01-08-2015 VC WS-MMINUTES OF THE WORKSHOP SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA JANUARY 8, 2015 Present: Darryl C. Aubrey, Sc.D., Mayor Robert A. Gebbia, Vice Mayor David B. Manuel, Councilman Mayor Aubrey called the meeting to order at 8:23 p.m. All members of Council were present, except Councilman Manuel, who was absent due to illness. All members of staff were present. COMPREHENSIVE PLAN TEXT AMENDMENT TO ALLOW ASSISTED LIVING FACILITIES Discussion was held on Amendment 14 -1, a proposed amendment to the Future Land Use Element of the Village's Comprehensive Plan to define assisted living facilities and establish use, intensity, and density regulations, and to allow assisted living facilities as a mixed -use development through the commercial planned unit development (CPUD) process. Village Planner Jodi Nentwick reviewed the proposed Comprehensive Plan Text Amendment. Mrs. Nentwick stated that each mixed -use Assisted Living Facility (ALF) must contain a residential component together with a non - residential component. Mrs. Nentwick explained the methodology used to determine the maximum number of rooms and residents that would be allowed, as well as the maximum floor area and maximum height of the facility. Mrs. Nentwick advised that allowing an ALF as a mixed -use development through the CPUD process would provide flexibility for developers and the Council. Mrs. Nentwick stated the Planning Commission, acting as the Local Planning Agency, held a public hearing on December 2, 2014, and voted 3 -2 to approve the amendment as submitted. Mrs. Nentwick reviewed the concerns expressed by the Planning Commission. Discussion took place regarding the proposed maximum density of 24 units per acre, which is the same as the maximum density allowed in the R -3 zoning district. Mrs. Nentwick noted the density would be subject to Council approval, up to a maximum of 24 units per acre and only for properties with a commercial land use designation and underlying commercial zoning. Discussion ensued concerning the requirement that the residential component comprise a minimum 50% of the gross floor area of an ALF. Jim Fleischmann, Land Research Management, Inc., explained that because an ALF is principally a residential development, this provision was included to balance the floor area used for residential and non - residential purposes. It was suggested that staff consider a broader interpretation or more flexibility in the 50% residential requirement, so long as the commercial component is there to serve the residents of the facility. By consensus, this item was forwarded to the next Regular Session agenda.
