01-23-2014 VC REG-Mi Present: Absent: ROLL CALL MINUTES OF THE REGULAR SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA JANUARY 23, 2014 William L. Manuel, Mayor Darryl C. Aubrey, Sc.D., Vice Mayor Robert A. Gebbia, President Pro Tem Doug Bush, Councilman Ed Green, Village Manager Leonard Rubin, Village Attorney Melissa Teal, Village Clerk David B. Norris, Councilman Mayor Manuel called the meeting to order at 7:30 p.m. All members of Council were present, except Councilman Norris, who was out of town, and Vice Mayor Aubrey who arrived at 7:42 p.m. All members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation was given by President Pro Tem Gebbia. Councilman Bush led the public in the Pledge of Allegiance. AWARDS AND RECOGNITION Mayor Manuel acknowledged the retirement of Deputy Village Clerk Christine Wilcott and presented Mrs. Wilcott with a Certificate of Appreciation commemorating her years of service. APPROVAL OF MINUTES The Minutes of the Regular Session held January 9, 2014 were approved as written. SECOND READING AND ENACTMENT OF ORDINANCE 2014 -01 — CODE AMENDMENT — SEPARATION REQUIREMENTS BETWEEN RESIDENTIAL AND COMMERCIAL PROPERTIES A motion was made by President Pro Tem Gebbia and seconded by Councilman Bush to adopt and enact on second reading Ordinance 2014 -01 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA AMENDING ARTICLE III, "DISTRICT REGULATIONS," OF APPENDIX C (CHAPTER 45) OF THE VILLAGE CODE OF ORDINANCES BY AMENDING SECTION 45 -36, "GENERAL PROVISIONS," TO ALLOW WALLS AND FENCES WITHIN THE FRONT YARD SETBACK WHERE RESIDENTIAL PROPERTIES ABUT COMMERCIAL OR INDUSTRIAL PROPERTIES; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Green reviewed the proposed ordinance and noted a revision to section D2 as approved by Council on first reading. Thereafter, the motion to adopt and enact Ordinance 2014 -01 on second reading passed with President Pro Tem Gebbia, Councilman Bush, and Mayor Manuel voting aye. President Pro Tern Gebbia seconded the motion and all present voted aye. The following items were approved: Receive for file Minutes of the Library Advisory Board meeting held 11/26/13 Receive for file Minutes of the Golf Advisory Board meeting held 12/16/13 Receive for file Minutes of the Recreation Advisory Board meeting held 1/14/13 RESOLUTION 2014 -05 — BUDGET AMENDMENT AND CAPITAL PURCHASE — THERMAL IMAGING CAMERAS A motion was made by Councilman Bush and seconded by President Pro Tern Gebbia to adopt Resolution 2014 -05 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA APPROVING AND AUTHORIZING THE PURCHASE OF THREE MSA EVOLUTION 6000 PLUS THERMAL IMAGING CAMERAS FROM TEN -8 FIRE EQUIPMENT, INC. PURSUANT TO AN EXISTING LAKE COUNTY CONTRACT FOR THE PURCHASE OF FIRE EQUIPMENT AND SUPPLIES; AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE CLERK TO AMEND THE CAPITAL PROJECTS FUND BUDGET TO TRANSFER $31,125.00 FROM THE CAPITAL RESERVE ACCOUNT TO THE FIRE — MACHINERY AND EQUIPMENT ACCOUNT TO FUND THE PURCHASE; DECLARING TWO EXISTING THREMAL IMAGING CAMERAS AS SURPLUS PROPERTY; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Green recommended the sole source purchase of three thermal imaging cameras from Ten -8 Fire Equipment, Inc. pursuant to an existing contract with Lake County. Mr. Green detailed the verification of fair market value as required by Village policy. Fire Chief J.D. Armstrong explained the use and life expectancy of thermal imaging cameras. Thereafter, the motion to adopt Resolution 2014 -05 passed unanimously. MAYOR AND COUNCIL MATTERS /REPORTS Councilman Bush introduced Village resident Don Kazimir, a U.S. Navy submarine forces veteran and chapter member of the U.S. Submarine Veterans. Mr. Kazimir presented an offer to donate a Mark 37 World War II torpedo to the Village for placement in Veterans Memorial Park. Council consensus was to place this item on a future Workshop Session agenda for discussion. President Pro Tern Gebbia, Vice Mayor Aubrey, and Mayor Manuel announced their candidacy for re- election to the Village Council in Groups 1, 3, and 5, respectively. Mayor Manuel reported on the Palm Beach County League of Cities meeting held 1/22/2014. Mayor Manuel noted an upcoming Senate vote regarding flood maps, and discussed the League's j legislative priority concerning sober homes. Mayor Manuel announced the Car Show and Chili Cook Off on Sunday at Anchorage Park. Minutes of Village Council Regular Session held January 23, 2014 Page 3 of 3 VILLAGE MANAGER MATTERS /REPORTS Mr. Green announced that Attorney Bonni Jensen would attend a March Council meeting to brief the Council on pension matters and the Village's Defined Benefit Plan. Mr. Green acknowledged distribution of the quarterly financial report. The Council concurred that it was satisfied with the quarterly report and would defer discussion of finances until receipt of the mid -year financial report.
