A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA APPROVING A MINOR
MODIFICATION TO THE PROSPERITY HARBOR SOUTH (N/K/A
HARBOUR ISLES) PLANNED UNIT DEVELOPMENT TO PROVIDE FOR A
REDUCED FRONT SETBACK FOR A PROPOSED ONE-STORY GARAGE
EXTENSION FOR THE STRUCTURE LOCATED ON LOT 69; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, through the enactment of Ordinance No. 26-96, the Village Council approved the
Prosperity Hazbor South Planned Unit Development, now know as the Hazbor Isles Planned Unit
Development ("PUD"); and
WHEREAS, Section 14 of Ordinance No. 26-96 provides that the Village Council may approve
minor modifications to the PUD without the necessity of review by the Planning Commission,
advertisement or public heazing; and
WHEREAS, the approved master development plan for the PUD designated certain lots within
the PUD, including Lot 69, as estate home lots; and
• WHEREAS, the typical estate home lot dimensions depicted in the master development plan
allow for a reduction in the front setback from twenty-five (25) feet to twenty (20) feet for one-
story structures or portions of a structure that are one-story; and
WHEREAS, during the development process, the size of Lot 69, which is located on a cul-de-sac
and is irregulazly shaped, was reduced so that it no longer met the typical lot dimensions for an
estate home lot as depicted in the master development plan; and
WHEREAS, each of the lots surrounding Lot 69 is an estate home lot and is subject to the
reduced front setback requirements; and
WHEREAS, the current owners of Lot 69 seek to construct aone-story addition to the garage of
the existing structure and aze requesting a modification of the master plan to allow for the
reduced twenty (20) foot setback afforded other estate lots within the PUD; and
WHEREAS, the Village Council determines that the adoption of this Resolution is in the best
interests ofthe Village and its residents.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF NORTH PALM BEACH, FLORIDA as follows:
• Section 1. The foregoing recitals aze ratified as true and incorporated herein.
• Section 2. Pursuant to Section 14 of Ordinance No. 26-96, the Village Council hereby
approves a minor modification to the Prosperity Hazbor South (Hazbor Isles) Planned Unit
Development to allow for a twenty (20) foot front setback for the proposed one-story extension
to the garage of the existing structure located on Lot 69. The extension shall be constructed in
accordance with the plans prepared by Randall StofR Architects currently on file with the
Village's Community Development Department.
Section 3. This resolution shall take effect immediately upon its adoption.
