• A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA APPROVING A MINOR
MODIFICATION TO THE SANCTUARY COVE PHASE II PLANNED UNIT
DEVELOPMENT TO PROVIDE FOR THE EXTENSION OF THE EXISTING
PIER; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, through the enactment of Ordinance No. 16-96, the Village Council approved the
Sanctuary Cove Phase II Planned Unit Development ("Sanctuazy Cove PUD"), as amended by
Ordinance No. 28-97; and
WHEREAS, Section 14 of Ordinance No. 16-96 provides that the Village Council may approve
minor modifications to the Sanctuary Cove PUD without the necessity of review by the Planning
Commission, advertisement or public heazing; and
WHEREAS, the property owner has requested an amendment to the PUD to extend the existing
ninety (90) foot pier an additional one hundred and eight (108) feet to provide access and
mooring for an existing yacht in accordance with a Stipulated Settlement Agreement with the
South Florida Water Management District and to provide enhanced access to the Intracoastal
Waterway to the residents of Sanctuary Cove for fishing and related activities; and
WHEREAS, the proposed pier extension does not extend waterwazd of the existing bulkhead
located to the north of the pier and does not represent a change in the recreational amenities or
otherwise wnstitute a major modification to the approved PUD; and
• WHEREAS, the property owner has received all approvals required by regulatory agencies
having jurisdiction over construction of piers within the Intracoastal Waterway; and
WHEREAS, the Village Council determines that the adoption of this Resolution is in the best
interests ofthe Village and its residents.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF NORTH PALM BEACH, FLORIDA as follows:
Section 1. The foregoing recitals are ratified as true and incorporated herein
Section 2. Pursuant to Section 14 of Ordinance No. 16-96, the Village Council hereby
approves the requested one hundred and eight (108) foot extension ofthe existing pier as a minor
modification to the Sanctuary Cove Phase II Planned Unit Development. The pier shall be
constructed in accordance with the plans prepared by Cunningham & Dun•ance dated April 6, 2005
and consisting ofone (1) sheet.
Section 3. This resolution shall take effect immediately upon its adoption.
