Mayor Aubrey called the meeting to order at 8:17 p.m. All members of Council were present.
All members of staff were present.
CODE AMENDMENT - ABATEMENT OF UNSAFE BUILDINGS AND STRUCTURES
Discussion was held concerning a proposed ordinance providing for the abatement of unsafe or
unsanitary buildings and structures and recovery of costs expended for such abatement activities.
Mr. Kelly stated there is home in the Village with significant roof damage that has not been
repaired since the last hurricane in 2015. Mr. Kelly reported the owner was removed due to the
unsafe and unsanitary condition of the home.
Community Development Director Chuck Huff distributed photos of the house. Mr. Huff
reviewed the procedure set forth in the proposed ordinance for abatement of unsafe or unsanitary
buildings or structures.
Discussion ensued regarding housing maintenance and building codes. Mr. Rubin advised that
while the home met code when it was constructed, through disrepair and neglect it has become
an unsafe, unsanitary, and nuisance property. Mr. Rubin explained the difference between
housing code and building code issues, and the need for a detailed abatement procedure that
ensures all due process requirements are met. Mr. Rubin advised that a special assessment lien
can be enforced on homestead property.
By consensus, Council forwarded this item to the next Regular Session agenda.

With no further business to come before the Council, the meeting was adjourned at 8:35 p.m.
