Dear Dennis:
To follow up our telephone conversation of Monday,June 7, 2004, enclosed please
find language with respect to the exemption of existing codes respecting the current pylon
sign and landscaping located on the Property. I have provided for a ten year exemption
for the pylon sign and landscaping,which appears to be consistent with your June 4, 2000
letter advising that rezoning and special zone overlay along North Lake Boulevard
regarding signs had to conform to code within ten (10) years.
The language of the enclosed waiver is intended so the Property can continue to be
used as a service-retail storage and rental facility,which would include all activities incident
thereto and which are currently being conducted on the Property. The Property is being
used as a U-Haul site.
It is our intent this exemption be included in any resolution permitting annexation of
the Property.
We hope this meets with your approval. Please contact me as soon as possible
once you have the opportunity to review the language and approve it. We can then
discuss whether you need me to appear at the annexation hearing, together with a U-Haul
representative, should any questions arise respecting the annexation.
