thursday, May 13, 1971 were approved as written. Mayor Privett stated that the organisation called the North County Program for Drug Abuse, Inc. had their first meeting in the Village Hall. This meeting was held May 25, 1971. The Mayor said there were-quite a-few Village residents present and a total number of about 150 persons. He felt this group was off to a good start, and he told them we would help them if we could. Mayor Privett informed the Council that he had written a letter to the L L F, advising that the Village Council is in favor_of moving the bulkhead line to the mean high water line in all areas of our municipality which are not now bulkheaded, and. requesting that they give us their position on this matter; namely, whether the bulkhead line may be officially desig- nated as 'the mean high water line" or must be actually surveyed and described as a precise location. Mayor Privett stated he had read the proclamation on Safety Week (May 24 through May 28, 1971) at the CouncilTs workshop meeting of May 20, 1971. On motion of Councilman Slater, seconded by Councilman Martin, all present voting aye, the minutes of Board of Governors meeting held April 21, 1971; the minutes of Special Meeting of Board o:f Governors held May 4, 1971; and the minutes of Planning and Zoning Advisory Board meeting held May 12; 1971 were accepted. ACCEPTANCE OF MINUTES OF MEETINGS OF VILLAGE BOARDS On motion of Vice Mayor Cadby, seconded by Councilman VILLAGE & ' Martin, all present voting aye, the financial statements for NPBCC FINANCIAL the Village and the North Palm Beach Country Club for the STATEMENTS FOR period ending April 30, 1971 were accepted. 4/30/71 ACCEPTED On motion of Vice Mayor Cadby, seconded by Councilman- BILL 105- Slater, all present voting-aye, Bill No. 105 entitled: PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE VILLAGE OF NORTH PALM BEACH CODE BY ESTABLISHING AN APPEARANCE CODE FOR THE VILLAGE OF NORTH PALM BEACH was placed on second reading and read by title. alone. Minutes of Regular Meeting Held Thursday, May 27, 1971 Page 2 Vice-Mayor Cadby made a motion that Bill No.-105 be adopted as Ordinance No. 4-71. Motion was seconded by Councilman Rhodes. On motion of Vice-Mayor Cadby, seconded by Councilman 1 Martin, all present voting aye, Section 6-37 of proposed Ordinance No. 4-71 was amended to read as follows: "Sec. 6-37. APPEALS AND REVIEW---The applicant or any interested party may file an appeal to the Village Council on any ruling by the appearance board made pursuant to this ordinance.- An appeal shall be on forms provided by the village. The appeal shall be filed or made within ten (10) days after decision of the appearance board. Appeals shall set .forth the alleged inconsistency or nonconformity with procedures or criteria set forth in this ordinance or standards set forth in or pursuant to this ordinance. The village council shall decide an appeal within thirty (30) days of the .filing of such appeal unless an extension of time is consented to by the applicant, and such filing shall suspend any building _ permit issued pursuant to the ruling of the appearance board until the village council has decided the appeal. The village council may review any decision of the appearance board and their disposition of the matter shall be final.' MOTION TO ADOPT_ BILL 105 AS ORD. 4-71 PROPOSED ORD. 4-71 AMENDED Thereafter Council voted on the main motion which passed PROPOSED ORD. 5 - 0. Therefore, proposed Ordinance No. 4-71 was adopted 4-71 ADOPTED as amended as Ordinance No. 4-71 by unanimous vote of the AS AMENDED AS Council. ORD. 4-71 On motion of Vice-Mayor Cadby, seconded by Councilman CONSIDERATION Martin, all present voting aye, that we postpone considera- OF BILL 125 Lion of Bill No. 125 until Councilts Regular Meeting of POSTPONED June 10, 1971. On motion of Councilman Rhodes, seconded by Councilman Martin, all present voting aye, Bill No. 126 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 25 OF THE VILLAGE OF - NORTH PALM BEACH CODE BY REGULATING MOTOR VEHICLE AND BICYCLE TRAFFIC IN PUBLIC PARKS AND AT THE NORTH PAIM BEACH COUNTRY CLUB was placed on first reading and read in full. On motion of Vice-Mayor Cadby, seconded by Councilman Slater, all present 'noting aye, Bill No. 127 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 41-13 AND REPEALING SECTION 41-13(3) OF THE VILLAGE. OF NORTH PALM BEACH CODE BY PERMITTING TREES SET FORTH ON EXHIBIT 1.T0 ORDINANCE NO. 207-70 TO BE PLANTED IN ANY SWALE AREA OF THE VILLAGE OF NORTH PALM BEACH, SO LONG AS THE SAME SHALL PROVIDE A HARMONIOUS VIEW ON SAID STREET -BILL 126 PLACED ON 1ST READING BILL 127 PLACED ON 1ST READING was placed on first reading and read in full. On motion of Vice-Mayor-Cadby, seconded by Councilman -- Martin, all present voting aye, that the name of Mr. Teed be placed in Section 1, and the names of Mr. Bott as First Alternate and Mr. Robson as Second Alternate be placed in Section 2 of proposed Resolution No. 12-71. On motion of Vice-Mayor Cadby, seconded by Councilman Martin, all present voting aye, proposed Resolution No. 12-71 entitled: -NAMES PLACED ON PROPOSED RES. 12-71 RES. 12-71 ADOPTED A RESOLUTION OF THE VILLAGE COUNCIL OF-NORTH PALM BEACH, FLORIDA, APPOINTING MEMBER TO THE BOARD OF ADJUSTMENT OF THE VILLAGE OF NORTH PAIM BEACH AND DESIGNATING ALTERNATE MEMBERS OF SAID BOARD 1 was read in £ull and adopted as read as Resolution_No. 12-n. Proposed Resolution No. 13-71 entitled: A RESOLUTION OF THE VILLAGE COIINCIL OF NORTH. PALM BEACH, FLORIDA, ESTABLISHING A POLICY REGARDING THE USE OF ALARM SYSTEMS CONNECTED TO THE TELEPHONE NUMBERS OF THE VILLAGE OF NORTH PALM BEACH PUBLIC SAFETY DEPART- MENT PROPOSED RES. 13-71 READ IN FULL 1 was read iti full. Vice-Mayor Cadby made a motion that proposed Resolution No. 13-71 be adopted as read. Motion was seconded by Councilman Slater. Councilman Martin made a motion that proposed Resolution No. 13-71 be amended by striking the words T`Herbert Kohl" from the resolution. Motion was seconded by Vice-Mayor Cadby. All present voted aye; therefore, motion passed 5 - 0. Thereafter Council voted on the main motion which passed 5 - 0. Therefore, ,proposed Resolution No. 13-71 was adopted as amended as Resolution No. 13-71 by unanimous vote of the Council. - PROPOSED RES_, 13-71 AMENDED PROPOSED RES. 13-71 ADOPTED AS AMENDED AS RES. 13-71 On motion of Vice-Mayor Cadby, seconded by Councilman LETTER TO Rhodes, all present voting aye, that the Mayor be directed SCHOOL BOARD to write a letter to the Chairman of the School Board ex- RE BOUNDARY pressing opposition to changing the boundaries for high CHANGE school attendance for the residents of North Palm Beach.
