VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA

THURSDAY, SEPTEMBER 18, 1969

Mayor Lewis called the Special Meeting to order at ROLL CALL
8:00 p.m. and asked the Clerk-to call the roll, all
members being present.
Mayor Lewis asked the Clerk to read the following letter: MAYOR'S LETTER

Please be advised that .the undersigned, as outlined in Article
III, Section 15, of the Village Charter of the Village of North
Palm Beach, Florida, is calling a special meeting of the Village
Council at 8:00 p.m., Thursday, September 18, 1969 in-the Council.
Chambers of the Village Hall located on U. S. Highway No. 1 in
the Village of North Palm Beach, Florida.
Purpose of the special meeting is for Council decision regarding
pending litigation - Bankers Life and Casualty Company vs. Village
of North Palm Beach et al.

Mayor Lewis stated that the purpose of this Special Meeting PURPOSE OF
is that the time limitations set forth in the law suit of SPECIAL MEETING
Bankers Life and Casualty Company vs. The Village of North
Palm Beach, Florida do not allow time for the Village
Attorney to make necessary preparations: Therefore, this
meeting is being held tonight so that Council may render
' a decision and allow the Village Attorney sufficient time ___
to respond to the law suit of Bankers Life and Casualty
Company vs. The Village of North Palm Beach, Florida
within the twenty days prescribed by law.

Mayor Lewis passed the gavel to the President Pro Tem
and, as Chief Executive Officer of the Village, made
the following motion: That proposed Resolution No.
420-69 entitled:
RESOLUTION

ADOPTED
UNANIMOUSLY
A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM
BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE VILLAGE
MANAGER TO EMPLOY THE LAW FIRM OF NASON, GILDAN &
YAEGER TO REPRESENT THE DEFENDANTS IN THE CAUSE STYLED
"BANKERS LIFE AND CASUALTY COMPANY, AN ILLINOIS COR-
PORATION, VS. THE VILLAGE OF NORTH PALM BEACH, FLORIDA,
ET AL" AND SETTING FORTH PROVISIONS FOR PAYMENT OF FEES
AND COSTS IN CONNECTION THEREWITH
be adopted this 18th day of September, 1969 as Resolution
No. 420-69. Thomas R. Bell, as Vice-Mayor of the Village,
seconded the motion. Mayor Lewis then asked the_C1erk to
poll the Council on the call for the question and the
results are as follows:

Councilman Herbert A. Watt Aye
Councilman H. Mallory Privett, Jr. Aye

Therefore, motion passed unanimously.
President Pro Tem returned the gavel to Mayor Lewis.
After the adoption of Resolution No. 420-69, Mayor
Lewis stated that the purpose of this Special Meeting
has been accomplished.
There being no further business to come before the
Council at this Special Emergency Meeting, on motion of
Vice-Mayor Be11, seconded by Councilman Privett, all
present voting aye, the meeting was adjourned at
8:10 p.m.
