Mayor Manuel called the meeting to order at 7:30 p.m. All members of Council were present.
All members of staff were present.
INVOCATION AND PLEDGE OF ALLEGIANCE
Vice Mayor Norris gave the invocation and President Pro Tem Aubrey led the public in the
Pledge of Allegiance to the Flag.
AWARDS AND RECOGNITION
On behalf of the Village Council, Mayor Manuel presented plaques to Beth and Bob Gebbia, and
Kim Pollard, in recognition of their tireless efforts on behalf of our military personnel and the
Village ofNorth Palm Beach Support Our Troops program.
The Law Enforcement Division of the Public Safety Department was awazded national
accreditation on 7/26/08 by the Commission on Accreditation for Law Enforcement Agencies
(CALEA.) Interim Director of Public Safety George Warren gave a brief review of the
accreditation process and presented the Village Council with a plaque from CALEA, awarding
the certificate of accreditation to the Public Safety Department.
APPROVAL OF MINUTES
The minutes ofthe Regular Session held 8/28/08 were approved as written.
DECLARATION OF EX PARTE COMMUNICATIONS
Councilman Hernacki reported ex parte communications from Attorney Gary Brandenburg on
6/23/08, and from Howard and Sherri Foster on 8/27/08, regarding Live Oak Plaza annexation
and rezoning.
REORGANIZATION OF AGENDA
Mayor Manuel requested that item 6.E.5, Resolution - U.S. Mayors Climate Protection
Agreement, be removed from the Regulaz Session agenda and placed on tonight's Workshop
Session agenda.

President Pro Tem Aubrey moved that Ordinance 2008-13 entitled

ENDING SEPTEMBER 30, 2009; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN

PALM BEACH FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2008 AND
ENDING SEPTEMBER 30, 2009 AND AUTHORIZING ALLOCATIONS,
APPROPRIATIONS AND EXPENDITURES IN ACCORDANCE WITH THE BUDGET AND
AS AUTHORIZED BY LAW; APPROVING A COMPREHENSIVE PAY PLAN AND
AUTHORIZING THE VILLAGE MANAGER TO MAKE TEMPORARY APPOINTMENTS

be adopted on first reading. Vice Mayor Norris seconded the motion.
Mr. Knight referred Council to the first two pages of the adopted budget document, which reflect
changes made by the Council during the Budget Workshop process. Mr. Knight noted the
reduction of the millage rate from the proposed 6.7322 mils (current year rolled back rate) to
6.6977 mils, which represents a reduction in the overall budget and in ad valorem taxes collected
from Village residents.
Mayor Manuel opened the public hearing. There were no comments from the public. Mayor
Manuel closed the public hearing.
Thereafter, the tentative millage rate of 6.6977 was unanimously approved. The motion to adopt
Ordinance 2008-13 on first reading passed unanimously. The motion to adopt Ordinance 2008-14
on first reading passed unanimously.
• Mayor Manuel announced that the rolled back rate is 6.7322, the percentage decrease is 0.512%
under the rolled back rate, and the millage rate to be levied is 6.6977 mils.

Councilman Hernacki moved that Ordinance 2008-10 entitled
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, ANNEXING APPROXIMATELY 2.62 ACRES OF REAL PROPERTY
KNOWN AS LIVE OAK PLAZA LOCATED ON THE WEST SIDE OF ALTERNATE AIA
SOUTH OF RICHARD ROAD AS MORE PARTICULARLY DESCRIBED HEREIN;
DECLARING THAT THE VOLUNTARY ANNEXATION OF THIS PROPERTY MEETS

Attorney David Gorman was present on behalf of Foster's Pub and requested that the ordinance
be effective at a later date, such as 60 to 90 days from date of adoption.
Attorney Gary Brandenburg was present on behalf of the property owner and expressed that his
client would like the annexation to go forward tonight.

Vice Mayor Norris declared a voting conflict and will not participate in the discussion or vote.
Discussion ensued on the effective date of the ordinance. President Pro Tem Aubrey moved to
amend Ordinance 2008-10 to provide that the effective date shall be 30 days from the date of
adoption. Councilman Eissey seconded the motion, which passed with President Pro Tem Aubrey,
Councilman Eissey, Councilman Hernacki, and Mayor Manuel voting aye.
Thereafter, the motion to adopt and enact Ordinance 2008-10 as amended, on second reading
passed with Councilman Eissey, Councilman Hernacki, President Pro Tem Aubrey, and Mayor
Manuel voting aye.
PUBLIC HEARING AND SECOND READING OF ORDINANCE 2008-11 -SMALL-SCALE
COMPREHENSIVE PLAN AMENDMENT (LIVE OAK PLAZAI
Councilman Eissey moved that Ordinance 2008-11 entitled
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, ADOPTING A SMALL SCALE AMENDMENT TO THE VILLAGE
COMPREHENSIVE PLAN TO AMEND THE FUTURE LAND USE DESIGNATION OF A 2.62

Due to the change in effective date for Ordinance 2008-10, Village Attorney Len Rubin advised
the phrase "or upon the effective date of Ordinance 2008-10, whichever is later" needs to be
added at the end of Section 6 in Ordinance 2008-11 and Ordinance 2008-12.
Mayor Manuel opened the public hearing. There being no comments from the public, Mayor
Manuel closed the public hearing.
Vice Mayor Norris declazed a voting conflict and will not participate in the discussion or vote.

RESOLUTION 2008-59 ADOPTED -STATE AID TO LIBRARIES GRANT APPLICATION
Councilman Eissey moved that Resolution 2008-59 entitled
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, CONFIRMING ITS SUPPORT OF AN APPLICATION FOR STATE
AID TO LIBRARIES GRANT FUNDS AND PROVIDING THE REQUIRED ASSURANCES

• RESOLUTION 2008-60 ADOPTED -PLAYGROUND EOUIPMENT PURCHASE
Councilman Eissey moved that Resolution 2008-60 entitled
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, APPROVING A CONTRACT AWARD TO DOMINICA RECREATION
PRODUCTS, INC. FOR THE REMOVAL OF EXISTING PLAYGROUND EQUIPMENT
AND THE INSTALLATION OF NEW GAMETIME PLAYGROUND EQUIPMENT AT THE
COMMUNITY CENTER AND OSBORNE PARK AND AUTHORIZING THE MAYOR AND
VILLAGE CLERK TO EXECUTE SAME; AND PROVIDING FOR AN EFFECTIVE DATE
be adopted. Vice Mayor Norris seconded the motion.
Parks and Recreation Director Mark Hodgkins distributed a depiction of the playground
equipment that will be purchased. Discussion took place concerning the U.S. Communities
contract. Mr. Hodgkins explained that U.S. Communities is a purchasing syndicate operating
mainly in the southeast.
It was suggested that Mr. Hodgkins check with the contractor to see if the equipment being
removed is suitable for donation to a charitable organization.
Thereafter, the motion to adopt Resolution 2008-60 passed unanimously.
• RESOLUTION 2008-61 ADOPTED -ANCHORAGE PARK WASTEWATER TREATMENT
FACILITY DEMOLITION PROJECT
Councilman Eissey moved that Resolution 2008-61 entitled
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA ACCEPTING THE BID SUBMITTED BY DEVLAND SITE
DEVELOPMENT, INC. FOR THE ANCHORAGE PARK WASTEWATER TREATMENT
FACILITY DEMOLITION AND REMOVAL PROJECT AND AUTHORIZING THE MAYOR
AND VILLAGE CLERK TO EXECUTE AN AGREEMENT RELATING TO SUCH
SERVICES; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE
be adopted. Vice Mayor Norris seconded the motion.
Mr. Knight advised that TBE Group reviewed the bid submittals and recommended Devland Site
Development. Mr. Knight noted that TBE Group will be retained to oversee this phase of
redevelopment.
Discussion ensued on the bid, which included both lump sum and vaziable contingency pricing.
It was noted that the contingency amount may increase or decrease depending upon the amount
of contaminants to be removed.

• REPLACEMENT PROJECT
Councilman Eissey moved that Resolution 2008-62 entitled

BEACH, FLORIDA ACCEPTING THE BID SUBMITTED BY AQUI SI KITCHENS AND
WINDOWS CORP. D/B/A ALLSTATE WINDOWS & KITCHENS FOR THE COMMUNITY
CENTER GLASS WINDOW AND DOOR REPLACEMENT PROJECT AND AUTHORIZING
THE MAYOR AND VILLAGE CLERK TO EXECUTE AN AGREEMENT RELATING TO
SUCH SERVICES; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN
EFFECTIVE DATE
be adopted. Vice Mayor Norris seconded the motion.
Mr. Knight confirmed that the windows and doors aze storm resistant.
Discussion took place on the type and quality of the windows. Public Works Director Wiley
Livingston reported that the contractor listed the type of windows to be used and the Building
Official reviewed it. Mr. Livingston noted that the contractor is required to provide engineering
for the work.
Thereafter, the motion to adopt Resolution 2008-62 passed unanimously.
• COUNCIL MATTERS
Councilman Hernacki requested that the issue of the Village's policy on collection of tree and
vegetation debris be placed on an upwming agenda for discussion.
VILLAGE MANAGER MATTERS
Mr. Knight reported that the South Florida Water Management District (SFWMD) has granted
the Village a permit to use the C-17 canal (Earman River) as its primary irrigation source and
reclaimed water as its secondary irrigation source. Mr. Knight recognized Village Attorney Len
Rubin and Community Development Duector Chuck Huff for their efforts to obtain the permit.
Mr. Knight advised that SFWMD will soon be voting on a vaziance to allow the Village to pull
water from the C-17 canal without limit, depending on the level of water in the canal.
Mr. Knight reported that MacArthur Beach State Park plans to build a boat docking facility on
the northern end of Munyon Island. Mr. Knight stated that the head ranger advised it will be a
passive facility with a breakwater for boat wakes and 20 docks. Mr. Knight expects some impact
to the Public Safety Department due to increased boat traffic in the area. Mr. Knight advised that
there is no obligation to obtain permits from North Palm Beach as the azea is state land.
Mr. Knight gave an update on golf membership renewals, which have reached 206 to date.
