09-25-1969 VC REG-MMINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, SEPTEMBER 25, 1969 Present: Thomas F. Lewis, Mayor ' Thomas R. Be11, Vice-Mayor Allan V. Everard, Councilman Herbert A. Watt, Councilman Herbert L. Gildan, Village Attorney Lawrence J. Robbins, Village Manager Dolores R. Walker, Village Clerk Absent: H. Mallory Privett, Jr., Councilman --- Mayor Lewis called the Regular Meeting to order at 8:10 - ROLL CALL p.m. and asked the Clerk to call the roll, all members being present except Councilman Privett, who was excused. -- Vice-Mayor Be11 gave-the invocation, immediately after INVOCATION & which Councilman Watt led the Council and the public in _ PLEDGE OF the Pledge of Allegiance to the Flag. ALLEGIANCE On motion of Vice-Mayor Bell, seconded by Councilman APPROVAL OF Watt, all present voting aye, the minutes of Public MINUTES Hearing held Wednesday, September 10, 1969; the minutes of Regular Meeting held Thursday, September 11, 1969; the minutes of Special Meeting held Wednesday, September 17, 1969 were approved as written; and the minutes of Emer- gency Meeting held Friday, September 12, 1969 .and minutes of Special Meeting held Thursday, September 18, 1969 were approved as read. Mayor Lewis stated that all is in readiness for our _ LIBRARY library dedication on Saturday, October 4. DEDICATION - OCT, 4 Mayor Lewis welcomed the various students from Jupiter STUDENTS FROM High Sphool who were present at this meeting to observe JUPITER HIGH government in action, and said he hoped we would broaden SCHOOL OBSERVE their knowledge of how our community operates. GOVERNMENT IN ACTION Mayor Lewis read let-ter from R. K. Kramer, Chairman VILLAGE FLOAT of Sout11 Florida Fair and Exposition, in which he en- AWARDED 2ND PLACE closed second place award for the Village's float which IN 1969 S0. FLA. was entered in the 1969 South Florida Fair Parade. MEETING were tabled until Regular Meeting of October 9, 1969 OP 8/27/fi9 _ -- so that Council can compare existing Ordinances. - -- TABLED ' The minutes of Beautification Committee Meetings held BEAUTIFICATION _ September 3, 1969, September 10, 1969 and September 17, COMM. MINUTES 1969 were tabled until Council has an opportunity to study TABLED them further. On motion of Vice-Mayor Bell, seconded by Councilman $100 DONATED TO Watt, all present voting aye, that we donate to Palm Beach PBGHS BAND FOR Gardens High School Band .Parents Association for the uni- UNIFORM FUND form fu}~d for the band the sum of $100.00. ' Minutes of Regular Meeting Held Sept. 25, 1969 Page 2 Village Attorney Gildan informed Council he had received a LAW SUIT - letter from Mr. Ronald Sales, representing Bankers Life BANKERS LIFE & and Casualty Company, stating that he intends to file an CASUALTY VS. amended complaint, and requesting that we file nothing to NPB ET AL his present complaint until he files his amendment so that therq will be no unnecessary effort, and further stating that the Village would have twenty days after he files his amenc~~d complaint to respond. Mr. Gildan recommended to - Coune~l that he and Mr. Sales stipulate to this and Council concurred with Mr. Gildan's recommendation. - On motion of Councilman Watt, seconded by Vice-Mayor Be11, BILL N0. 75 all present voting aye, that Bill No. 75 entitled: PLACED ON 2ND READING & ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, READ BY TITLE FLORIDA, DEFINING WHEN A DOG WHICH BITES OR ATTACKS ONLY [~ PERSON IS PROVOKED OR UNPROVOKED _ - was paced on second reading and read by title only. On motion of Councilman Watt, seconded by Vice-Mayor _ BILL NO, 75 Be11, all present voting aye, Bill No. 75 was adopted as ADOPTED AS OR D. Ordinance No. 195-69. _ N0. 195-69 On motion of Councilman Watt, seconded by Councilman MEETING RECESSED Everard, all present voting aye, that this meeting be recessed. Meeting was recessed at 8:35 p.m. so that Council could reconvene Regular Meeting of September 11, 1969 for the purpose of unfinished business..at that meeting. RECESSED MEETING CALLED BACK TO ORDER On motion of Councilman Watt, seconded by Vice-Mayor Bell, BILL N0. 79 all present voting aye, Bill No. 79 entitled: PLACED ON 1ST READING & READ AN ORDINANCE OF THE VILLAGE OF-NORTH PALM BEACH, IN FULL FLORIDA, AMENDING PORTIONS OF ORDINANCE N0. 181-68, CONCERNING DETAILED APPROPRIATIONS FOR THE FISCAL YEAR 1.968-69 - was placed on first reading and read in full. There will be a Public Hearing on Bi11 No. 79 on October 16, 1969 at 7:30 p.m. in the Village Hall. On motion of Councilman-Batt, seconded by Councilman BID IN AMT. OF Everard, all present voting aye, that bid be awarded to. $15,880 AWARDED Giles Construction Company, Inc. in the amount of TO GILES CONST. $15,880-for the snack bar construction. CO. FOR SNACK BAR On motion of Councilman Watt, seconded by Councilman RES. N0. 421-69 Everard, all present voting aye, proposed Resolution ADOPTED No. 421-69 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF GILES CON- STRUCTION CO., INC. FOR REMODELING OF THE SNACK BAR AT THE NORTH PALM BEACH COUNTRY CLUB, AND AUTHORIZING THE MAYOR AND VILLAGE CLERK TO SIGN A CONTRACT WITH GILES CONSTRUCTION COMPANY, INC. FOR SUCH REMODELING- was read in full and adopted as read as Resolution No. 421-69. Minutes of Regular Meeting Held September 25, 1969 Page 3 1 1 Village Manager read highlights of the following financial statements: Village financial statement for period ending July 31, 1969; Village financial statement for period ending August 31, 1969; and North Palm Beach Country Club financial statement for period ending August 31, 1969. On motion of Vice-Mayor Be11, seconded by Councilman Watt, all present voting aye, these three financial statements were accepted, and a true copy of each will be attached to the minutes of this meeting. On motion of Vice-Mayor Bell, seconded by Councilman Everard, all present voting aye, that we follow Village Attorney`s recommendation and continue-codification of our code with existing Comprehensive Zoning Ordinance No. 20 with its amendments, and at some future date amend our code with new Comprehensive Zoning Ordinance when it is available, On motion of Councilman Watt, seconded by Vice-Mayor Bell, all present voting aye, that Mayor and Clerk be authorised to enter into maintenance agreement with R. H. Barto Company for maintenance of air conditioning equip- ment in Village and at North Palm Beach Country Club. On motion of Councilman Watt, seconded by Vice-Mayor Be11, all present voting aye, that Council hold workshop meetings on first and third. Thursdays of each month at 8:00 p.m. in the Village Ha11. FINANCIAL STATEMENTS ACCEPTED CODIFICATION OF VILLAGE CODE MAINTENANCE AGREEMENTS WITH R. H. BARTO CO, COUNCIL WORKSHOPS TO BE HELD 1ST & 3RD THURSDAYS , OF EACH MONTH Mayor Lewis informed Council that he has tentatively DINNER DANCE established and reserved the Friday after Thanksgiving, FOR VILLAGE November 28, 1969, at the Country Club for the annual BOARDS AND dinner dance for the various Village boards and committees.
