05-22-2014 VC WS-MMINUTES OF THE WORKSHOP SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA MAY 22, 2014 Present: Darryl C. Aubrey, Sc.D., Mayor Robert A. Gebbia, Vice Mayor David B. Norris, President Pro Tern William L. Manuel, Councilman Doug Bush, Councilman Chuck Huff, Interim Village Manager Leonard Rubin, Village Attorney Melissa Teal, Village Clerk ROLL CALL Mayor Aubrey called the meeting to order at 7:40 p.m. All members of Council were present, VILLAGE PENSION PLAN REPORT Attorney Bonni Jensen of the Law Offices of Perry & Jensen, LLC, gave a presentation on the status of investments, asset allocation, Village and State contributions, actuarial funding, FASB 35 and GASB25 funded ratios, and projected future plan status for the General Employees Pension Plan and the Police and Fire Pension Plan. During discussion, Council requested that Ms. Jensen provide the RP -2000 mortality tables. DEFERRED RETIREMENT OPTION PLANS (DROP) Attorney Bonni Jensen of the Law Offices of Perry & Jensen, LLC, gave an overview of Deferred Retirement Options Plans (DROP). Ms. Jensen discussed the benefits to the Village and employees for participating in the DROP as well as provisions that would make adding the DROP cost neutral. During discussion, Council requested that Ms. Jensen provide the actuarial calculations and /or analysis used to determine cost neutrality for the DROP. ZONING CODE AMENDMENT — RESTAURANTS WITH DRIVE - THROUGHS Mr. Huff discussed an application to construct a Dairy Queen Grill & Chill Restaurant with a drive - through at 124 U.S. Highway One. Mr. Huff noted that permitted uses within the C -1 Neighborhood Commercial District include "...restaurants, excluding those with a drive - through." Mr. Huff noted that because the parcel at 124 U.S. Highway One is less than one acre in size, it would not qualify as a Commercial Planned Unit Development. Mr. Huff advised there are presently two drive - through restaurants within the C -1 District, both of which are existing non - conforming uses, having been annexed into the Village in 1996. Mr. Huff clarified the areas that comprise the C -1 Neighborhood Commercial District. Mr. Huff recommended adoption of an ordinance amending the C -1 District regulations to remove the drive - through prohibition. Council noted other businesses in the Village, including banks, a drug store, and a dry cleaner, that have drive - throughs. Discussion ensued on traffic. Mr. Rubin stated traffic would have to circulate on -site. Acting Community Development Director Jodi Nentwick reported on the traffic study submitted by the applicant, which is currently being reviewed by Palm Beach County. Ms. Nentwick stated the Planning Commission, sitting as the Local Planning Agency (LPA) would consider this issue at its June 3, 2014 meeting. By consensus, Council forwarded this item to the June 12, 2014 Regular Session. Draft Minutes of Village Council Workshop Session held May 22, 2014 Page 2 of 2 AT &T REQUEST FOR CELL TOWER AT OSBORNE PARK Mr. Huff reviewed a request by Mastec Network Solutions, representing AT &T, to install a 100 -foot cellular tower and equipment shelter building to be located at Osborne Park. Clinton Weissing, Site Acquisition Project Manager, addressed the Council on behalf of Mastec Network Solutions. Mr. Weissing advised the proposed cell tower would accommodate a minimum of three carriers. It was noted that locating a cell tower at Osborne Park would increase the cell phone coverage area. Discussion took place concerning possible locations for the tower within Osborne Park. Council directed staff to work with Mastec on a location that would not be affected by a future redesign of the park. This item will be reviewed by the Recreation Advisory Board and the Planning Commission prior to being placed on an upcoming Council agenda.
