Mayor Gebbia called the meeting to order at 8:29 p.m. All members of Council were present.
All members of staff were present.
ESTABLISHING PROCEDURES FOR SPECIAL EXCEPTION USES IN ZONING DISTRICTS
Discussion was held concerning amending Appendix C, "Zoning," of the Village Code of Ordinances
to establish procedures and standards applicable to applications for approval of special exception uses
within Village zoning districts.
Mr. Kelly explained that a special exception use is a use that is generally compatible with the
characteristics of a particular zoning district, but requires individual review of its location, design,
intensity, configuration and public facility impact in order to determine its appropriateness on
any particular site within the zoning district and ensure compatibility with adjacent uses. Mr. Kelly
noted that a special exception use may require the imposition of additional conditions to make it
compatible within a specific context. Mr. Kelly reported that at its December 2, 2014 meeting,
the Planning Commission, sitting as the Local Planning Agency, recommended approval of the
proposed ordinance.
Discussion ensued on the phrase "filing of a subsequent like application" in Section 45- 16.2(e)(4).
Mr. Rubin explained the intent is that an applicant not be allowed to file successive special
exception use applications that are only slightly modified from the previous application, but must
wait one year to file a substantially similar petition. Mr. Rubin will revise this wording prior to
first reading of the ordinance.
By consensus, Council forwarded this item to the next Regular Session agenda of June 25, 2015.
