Supp. No. 22 507 EMERGENCY MANAGEMENT § 8 -5 ARTICLE I. IN GENERAL Sec. 8 -1. Definitions. As used in this chapter, the following terms, phrases, words and their derivations shall have the meanings given herein: Disaster means any natural, technological or civil emergency that causes damage of sufficient severity and magnitude to result in the declara- tion of a state of emergency by the county, the governor or the President of the United States. Emergency means any occurrence, or threat thereof, whether natural, technological, or man made, in war or in peace, which results or may result in substantial injury or harm to the village population or substantial damage to or loss of property. Emergency management means the prepara- tion for, the mitigation of, the response to, and recovery from emergencies and disasters. (Ord. No. 16 -2001, § 1, 6- 28 -01) Sec. 8 -2. Applicability. All officers, employees, contractors, vendors, boards, commissions, authorities, and other agen- cies of the village are subject to the provisions of this chapter. (Ord. No. 16 -2001, § 1, 6- 28 -01) Sec. 8 -3. Emergency management structure. (a) The village manager or his designee shall perform the function of director of emergency management and shall implement, manage and report on all actions authorized and taken on the provisions of this chapter. (b) Duties as director of emergency manage- ment shall include the on -going planning for and coordination of those actions necessary for the creation and maintenance of a village comprehen- sive emergency management plan and of an effec- tive emergency response capability to prepare for and manage emergency conditions. (c) The public safety building's multi - purpose room shall serve as the village emergency opera- tions center as necessary. The department of Supp. No. 52 509 public works building will serve as a back -up village emergency operations center should the need arise. (Ord. No. 16 -2001, § 1, 6- 28 -01; Ord. No. 2006 -24, § 2.D, 11 -9 -06) Sec. 8.4. Powers, duties and responsibili- ties. (a) The village manager, when acting as direc- tor of emergency management shall have the following powers, duties and responsibilities: (1) Recommend a declaration of local emer- gency pursuant to section 8 -5. To inform the Village Council of the reasons for and status of the event(s) requiring the decla- ration. (2) To direct the creation, revision and exer- cise of a village comprehensive emergency management plan for the mitigation of, preparation for, response to, and recovery from emergencies, and to exercise all pow- ers permitted by F.S. chapter 252. (3) To direct the efforts of emergency services personnel in preparation for, response to, and recovery from emergency conditions. (4) To recommend a budget to the village council for the creation and maintenance of an emergency response capability as provided herein. (5) To recommend emergency regulations nec- essary for the protection of life and prop- erty, establishment of public order, and control of adverse conditions affecting pub- lic welfare resulting from an emergency, to the mayor and/or village council. (Ord. No. 16 -2001, § 1, 6- 28 -01) Sec. 8 -5. Declaration of a state of emer- gency. (a) The mayor, vice mayor or village manager, in the order named, shall have the authority to declare a local state of emergency. Upon the absence or unavailability of the mayor, vice mayor or village manager, the acting village manager may issue such a declaration. § 8 -5 NORTH PALM BEACH CODE n (b) Any declaration of a local state of emer- gency and all emergency regulations activated under the provisions of this chapter shall be confirmed by the village council by resolution no later than the next regular meeting, unless the nature of the emergency renders a meeting of the village council extremely impractical. Confirma- tion of the emergency declaration shall disclose the reason for, and anticipated impacts of, actions proposed and taken to manage the emergency and other pertinent data relating to the emergency requiring the declaration. (c) Emergency resolutions authorized under this chapter shall include but not be limited to the following subjects: Resolution Subject A Evacuation B Curfews; declaration of areas off limits C Suspension or regulation of the sale of, or offer to sell, with or without consideration: Alcoholic beverages, explosives or combusti- bles. D Suspension of local building regulations E Emergency procurement procedures F Regulating the use of and rationing of fuel, ice and other essentials (d) A local state of emergency, when declared as provided herein, shall continue in effect from day to day for a period of seven (7) days unless declared terminated prior to the passage of seven (7) days; should the local state of emergency be of a duration longer than seven (7) days, the decla- ration may be extended, as necessary, in seven (7) day increments. (e) When a local state of emergency is declared under this article the village has the power and authority to waive the procedures and formalities otherwise required by law pertaining to: (1) Performance of public work in taking what- ever prudent action is necessary to ensure the health, safety and welfare of the vil- lage. (2) Entering into contracts. (3) Incurring obligations. (4) Employment of permanent and tempo- rary workers. (5) Utilization of volunteer workers. Supp. No. 52 510 (6) Rental of equipment. (7) Acquisition and distribution, with or with- out compensation, of supplies, materials, and facilities. (8) Appropriation and expenditure of public funds. (Ord. No. 16 -2001, § 1, 6- 28 -01; Ord. No. 2011 -18, § 2, 9- 22 -11) Sec. 8 -6. Termination of a state of emer. gency. A state of emergency shall be terminated by a vote of the village council if practicable upon the certification of the person who originally re- quested the declaration of the state of emergency, that the conditions leading to or causing the emergency no longer exist and the village's de- partments are able to manage the situation with- out extraordinary assistance; provide that a state of emergency established under F.S. section 252.38 et seq., shall terminate at the end of a period of seven (7) consecutive days after the declaration of the emergency, unless prior to the end of the seven -day period, the public official calling for or the village council has terminated such state of emergency. Any extension of the seven -day time period must be accomplished by a request from the public official and concurrence of the village council by duly enacted resolution. (Ord. No. 16 -2001, § 1, 6- 28 -01) Secs. 8- 7 -8 -20. Reserved. ARTICLE II. CIVIL DISORDERS AND DISTURBANCES Sec. 8 -21. Mayor designated local authority for preservation of public peace. The mayor is hereby designated the local au- thority for preservation of the public peace, pur- suant to F.S. section 870.041. (Ord. No. 16 -2001, § 2, 6- 28 -01) Sec. 8 -22. Declaration of a state of emer- gency. (a) Whenever the chief of police determines that there has been an act of violence or a flagrant and substantial defiance of, or resistance to, a EMERGENCY MANAGEMENT § 8 -22 lawful exercise of public authority and that, on account thereof, there is reason to believe that there exists a clear and present danger of a riot or other general public disorder, widespread disobe- dience of the law, and substantial injury to per- sons or property, all of which constitute an immi- nent threat to public peace or order and to the general welfare of the village or a part or parts thereof, the chief of police shall certify to the village manager, in writing, who in turn shall certify to the Mayor, in writing, that an emer- gency exists within the village or any part or parts thereof. (b) Whenever a state of emergency is declared as stated above, the measures listed in F.S. sec- tion 870.44 shall automatically be invoked. (c) Any declaration of a state of emergency under this section shall be confirmed by the village council through the village manager as soon as practical following the issuance of the declaration. Confirmation shall include the rea- sons for, anticipated impacts of, actions proposed and taken to manage the emergency, and other pertinent data relating to the declaration. (d) Whenever a state of emergency is declared under this section, the discretionary emergency measures listed in F.S. section 870.045 may be invoked in whole or in part, with limitation and conditions as may be deemed appropriate. (e) A state of emergency, when declared as provided herein, shall commence upon the decla- ration thereof and shall terminate at the end of seventy -two (72) consecutive hours, unless, prior to the end of such seventy -two (72) hour period, the chief of police shall have recommended termi- nation of the emergency. An extension of the seventy -two (72) hour period must be accom- plished by request of the chief of police and concurrence of the village council, by duly enacted resolution. (f) Upon the declaration of a state of emer- gency under this section, a written notice of such declaration shall be posted on the main bulletin board in village hall, and as promptly as practical, a notice of declared state of emergency shall be filed in the office of the village clerk or clerk of the Supp. No. 52 511 circuit court, and delivered to local news media for publication and radio and television broad- cast. Dump - sters and similar containers, including recycling bins, compactors, etc., shall be screened in a manner consistent with the following: 1. Similar containers shall be located only at the rear of a building or structure. 2. Enclosures shall be constructed in a man- ner consistent with the architectural style, color, materials, etc., of the principal build- ing, and shall screen the dumpsters on all four (4) sides of the enclosure from public view. a. An opaque concrete wall or similar material shall screen both sides and the rear of such facilities. b. The front of a screen enclosure shall be gated and shall consist of durable opaque materials consistent with the overall design of the project. C. Dependent upon the location of an enclosure on the site, landscaping may be required in addition to the opaque screening material. 3. Alternative dumpster location. When it is not possible to locate the enclosure in the rear of the site, the dumpster shall be enclosed by landscaping to the greatest extent possible. 4. Access to the dumpster should be pro- vided from a secondary street. 5. Enclosures are to be designed to provide space to accommodate recycling bins. D. Sidewalks. Sidewalks shall be provided along all roadways on both sides of the street. At cor- ners handicapped ramps shall be provided and sidewalks shall continue across driveway and parking lot surfaces using decorative paving ma- terials to delineate crosswalks. All new construc- tion or substantial renovation of existing build- ings and structures shall include one (1) or more - clearly delineated walkways from the public sidewalk to the private sidewalk, arcade, pedes- trian way, etc. Examples of other complementary materials include the following: 1. Paver blocks or alternative style or color; 2. New and used brick; and Supp. No. 54 3. Concrete stamped with a pattern. § 45 -35.3 E. Retaining walls. Retaining walls shall be constructed as necessary, provided such walls are constructed utilizing the same architectural style, materials, and color of the principle structure. F. Alley screening walls. All new construction or substantial renovation of existing buildings and structures shall construct or reconstruct a solid masonry or concrete wall a minimum of six (6) feet in height. 1. The wall shall be located along the rear property line of the parcel being im- proved. 2. Chain link and wooden fences are prohib- ited. 3. Properties within the marine district of the NBOZ are exempt from this require- ment. G. Underground utilities. The village may re- quire existing overhead utilities to be placed underground when located on properties subject to new construction or substantial renovation. H. Shopping carts. If a use requires shopping carts, they shall not be allowed to accumulate in any outside area including parking lots and load- ing areas, and shall be removed from cart corrals in a timely manner and relocated to designated storage areas near the principle structure. I. Mailboxes. Mailboxes, including special drop boxes, may be clustered within buildings, grouped under a kiosk, or individually freestanding. In all cases the design and installation of mailboxes shall comply with the following standards: 1. The village and the U.S. Postal Service shall approve the size, type, and location of mailboxes. 2. Mailboxes shall be landscaped consistent with and architecturally compatible to the development. J. Satellite dishes. Satellite dishes may be in- stalled provided the dishes are not visible from any street, and the color is compatible with the surrounding environment. Wall- mounted and free- standing public telephones visible from a public right -of -way shall be fully or par- tially enclosed. 3. Vending machines. a. Vending machines dispensing bever- ages, food, ice, and related consumer products shall not be visible from a public right -of -way. b. Vending machines may be located in outdoor enclosures, provided such en- closures are constructed utilizing the same architectural style, materials, and colors as the principal structure. (Ord. Upon the issuance of a tropical storm watch and/or a hurricane watch by the National Weather Service, the occupant of the property on which a portable storage container or roll -off dumpster is located shall use every reasonable and best ef- fort to remove, or to arrange for the removal of, the portable stor- age container or roll -off dump - ster from the property. b. In the event removal is not possible, the storage container or the roll -off dumpster and its contents, shall be secured against windloads of up to one hundred and fifty (150) miles per hour. C. The occupant of a property upon which a portable storage con- tainer or roll -off dumpster is located shall be subject to civil liability and/or code enforce- ment action for damages and/or code violations caused by an unsecured portable storage con- tainer or roll -off dumpster and its contents. No. 2011 -09, § 2, 5- 26 -11) Sec. 45 -37. Historic site overlay district. A. Purpose. The historic site overlay district is used to impose special development restrictions on identified areas. The locations of this overlay district are established by the Village based on the need for special protective measures at those locations. The historic site overlay district im- poses different standards than those that would otherwise apply. B. Definitions. [For purposes of this section, the following words shall have the meaning as- cribed to them in this subsection:] Building. A structure created to shelter any form of human activity. This may refer to a house, barn, garage, church, hotel, or similar structure. Buildings may refer to a historically or architec- turally related complex, such as municipal build- ings, or a house and barn. Parking lots and garages are hereby deemed to be "buildings." Cultural resource. Asite, object, structure, build- ing or district listed in the Village's register of historic sites. Demolition. The tearing down or razing of twenty -five (25) percent or more of a structure's external walls. District. A geographically definable area pos- sessing a significant concentration, linkage, or continuity of sites, buildings, structures, objects, or areas, which are united historically or aesthet- ically by plan or physical development. A district may be comprised of individual resources which are separated geographically but are linked by association or history. Object. A material thing of functional, aes- thetic, cultural, historical or scientific value that may be, by nature of design, movable, yet related to a specific setting or environment. Ordinary maintenance. Work which does not require a construction permit and that is done to repair damage or to prevent deterioration or decay of a building or structure or part thereof as nearly as practicable to its condition prior to the damage, deterioration, or decay. Original appearance. That appearance (except for color) which, to the satisfaction of the village council, closely resembles the appearances of ei- ther: (1) The feature on the building as it was originally built or was likely to have been built, or (2) The feature on the building as it presently exists so long as the present appearance is appropriate, in the opinion of the vil- lage council, to the style and materials of the building. C. Creation of local register of historic sites. A local register of historic sites is hereby created as a means of identifying and classifying various sites, buildings, structures, objects and districts as historic and/or architecturally significant. The local register will be kept by the director of community development. D. Initiation of placement on local register. Placement of sites, buildings, structures, objects or districts on the local register may be initiated by the village council. In addition, placement may be initiated by the owner of the site, building, structure, object or area; or, in the case of a district, by the owner of a site, building, struc- ture, object or area within the proposed district. By adoption of this ordinance, those sites within the Village of North Palm Beach that have been classified as a "Florida historic site" by the Divi- sion of Archives, History and Records Manage- ment, Florida Department of State, are hereby placed on the local register. E. Placement on local register The following procedure shall be followed for placement of sites, buildings, structures, objects, areas and districts on the local register: 1. A nomination form, available from the department of community development, shall be completed by the applicant and returned to the department.
