• A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH
PALM BEACH, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO OFFER
VOLUNTARY `BUY OUT" PROPOSALS TO CERTAIN LONG-TENURED FULL-
TIME EMPLOYEES; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, as a result of recent property tax reforms and a corresponding decrease in taxable
property values, the Village is facing increased operating costs and decreased revenues; and
WHEREAS, personnel vests wmprise over seventy percent (70%) of the Village budget, and
Village Administration has proposed instituting a voluntary buy out program for certain long-
tenured full-time employees as a method to reduce such costs; and
WHEREAS, the Village Council determines that authorizing the buy out program proposed by
Village Administration is in the best interests of the residents and citizen of the Village.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM
BEACH, FLORIDA as follows:
Section 1. The foregoing recitals aze hereby ratified and incorporated herein.
• Section 2. The Village Council hereby authorizes the Village Manager to offer voluntary buy
out proposals to the following classes of full-time Village employees: (1) employees with twenty-
five (25) years of service as of September 30, 2008; and (2) employees who aze fully vested and
eligible for normal retirement benefits in accordance with the provisions of the applicable Village
pension plan as of September 30, 2008. Employees wishing to participate will be required to accept
the buy out proposal by August 1, 2008.
Section 3. The buy out program authorized herein shall consist of: (1) a payment of one
hundred percent (100%) of all accrued leave time, including annual leave, comp time and sick leave
(with no maximum); and (2) three (3) yeazs of continuing 100% employer-paid premiums for single
coverage on the Village's lowest cost medical insurance plan or the cash equivalent of said
coverage paid at the current year's rate (times three years). Employees accepting a voluntary buy
out will be required to execute a general release in favor of the Village.
Section 4. Should any resolution or part thereof, including all portions of existing Village
personnel policies and procedures, be in conflict with this Resolution, the terms of this Resolution
shall control.
Section 5. If any section, paragraph, sentence, clause, phrase, or word of this Resolution is for
any reason held by a court of competent jurisdiction to be unconstitutional, inoperative or void, such
holding shall not affect the remainder of the Resolution.
Section 6. This Resolution shall take effect immediately upon adoption.
