THURSDAY, MAY 13, 1971

Mayor Privett called the Regular Meeting to order at 8:00 ROLL CALL
p.m, and asked the Clerk to call the roll, all members being
present.
Mayor Privett gave the invocation and Councilman Martin INVOCATION &
led the Council and the public in the Pledge of Allegiance PLEDGE OF
to the Flag. ALLEGIANCE
On motion of Vice-Mayor Cadby, seconded by Councilman APPROVAL OF
Martin, all present voting aye, the minutes of Regular MINUTES
Meeting held Thursday, April 22, 1971; the minutes of
Special Meeting held Thursday, April 29, 1971; and the
minutes of Public Hearing held Thursday, May fi, 1971
were approved as written.
Mayor Privett stated that Civic Day, which was held in CIVIC DAY
the Village on May 7, 1971, was an excellent program.
He felt that it was well organized; that the Council
Meeting was conducted by the students extremely well;
and that their comments were very meaningful. The
Mayor stated it was a worthwhile experience for the
Council and employees of the Village as well as their
student counterparts.
Mayor Privett proclaimed the week of May 24 through CRIPPLED
May 30 as "Crippled Children Week" in the Village of CHILDREN WEEK -
North Palm Beach. This i.s sponsored by the Florida MAY 24-30
State Elks Association to raise funds for the E1ksT
crippled children.
Mayor Privett reminded the Council that the .Blue Star BLUE STAR
Memorial Highway Marker dedication is scheduled for MARKER
Friday, May 14, at 2:30 p.m. DEDICATION
Mayor Privett referred to the invitation he had DEDICATION
received from the City of Palm Beach Gardens to attend 0P PBG
the dedication of their municipal complex on Saturday, MUNICIPAL
May 15, at 2:30 p.m. He stated that he planned to COMPLEX
attend this dedication.
Mayor Privett referred to the letter he had received .LETTER FROM
from Mayor Foster of West Palm Beach, dated May 10, MAYOR FOSTER
1971, concerning the meeting to discuss the bus trans- RE BUS TRANS-
portation problem. The Mayor stated that since the PORTATION
bus company no longer services the Village, and the PROBhEM
buses do not came to the Village anymore, he did not
feel we should be a party to the discussions on how
to continue existing services. The Mayor stated that
'the Village would not be in favor of any type of sub-
sidy to the Transit Company.

Mayor Privett referred to the letter from Palm Beach
Junior College to Mr. Larry Robbins, dated April 22,
1971, commending"Lieutenant Richard Wille on the work
he had done at the college. Lieutenant Wille graduated
from Palm Beach Junior College on May 10, 1971. The
Mayor asked Mr. Robbins to extend congratulations from
the Council to Lieutenant Wille.
On motion of Councilman Martin, seconded by Vice-Mayor
Cadby, all present voting aye, the minutes of the Planning
and Zoning Advisory Board Meeting held April 21, 1971; and.
the Report of Beautification Committee of April 28, 1971
were accepted.
On motion of Councilman Martin, seconded by Vice-Mayor
Cadby, all present voting aye, that we consider Bill No.
120 first on the agenda under Ordinances.
On motion of Vice-Mayor Cadby, seconded by Councilman
Rhodes - 3 to 2, Mayor Privett and Councilman Martin
opposed - Bill No. 120 entitled:
AN ORDINANCE OF THE VILLAGE OF NORTH PATH BEACH,
FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH
PALM BEACH CODE BY SETTING FORTH REGULATIONS CONCERN-

Vice-Mayor Cadby made a motion that Bill No. 120 be adopted
as Ordinance No. 2-71. Motion was seconded.by Councilman
Rhodes.

Vice-Mayor Cadby made a motion to amend proposed Ordinance PROPOSED ORD.
No. 2-71 by adding the words "in height".after feet in the 2-71 AMENDED
first sentence of Section 1. Motion was seconded by Council-
man Rhodes. A11 present voted aye; therefore motion passed
unanimously.
Councilman Rhodes made a motion to amend proposed Ordinance PROPOSED ORD.'
No. 2-71 by adding the word "line" in the third line of 2-71 FURTHER
Section 1 between "setback" and TMshall." Motion was AP+~.ENDED
seconded by Councilman Slater. A11 present voted aye;
therefore, motion passed unanimously.
On motion of Councilman Rhodes, seconded by Councilman
Martin, all present voting aye, that we take a three
minute recess.
The meeting recessed at 10:00 p.m. and reconvened at
10:03 p.m.
Vice-Mayor Cadby made a motion to amend proposed Ordin-
ance No. 2-71 in the last sentence of Section 1 to have
it read as follows:
"On corner lots, walls or fences shall not exceed
four (4) feet in height within the area between the
side line of the lot which fronts on a street, and
the front building setback line extended of the ad-
jacent side street lot."

Motion was seconded by Councilman Slater. Vice-Mayor
Cadby, Councilman Martin, Councilman Rhodes and Councilman
Slater voted for, Mayor Privett voted against. Therefore,
motion passed 4 to 1.
Mayor Privett passed the gavel to Vice-Mayor Cadby and made
the following motion: That proposed Ordinance No. 2-71 be
amended in Section 1 to strike the words "walls" everywhere
that they appear, and that we add a new Section 45-36(d)(2)
which would state that walls built within the area between
the property line and the building setback shall not exceed
four feet in height. Motion was seconded by Councilman
Martin. Mayor Privett and Councilman Martin voted for,
Vice-Mayor Cadby, Councilman Rhodes and Councilman Slater
voted against; therefore, motion was defeated 3 to 2.

Mayor Privett made a motion that proposed Ordinance No.
2-71 be amended as follows: By adding ~oords on the
building permit for walls or fences greater than four
feet in height that are to be located outside building
setback lines, that there shall be a prominent notice that
a Village building permit in no way offsets the deed covenants
and that the applicant should also check deed covenants to
protect himself. Motion was seconded by Councilman Martin.
All present voted aye; therefore, notion passed unanimously.
Vice-Mayor Cadby returned the gave to Mayor Privett.
Thereafter, Council voted on the main motion which passed
3 to 2. Vice-Mayor Cadby, Councilman Rhodes and Councilman
Slater voted for, Mayor Privett and Councilman Martin voted
against. Therefore, proposed Ordinance No. 2-71 was
adopted as amended as Ordinance No. 2-71 by a 3 to 2
vote of the Council.
On motion of Vice-Mayor Cadby, seconded by Councilman
Rhodes, all present voting aye, Bill No. 105 entitled:

Rhodes - 3 to 2, Vice-Mayor Cadby, Councilman Rhodes
