OF THE VILLAGE COUNCIL OF
NORTH PALM BEACH HELD
June 24, 1961
' The Village Council of the Village of North Palm Beach, Palm Beach County,
Florida, met in special session at the regular meeting place of the council in the
Village Hall in the Village of North Palm Beach, at 10 o'clock P.M., on June 24,
1961, pursuant to cll. which is attached to these minutes, with all members present,
to-wit:

Emery J. Newell Vice-Mayor

Frank J. Hahn Councilman
There was also present Albin R. Olson, Village Clerk, and Village Manager.
The Mayor was in the chair. After the roll had been called with the above
results, the following Ordinance, being Ordinance No. 65, was introduced in written
• form by Vice-Mayor Newell, and read in full and discussed.
Thereupon, upon motion made by Vice-Mayor Newell and seconded by Council-
man Aiello, all. members present voting "aye", the rules were waived and said Ordinance ,
was placed upor. second reading and read by title only.
Thereupon, upon motion made by Councilman Hahn and seconded by Vice-Mayor
Newell, all members present voting "aye", said Ordinance was enacted and adopted.
Said ordinance was thereupon signed by the Mayor, was attested by the Village
Clerk, was ordered recorded, and is as follows:
ORDINANCE N0. 65
An Ordinance calling and providing for a special election in the Village
' o£ North Palm Beach, Florida, on the proposition of issuing $ 1,430,000.00 Recrea-
tional facilities bonds of -said Village.
WHEREAS it has been found necessary by the Village Council of the Village of
North Palm Beach to provide For the acquisition through purchase and construction of
a building, facilities, equipment and grounds for public recreational purposes, includ-
ing golf and swimming, for said Village; and
WHEREAS there are not now available any funds to pay for the cost of said
acquisition; and
WHEREA3 authority is contained in the laws of Florida and the charter of
said Village to issue the bonds of said village for the purpose of paying all or
part of the cost of such acquisition and to make such bonds payable from taxes to be
levied on all taxable property in the village sufficient for the purpose, provided
that prior to the adoption of the ordinance authorizing such bonds, the question of
• the issuance thereof shall have been approved by a majority of the votes cast at an
election in which a ma3ority of the freeholders who are qualified electors residing
in the village shall participate, which election is to be called and held pursuant to
the provisions of Chapter 100, Florida Statutes Annotated; and
WHEREAS the Village Council has determined that the estimated cost of the
acquisition through purchase and construction of said building, facilities, equipment,
and grounds for public recreational purposes, including golf and swimming, and in-
cluding engineering, legal and other fees and charges and costs incidental thereto,
' will be the sum of ~ 1,430,000.00; and
WHEREAS, it is, therefore, deemed advisable to provide for the holding
of a special election for the authorization of such bonds;
NOW, THEREFORE, Be It Ordained by the Village Council of North Palm Beach,
Florida, as follows:
' Section 1. That a special election is hereby called and ordered to be
held in and o-Village of North Palm Beach, Florida, on July 25, 1961, from
7:00 o'clock A.M. until x:00 o'clock P.M., at which there will be submitted to the
freeholders who are qualified electors residing in said Village to be by them voted
upon, the proposition set out in the form of ballot appearing in Section 3 hereof.
For municipal elections generally in said village all of said village constitutes
a single election precinct and the polling place for such election precinct is
usually at the Village Hail, in said village and accordingly for the special election
hereby called all of said village shall constitute a single election precinct and
the palling place for same shall be the Village Hall, in said Village.

Section 2. Only those freeholders who are qualified electors in said
Village and who have duly registered according to law, shall be qualified to vote
at said special election. The Village Glerk as Registration Officer shall close
the registration books for voting purposes fourteen days prior to said election,
and said Village Clerk as such Registration Officer is hereby authorized and
directed to cause to be prepared a list of names of all.qual.ified electors who
' are determined to be freeholders in said village aryl who are thus qualified to
vote at said election, and to furnish a certified copy of such list of qualified
electors who are freeholders'to the inspectors and clerk of the election. Such
list shall be deemed, taken and held to be prima facie evidence of the total
number o£ qualified electors who are freeholders residing in said village and
who are qualified to participate in said special election.
Section 3. That £or said special election ballots shall be prepared for

mature in not more than thirty (30) years
from the date thereof, for the purpose of
paying the cost of acquiring through purchase
and construction a building, facilities, equip-
ment, and grounds for public recreational
' purposes, including golf and swimming, which

Section !~. That the Mayor and Village Clerk are hereby authorized and
directed to give notice of said special election and of the proposition to be
submitted thereat, and of the registration of qualified voters by publicatian
thereof at least once each week for at least four consecutive weeks commencing
not less than thirty days prior to said election in the Commercial Record, a news-
paper of general circulation in the pillage of North Palm Beach, Florida, there
' being no newspaper published in said Village; the Mayor and Clerk are hereby
authorized and directed to give further notice of said special election and
of the proposition to be submitted, and of the notice thereof in at least ten
different places within the territorial limits of the Village. Said notice of
election so to be published and posted shall be in substantially the following
form:

Public notice is hereby given that pursuant to Ordinance duly adopted
by the Village Council of the Village of North Palm Beach, Florida, a special
election has been called and ordered held in and for said village, from 7:00 o~clock
A.M. until 7:00 o+clock P.M, on the 25th day of July, 1963, at which the following
proposition will be submitted to the freeholders who are qualified electors
residing in said village:

PROPOSITION
Proposition of the issuance of the bonds of the
Village of North Palm Beach in the amount of
X1,430,000.00, bearing interest at not to exceed
' four affi three-quarter percent (4 3/4~} per annum,
and to mature in not more than thirty (30) years
from the date thereof, For the purpose of paying the
cost of acquiring through purchase and construction
of building, facilities, equipment airs grounds for
public recreational purposes, including golf and
swimming, which bonds shall constitute full general
obligation of the village and be payable from taxes
levied on all taxable property in the village.
' Said special election will be held at the same polling place whereat elections are
generally held in said Village and the polling place will be at the Village Hall in
said village.
All qualified electors of said village whose names appear upon the registra-
tion books in the office of the Village Clerk and who are found to be Freeholders
residing in said village may vote at said election. The Village Clerk as Registration
Officer will close the registration books fourteen days prior to the election for the
• purpose of making lists of those qualified electors of said village whose names
appear on said registration books and who are found to be freeholders residing in
said village.
This notice is given pursuant to ordinance adopted by said Village Council.

Upon closing of the polls for said special election said inspectors and clerk shall

mitted with the Mayor and Village Clerk in order that such results may be thereafter
canvassed and officially declared by the Council.
Section 6. That the Village Council shallmeetat 8 o~clock P.M. on July 26,
1961, that being the day after said election, at the regular.meeting place of said
Council and sha71 caznrass the returns and declare the result of said election.
Section 7. That this ordinance become effective innnediately following its
adoption.

On motion of Vice-Mayor Thomas, seconded by Councilman Ross, all members voting aye,
proposed Ordinance #50 was approved as read.
The matter of the installation of a police radio facility to provide an exclusive
radio frequency for communication with Anserfone, Inc., was discussed. On motion of
' Vice-Mayor Thomas, seconded by Councilman Ross, all members voting aye, the village
manager was.. authorized to arrange for the exclusive frequency and purchase the necessary
radio equipment to provide this service together with equipment to activate the siren
by telephone equipment. The total cost of the equipment is not to exceed $1,500.
The Village Clerk read the following letter from the owners of the North Palm Beach
Country Club:

Gentlemen:
This letter is written for the purpose of making public the intentions of the
• owners of the North Palm Beach Country Club with regard to its current operation,
future plans, and continued availability to the residents of the Village.
It has long been the intention of the present owners to improve the facilities
in the North Palm Beach Country Club to the extent that it would eventually be the
center of social and recreational activity in the Village. In this regard much
improvement has been made in the past few years on the course itself, in reshaping
and redesigning the holes, planting Permanent grass, insta115ng a complete sprinkling
system, and general improvement of the parking area, approach facilities, etc. The
secor_d phase of this program, to begin during the year 1960 and continuing through the
next few years, will include renovation, new additions, and over-all improvement of
the clubhouse facilities. When this program has been completed, the North Palm Beach
Country Club will be an outstanding asset to the community.

' In order to answer a~ questions about the availability of the club to Village
residents because of some change in the x"uture plans of the present owners, and
to secure for the Village residents the use o£ the golf course and clubhouse, the
present owners are willing to make a proposal as follows: That should the present
otmers desire to sell the Country Club, they iri11 first give the Village an option
to purchase the property on the following terms and conditions.
1. The owners shall give the Village written notice by registered
mail of the purchase price and the terms upon which they are
willing to sell the property.
2, The Village shall have the option of purchasing the property at
such price and terms, provided the Village gives-them vmitten
notice within 90 days, by registered mail directed to the North
Palm Beach Country Club, which written notice shall state that the
Village i.s ready, wiling and able to purchase the land at such
• price and terms.
3. In the event the Village does not accept the offer by giving such
90 days written notice, the owners shall be free of any restriction
on the use or sale of the property thereafter.

On motion of Vice-Mayor Thomas, seconded by Councilman Young, the list of accounts
payable was approved for payment.
' Mr. Carl Tdorris, 801 Alamanda Drive, presented the Council a petition signed by
21 residents of the Buttonwood-(:innamon Road area concerning the maintenance of the
drainage canal abutting their property.
The petitioners were advised the canal would be taken over by the Village for
maintenance as soon as the canal had been constructed by the developer in accordance
with the village engineer specifications.
The Vi17.age Manager was instructed to contact Federal Housing Administration officials
and advise them of the canal situation in an effort to expedite completion of its construc-
tion in accordance with specifications.
There being no further business to come before the Council, on motion of Vice-Mayor
Thomas, seconded by Councilman Young, all members voting aye, the meeting %ras adjourned
at 9:10 p.m.
