Mayor Gebbia called the meeting to order at 8:23 p.m. All members of Council were present.
All members of staff were present.
LAND DEVELOPMENT REGULATIONS FOR ASSISTED LIVING FACILITIES
Discussion took place regarding a draft ordinance to provide land development regulations for
Assisted Living Facilities within the C -lA Limited Commercial Zoning District. Mr. Kelly noted
the Council recently amended the Future Land Use Element of the Village's Comprehensive Plan to
adopt Policy 1.B.3 to facilitate the approval of Assisted Living Facilities as mixed -use developments
through the commercial planned unit development process, subject to certain use, intensity, and
density standards. Mr. Kelly reported that on April 14, 2015, the Planning Commission, sitting as
the Local Planning Agency, voted 4 -1 to approve the draft regulations as submitted.
Mr. Rubin stated the proposed regulations would apply to any parcel with a zoning designation of
C -lA Limited Commercial. Mr. Rubin clarified that the proposed land development regulations are
not project or site specific. Regarding the application for land use change and rezoning for the
Oak Hollow Memory Care project, Mr. Rubin reported the Planning Commission would consider
the application and site plan at its June 2, 2015 meeting.
Discussion ensued regarding the areas of the Village that have a C -lA Limited Commercial zoning
designation. Village Planner Jodi Nentwick confirmed there are eight parcels designated C -lA.
Mr. Rubin confirmed that assisted living facilities would be limited to the C -IA zoning district only,
and would not be a permitted use in other commercial zoning districts. Mr. Rubin explained that
the C -lA zoning district was chosen as the most appropriate one for assisted living facilities
because they are technically mixed -use projects with a commercial- residential component.
Discussion was held concerning Section 45- 35.1.II.A.8 of the proposed ordinance regarding parking
requirements. Mrs. Nentwick explained that the language is taken from the Comprehensive Plan
Amendment and is one of the waivers that may be requested in conjunction with the Commercial
Planned Unit Development application process.
By consensus, the Council forwarded this item to the next Regular Session agenda.
