The village's investment portfolio shall be structured to provide sufficient liquidity to pay obligations as they come due. Furthermore, to the extent possi- ble, an attempt will be made to match investment maturities with known cash needs and antici- pated cash flow requirements. Unless matched to a specific cash flow, the village will not directly invest in securities maturing more than three years from the date of purchase. (h) Portfolio composition. The following are the limits for investments and limits on security issues, and maturities in the portfolio. The chief financial officer has the option to further restrict investment in selected instruments, to conform to the present market conditions. Note: The table below defines two (2) types of village investments, "operating" and "core ": Operating: Those liquid funds necessary to conduct routine village activity, in addition to an amount determined by the village council and administration sufficient to cover emer- gency situations and unforeseen capital expen- ditures. Core: All funds not included in operating funds. In general, these funds can be invested in issues with longer -term maturities. These terms shall be defined and the amounts will be designated at least once a year during the village budget discussions. Changes during a year shall only be made by resolution of the village council. These changes will apply to the end of the current fiscal year and must be reconfirmed or changed as needed during the next annual budget process. Assets held shall be diversified to control the risk of loss resulting from the over - concentration of assets in a specific maturity, issuer, instrument, dealer, or bank through which these instruments are bought and sold. Diversification strategies shall be reviewed and revised periodically as deemed necessary by the chief financial officer. (j) Authorized investment institutions and deal- ers. A list will be maintained of financial institu- tions authorized to provide investment services. Supp. No. 39 135 In addition, a list also will be maintained of approved security brokers /dealers selected by cred- itworthiness. (k) Third -party custodial agreements. All secu- rities purchased by the village shall be properly designated as an asset of the village and shall be held in safekeeping with a third -party custodial institution. The third -party custodian will be re- quired to designate all securities held as assets of the village. No withdrawal of securities, in whole or in part, shall be made from safekeeping, except § 2 -4 NORTH PALM BEACH CODE by the chief financial officer, or his/her respective designees. Securities transactions between a bro- ker- dealer and the custodian involving purchase or sale of securities by transfer of money or securities must be made on a "delivery vs. pay- ment" basis, if applicable, to ensure that the custodian will have the security or money, as appropriate, in hand at the conclusion of the transaction. (1) Master repurchase agreement. All approved institutions and dealers transacting repurchase agreements shall execute and perform as stated in the master repurchase agreement. All repur- chase agreement transactions shall adhere to the requirements of the master repurchase agree- ment. (m) Bid requirement. An appropriate maturity date will be determined for each investment based on cash -flow needs and market conditions. Based on these considerations, the chief financial officer will analyze and select one or more optimal types of investments and competitively bid the security in question when feasible and appropriate. Ex- cept as otherwise required by law, the bid deemed to best meet the investment objectives specified in subsection III must be selected. (n) Internal controls. (1) The chief financial officer shall establish and maintain a written system of internal controls made a part of the village's oper- ational procedures. The internal controls shall be designed to prevent losses of funds, which might arise from fraud, em- ployee error, misrepresentation by third parties, or imprudent actions by employ- ees of the village. No person shall engage in an investment transaction except as authorized in this policy. (2) Independent auditors, as a normal part of the annual financial audit to the village, shall conduct a review of the system of internal controls to ensure compliance with policies and procedures as may be required by the village. Supp. No. 39 136 (o) Continuing education. The chief financial officer shall complete eight (8) hours of continuing education annually in subjects or courses related to investment practices and products. (p) Reporting. The chief financial officer shall prepare a quarterly investment report, which shall include securities in the portfolio by class and type, acquisition cost, income earned, yield, maturity date and market value as of the report date. The report will be provided to the legislative and governing body of the village and shall be available to the public. (q) Securities; disposition. Every security pur- chased on behalf of the Village must be properly earmarked and: (1) If registered with the issuer or agents, must be immediately placed for safekeep- ing in a location that protects the village's interest in the security; (2) If in book entry form, must be held for the credit of the governing body by a deposi- tory chartered by the federal government, the state, or any other state or territory of the United States which has a branch or principal place of business in the state as defined in Florida Statutes section 658.12, or by national association organized and existing under the laws of the United States which is authorized to accept and exercise trusts and which is doing busi- ness in the state, and must be kept in the depository in an account separate and apart from the assets of the financial institution, or (3) If physically issued to the holder but not registered with the issuer or its agents, must be immediately placed for safekeep- ing in a secured vault. (r) Sale of securities. When invested funds are needed in whole or in part for the purposes originally intended or for more optimal invest- ments, the chief financial officer may sell such investments at the then - prevailing market price and place the proceeds into the proper account or fund. 0 ADMINISTRATION § 2 -19 (s) Policy considerations. (1) Exemptions. Any investment held prior to the adoption of this policy that does not meet the guidelines of this policy shall be exempted from the requirements of this policy. At maturity or liquidation, such monies shall be reinvested only as pro- vided by this policy. (2) Amendments. This policy shall be re- viewed on an annual basis by the village council at the "setting of council goals and objectives" session of the annual budget. The village council must approve any changes. (t) Delegation of authority. The finance direc- tor is the chief financial officer of the village and is responsible for investment decisions and activi- ties. No person may engage in an investment transaction except as provided under the terms of this policy and the procedures established here- under. Nothing set forth herein shall preclude the village from utilizing a chartered financial ana- lyst or any other individual or agency subject to formal oversight by the United States Securities and Exchange Commission to invest funds on behalf of the village in accordance with the man- dates of paragraph (h) of this investment policy. Authorized signatories are the chief financial officer, the village manager and the village mayor. These individuals are also authorized to initiate wire transfers for the village. Secs. 2- 5 -2 -15. Reserved. ARTICLE II. COUNCIL* DIVISION 1. GENERALLY Sec. 2 -16. Compensation. The compensation of all members elected to the village council other than the mayor is hereby *Charter reference — Legislative provisions generally, Art. III. Supp. No. 54 137 fixed at the sum of seven hundred fifty dollars ($750.00) per month. The compensation of the mayor is hereby fixed at the sum of nine hundred dollars ($900.00) per month. Same — Presiding officer. (a) The mayor shall preside at all meetings, if present, and in his absence, the vice - mayor. In the absence of both the mayor and vice - mayor, the president pro tem shall preside. (b) The presiding officer shall preserve order and decorum. He shall appoint all committees unless the council shall otherwise direct. (c) Terms of mayor. No person may serve more than one -year term as mayor of the village. A person who served as mayor of the village for one (1) term shall not serve as mayor during the following council year, but beginning one (1) year after termination of his one -year term as mayor of the village, he may again serve as mayor for a period not to exceed one (1) year. All regular meetings, special meetings and workshop meetings for the village council shall be adjourned on or before 11:00 p.m. on the date when the meeting convened. In the event there is pending business on the floor at 11:00 p.m. during one (1) of the meetings, the chair shall at that time entertain a motion that the meeting be reconvened at a time and date certain, but upon failure of the council to agree upon such motion, the meeting shall be adjourned and the business § 2 -19 NORTH PALM BEACH CODE ,- ) pending at the time of adjournment shall be the first item on the agenda of the next meeting of the village council pertaining thereto. No. 2006 -01, § 3, 1- 26 -06) Sec. 5 -23. Same — Claiming of vessel by owner; payment of costs. The owner of such impounded vessel may take possession of such vessel at anytime prior to the time of sale provided herein, but such owner shall reimburse the village for all reasonable expenses for removal, storage, advertising and other ex- penses incurred as a result of the impoundment of such vessel. The proceeds from the sale of any impounded vessel shall not be expended or disbursed for ninety (90) days after the date of such sale. At any time during such period, the owner, upon provid- ing proof of such ownership of such vessel, evi- denced by documentary written evidence, may recover back the proceeds of the sale, less all of the expenses incurred in regard to removal, stor- age, advertising and a commission of five (5) percent on the gross sales price of such vessel for the cost of making such sale. If the owner fails to provide proof of ownership and recover back the proceeds of the sale in the time frame set forth herein, the proceeds of sale shall be forfeited to the village. (Ord. It shall be unlawful of any person to occupy a live aboard boat or vessel in any waterway except as specifically authorized by this article. (Ord. No. 12 -98, § 9, 4- 23 -98; Ord. BOAT LAUNCHING AREA Sec. 5 -33. Designated; use restricted. No person shall bring into, launch or operate any vessel (as defined in F.S. § 327.02) upon any park property, including designated swimming areas, except as such places as are or may be designated for such use or purposes by the North Palm Beach Village Council. Such operation or use shall be in accordance with such rules and regulations as are now or may hereafter be adopted by the village council. All vehicles using the boat ramps ofAnchorage Park or parking with a trailer at Anchorage Park must have a village launch ramp sticker permanently affixed to the vehicle, visible from behind the vehicle. (Code 1970, § 11 -11; Ord. No. 2006 -08, § 1, 6 -8 -06) Sec. 5 -34. Repairs prohibited. No repair work upon boats, boat trailers or other boating equipment shall be permitted at the village boat launching area with the exception of minor repairs or adjustments essentially neces- sary to make such boat, trailer or equipment operable or transportable to a professional facility devoted to such repair service. (Code 1970, § 11 -12) Sec. 5 -35. Vehicle /trailer parking in desig- nated areas; permits required. (a) No person shall park a vehicle on park property at any place other than in the regularly designated facilities provided for that particular type of vehicle unless otherwise directed by a law enforcement officer or village employee or by official signs or markings. (b) No boats or boat trailers shall be allowed to remain more than twenty -four (24) hours at the village boat launching area unless a written per- § 5 -35 NORTH PALM BEACH CODE C mit therefore has been secured from the village manager or his designee. Such permits shall be issued upon such reasonable regulations and upon such cost as shall be determined, from time to time, by the village council. (Code 1970, § 11 -13; Ord. No. 2006 -08, § 2, 6 -8 -06) Sec. 5 -36. Abandoned boats and equipment — Disposition. (a) It shall be presumed that the owner of each boat, each boat trailer, and each piece of boat equipment found on the village boat launching area as to which there is not then outstanding a currently effective permit issued under section 5 -35 of this chapter, has abandoned such boat, boat trailer or piece of boat equipment. (b) Thereupon, it shall be lawful for the vil- lage, through its officers or employees, to remove such abandoned material from such area, destroy- ing that which is junk and disposing of all other material for the best price, and upon the best terms available. The net proceeds of any such sale shall be deposited in the general fund of the village. (Code 1970, § 11 -14) Sec. 5 -37. Same — Recovery. At any time within ninety (90) days after the disposition of any boat, boat trailer or equipment under section 5 -36 of this chapter, the owner, or any person having any alleged interest in such disposed of property, may, upon making proof of such ownership or interest, recover back from the village the proceeds of the sale, less all the ex- penses of caring for, moving, advertising and making such sale. (Code 1970, § 11 -15) Sec. 5 -38. Violation; penalty. Violation of any provision of section 5 -33, Des- ignated; use restricted or section 5 -35, Vehicle/ trailer parking in designated areas; permits re- quired, shall result in a civil fine of fifty dollars ($50.00) for a first offense and one hundred dol- lars ($100.00) for any subsequent violation. CANALS Sec. 5 -56. Compliance with division re- quired. All canals for navigation and/or drainage pur- poses to be dug or constructed within the corpo- rate limits of the village, either in whole or in part, whether or not such canal is dedicated to the public, shall be subject to the requirements set forth in this division. (Code 1970, § 11 -21) Sec. 5 -57. General requirements. (a) All canals shall be provided with reinforced or prestressed concrete bulkheads which shall meet the requirements of the village building code and the village ordinances concerning zoning as they are concerned with bulkheads. (b) All canals to be constructed in areas pro- posed to be platted shall meet the requirements of the subdivision ordinance of the village, as set out in Appendix B of this volume, and amendments thereto, and must be approved as part of the plan of development of the proposed platted area. (c) Canals to be constructed in unplatted areas shall meet the requirements of the village build- ing code and all ordinances of the village relating to zoning, and plans for the construction of any canal must be approved by the engineers of the village prior to the issuance of a building permit for such canal. Vulgar language. No person shall use vulgar, profane or indecent language on any public street or other public place or in any public dance hall, club dance, skating rink or place of business open to public patronage. (Code 1970, § 24 -71) Sec. 19 -66. Window peeping. No person shall look, peer or peep into, or be found loitering around or within view of, any window not on his own property with intent of watching or looking through such window where persons lawfully present on such property would have a reasonable expectation of privacy. (Code 1970, § 24 -77) Secs. 19- 67- 19 -81. Reserved. ARTICLE V. OFFENSES AGAINST PUBLIC PEACE* Sec. 19 -82. Stench bombs. (a) Throwing or depositing. No person shall throw, drop, pour, deposit or discharge, upon the person or property of another any liquid, gaseous or solid substance which is injurious to person or property, or which is nauseous, sickening, irritat- ing or offensive to any of the senses with the intent to wrongfully injure, molest, discomfort, discommode or coerce another in the use, man- agement, conduct or control of his person or property. No person shall attempt or aid in the attempt or commission of any of these prohibited acts. (b) Possession prohibited. No person shall man- ufacture or prepare or have in his possession or under his control, any liquid, gaseous or solid substance or matter of any kind which is injurious to person or property, or which is nauseous, sick- ening, irritating or offensive to any of the senses, with the intent to use the same in violation of paragraph (a) of this section or with intent that the same shall be used in violation of such para- graph. The possession or control by any person of any such liquid, gaseous or solid substance or *Cross reference —Noise control, § 19 -99 et seq. Supp. No. 21 1229 matter shall be deemed prima facie evidence of intent to use the same or cause the same to be used in violation of such paragraph. (c) Excepted uses. The prohibitions of para- graphs (a) and (b) of this section shall not apply to police officers acting in line of duty or to propri- etors of business places or their employees using such substances for the protection of their prop- erty and their business places when the sub- stances referred to herein are kept solely for the purpose of repelling robbers, thieves, murderers or other law violators. No person shall throw any stone or any other missile upon or at any vehicle, building, tree or other public or private property, or upon or at.any person in any public or private way or place or enclosed or unenclosed ground. (Code 1970, § 24 -66) Secs. 19- 84- 19 -98. Reserved. ARTICLE VI. NOISE CONTROL- Sec. 19 -99. Definitions. For the purpose of this article, whenever any of the following words, terms or definitions are used herein they shall have the meanings respectively ascribed to them in this section except where the context requires otherwise: Ambient noise means the all- encompassing noise associated with a given environment, being a composite of sounds from many sources, near and far. For the purposes of this Code, ambient noise level is that level which is exceeded only fifty (50) percent of the time during an observation period of not less than seven (7) minutes, excluding random or intermittent noises and the alleged offensive noise at the location and the time of day at which a comparison with an alleged offensive noise is to be made. The evaluation of the ambient (Cross references — Enforcement of Ch. 19, Art. XI by code enforcement inspector, § 2 -171 et seq.; offenses against public peace, § 19 -82 et seq. § 19 -99 NORTH PALM BEACH CODE - -.� noise level may be done in accordance with Amer- ican National Standard S1.13 -1971, as amended, or may be done manually as follows: (1) Observe a sound level meter and at either five- second or ten- second intervals and record the A- weighted level indicated by the meter needle with the meter on FAST response. (2) Repeat the observations and measure- ments over a period of not less than seven (7) minutes and of a sufficient time period so as to make at least fifty (50) readings. (3) Calculate the A- weighted sound pressure level that is exceeded fifty (50) percent of the observation period. This level shall also be referred to as the L50. Acoustical terminology. All acoustical terminol- ogy and all definitions thereof shall be that con- tained in ASA S1.1 -1960, as amended, American Standard Acoustical Terminology of the American National Standards Institute. Authorized emergency vehicle means vehicles of the fire department (fire patrol), police vehicles and such ambulances and emergency vehicles of municipal departments, public service corpora- tions operated by private corporations, and the department of transportation as are designated or authorized by the department or the chief of police of an incorporated city or any sheriff of any of the various counties. Decibel means a unit for measuring the inten- sity of a sound, the mathematical formula for which is expressed as the volume of a sound which is equal to ten (10) times the logarithm of the ratio of the intensity of the sound to the intensity of a specified standard sound, abbrevi- ated "dB." Discrete tone means a pure tone or a single - frequency sound. This is expressed technically as a sound wave whose instantaneous sound pres- sure varies essentially as a single sinusoidal function of time. Emergency work means work made necessary to restore property to a safe condition following a natural disaster or public calamity; or work re- quired to protect persons or property from immi- Supp. No. 21 1230 nent danger caused by hurricanes, tornados, floods or other natural disasters or public calamity; or work by private or public utilities when installing or restoring utility service. Fixed source means a machine or device capa- ble of creating a noise level at the property line upon which it is located, including, but not lim- ited to, industrial and commercial process machin- ery and equipment, pumps, fans, air conditioning apparatus, refrigeration machines or pool heat- ers. Fluctuating noise means a noise in which the loudness varies with time. This is expressed tech- nically as a noise whose sound pressure level varies significantly and exceeds the ambient noise level. Impulsive noise means a very short duration noise. It is a noise characterized by brief exertions of sound pressure which significantly exceed the ambient sound pressure. Intermittent noise means an interrupted noise which reoccurs at either regular or irregular intervals, excluding an impulsive noise. The sound pressure level of an intermittent noise will equal the ambient environmental level two (2) or more times during the period of observation. Motor vehicle means any vehicle which is self - propelled. Motorcycle means any motor vehicle having a seat or saddle for the use of the rider and de- signed to travel on not more than three (3) wheels in contact with the ground, but excluding a trac- tor. Motor - driven cycle means any motorcycle, and any motor scooter with a motor which produces not to exceed five -brake horsepower, including every bicycle with a motor attached. Nonsteady noise is the same as a fluctuating noise. Period of observation means the time interval during which acoustical data and facts are ob- tained. Sound means a temporal and spatial oscilla- tion in pressure, or other physical quantity in a i OFFENSES AND MISCELLANEOUS PROVISIONS medium with internal forces that causes compres- sion and rarefaction of that medium, and which propagates at finite speed td distant points. Sound pressure level, in decibels, of a sound is twenty (20) times the logarithm to the base ten (10) of the ratio of the pressure of the'sound to the reference sound pressure. The reference is 0.0002 microbar. The sound pressure level may be eval- uated using FLAT, A, B, or C scales as defined by the American National Standards Institute and shall be labeled dB, . dBA, dBB or dBC respec- tively The A- weighted sound pressure level mea- sured with fast response on an instrument meet- ing American National Standards Institute specifications or its successor bodies, except that only the A- weighting and fast dynamic response need be provided, shall be called the "sound level." .Steady noise means a nonfluctuating noise or a noise whose level remains essentially constant during the period of observation. \ Unnecessary, excessive or offensive noise is any sound which: (1) Endangers or injures the safety or health -.._ of humans or personal or real property; (2) Exceeds any dBA limits established pur- suant to this article; (3) Is loud and raucous; (4) Tends to annoy a substantial number of persons in the community; or (5) Is plainly audible and causes or tends to cause an adverse psychological or physio- logical effect on human beings. Zoning district means any of the several desig- nated categories in the zoning code of the village. (Code 1970, § 22 -2; Ord. No. 5 -75, § 1, 6- 12 -75; Ord. In furtherance of the mandate of the people, as expressed in article II, section 7 of the constitu- tion of the state, it shall be the policy of the village to conserve and protect its natural resources and Supp. No. 21 1231 § 19 -103 scenic beauty and adequate provision shall be made by ordinance for the abatement of excessive and unnecessary noise. (Code 1970, § 22 -1; Ord. No. 5 -75, § 1, 6- 12 -75) Sec:` 19 -101. Unlawful to make unnecessary, excessive or offensive noise. It shall be unlawful for any person knowingly or willfully, or through his culpable negligence to make or create excessive, unnecessary or offen- sive noise within the village, as heard by persons. (Code 1970, § 22 -3; Ord. No. 5 -75, § 1, 6712 -75) Sec. 19.102. Noise from buildings, premises or property. No person owning, or in possession or control of any building or.premises, shall use the same, or rent the same to be used for any business or employment or residential use, or for any purpose of pleasure or recreation, if such use shall, by its nature, be excessive or offensive, and thereby disturb or destroy the peace of the neighborhood in which such building or premises is situated, or be dangerous or detrimental to health. This sec - tion shall not prohibit the operation or periodic testing of emergency engines, generators and other 'equipment necessary to maintain or restore regulated public utilities service or other neces- sary public services. No person shall sound any horn or audible audible signal device of any motor vehicle, boat, engine, machine or stationary boiler of any kind while not in motion, nor shall such horn or signal device be sounded under any circumstances except as re- quired by law, or as a danger warning, nor shall it be sounded for any unnecessary or unreasonable period of time. This section shall not be construed as forbidding ` the use of a signal device on a vehicle as a warning signal during the use thereof. (Code 1970, § 22 -5; Ord. No. 5 -75, § 1, 6- 12 -75) Cross reference —Motor vehicles and traffic, Ch. 18. § 19 -104 NORTH PALM BEACH CODE Sec. 19 -104. Radios, electronic audio equip- ment and musical instruments. No person shall use, operate or play any radio, phonograph, stereo set, tape player, television set, sound amplifier or other electronic audio device or any musical instrument which produces or repro- duces sound, at an excessive or unusually loud volume level so as to disturb the peace, quiet and comfort of the neighborhood in the vicinity. (Code 1970, § 22 -6; Ord. No. 5 -75, § 1, 6- 12 -75) Sec. 19 -105. Loudspeakers and devices for advertising. No person shall use, operate or play any loud- speaker, sound amplifier or musical instrument which produces or reproduces sound which is cast or emitted upon the public streets and sidewalks for the purpose of commercial advertising or for attracting the attention of the public to any build- ing, structure or place or to the activity which is being carried on thereon. (Code 1970, § 22 -7; Ord. No. 5 -75, § 1, 6- 12 -75) Cross reference— Licenses and miscellaneous business regulations, Ch. 17. Sec. 19 -106. Noisy and boisterous conduct. It shall be unlawful to knowingly and willfully cause or create excessive or unnecessary noise by engaging in boisterous, noisy and loud conduct while upon a public street, sidewalk or parkway so as to annoy or disturb the quiet, comfort or repose of persons in any office, store, dwelling, hotel, motel or residence within the range of hearing. (Code 1970, § 22 -8; Ord. No. 5 -75, § 1, 6- 12 -75) Sec. 19 -107. Animal noises. It shall be unlawful to keep or maintain any animal or bird within residential zones of the village unless the owner thereof shall provide and maintain adequate precautions and sound control techniques to eliminate any excessive, offensive or unnecessary noise. It shall not be a violation of this section, however, for any animal or bird to give a sound of danger or warning under partic- ular circumstances reasonably requiring the need for warning. It shall be unlawful to discharge into the open air the exhaust of any steam engine, turbine or reciprocating internal- combustion engine of any kind, whether on a motor vehicle, boat or any machine of any kind, except through a muffler or other device which will effectively prevent exces- sive or unnecessary loud noise. (Code 1970, § 22 -10; Ord. No. 5 -75, § 1, 6- 12 -75) Cross reference —Motor vehicles and traffic, Ch. 18. Sec. 19 -109. Vehicle defect or condition of load. It shall be unlawful for any person to operate a motor - propelled boat in need of repair, or defec- tive or under any condition of load, acceleration or deceleration, as to create excessive or unneces- sary loud noises. It shall be unlawful for any person engaged in loading, unloading, packing or unpacking or open- ing crates, boxes or containers, including the loading or unloading of any motor vehicles or truck trailers onto any truck transport to create excessive or unnecessary loud noise. (Code 1970, § 22 -12; Ord. No. 5 -75, § 1, 6- 12 -75) Sec. 19 -111. Permissible time for construc- tion activity. (a) It shall be unlawful for any person to do, perform or engage in any construction work, building, excavating, hoisting, grading, pile driv- ing, pneumatic hammering, demolition, dredging, building alteration or repair work of any nature to any building or structure or upon any site for same, in the village between the hours of 8:00 p.m. of one day and 8:00 a.m. of the next day if any such activity shall cause noises whose levels result in excess of the limits as stated in section 19 -118. No construction activity shall be permit- ted on Sundays or legal holidays. Any person desiring to engage in the aforesaid activity be- yond the stated hours of limitation, based upon cases of urgent necessity or upon the interests of 1 � 1 U OFFENSES AND MISCELLANEOUS PROVISIONS § 19 -114 public health, safety and ultimate convenience, may apply to the village manager or his represen- tative for a special permit. Such permits, if granted, shall be limited to a certain period, but may be renewed for additional periods if the emergency or need therefor continues. In the issuance of such permits the village manager or his designated representative shall weigh all facts and circum- stances and shall determine whether the reasons given for the urgent necessity are valid and rea- sonable, whether the public health, safety and ultimate convenience will be protected or better served by granting the permit requested, and whether the manner and amount of loss or incon- venience to the party in interest imposes a signif- icant hardship. Upon an affirmative finding of the foregoing considerations, the village manager or his designee is authorized to issue the permit requested and any extensions thereof, as may be required. Any person aggrieved by the decision of the village manager or his designated represen- tative may appeal the decision of the village manager to the village council. (b) It shall be unlawful for any person to cause or permit the use of any power - driven machinery, tools or equipment in any portion of the village zoned and designated as a residential district or section other than between the hours of 8:00 a.m. and 6:00 p.m. on weekdays and between the hours of 12:00 noon and 6:00 p.m. on Sundays. Power mowers shall be used only between the hours of 8:00 a.m. and 8:00 p.m. weekdays, and on Sun- days only between the hours of 12:00 noon and 8:00 p.m. (Code 1970, § 22 -13; Ord. No. 5 -75, § 1, 6- 12 -75; Ord. No. 17 -76, § 2, 9- 23 -76) Cross reference — Buildings and building regulations, Ch. 6. Sec. 19 -112. Fixed mechanical equipment. (a) It shall be unlawful to create any excessive or unnecessary loud noise in excess of the limits of section 19 -118 by the use or operation of any fixed mechanical equipment including, but not limited to, air conditioners, compressor units, power fans or blowers or the electric motor or any engine used to drive such device, and such noise shall be muffled and deadened by adequate noise suppres- Supp. No. 52 sion and muffling devices to eliminate annoyance and disturbance to persons within the range of hearing as set forth in this article. (b) The director of community development shall require compliance with all reasonable sound abatement measures and sound screening which may be necessary to prevent all existing and new fixed mechanical equipment, including, but not limited, to air conditioning equipment, from cre- ating excessive, unnecessary or offensive noise. All new air conditioning equipment hereafter installed in the village shall carry the manufac- turer's certification of the sound rating, as deter- mined by the applicable standards of the Air Conditioning and Refrigeration Institute or the American Society of Heating, Refrigeration and Air- Conditioning Engineers. If the sound rating value of an air conditioning unit is such that the sound level created by its operation is in conflict with the provisions of section 19 -118, adequate noise suppression and muffling devices shall be provided to reduce noise level to within the allow- able limits. All pertinent information and data as to the sound ratings of such equipment shall be furnished to the department of public services at the time the application for the building permit is made. (Code 1970, § 22 -14; Ord. No. 5 -75, § 1, 6- 12 -75; Ord. No. 2006 -24, § 2.G.1, 11 -9 -06) 1233 Sec. 19 -113. Noise measurement procedure. For the purpose of determining and classifying any noise as unnecessary, excessive or offensive or as an unusually loud noise, which is hereby declared to be unlawful and prohibited by this article, the requirements of section 19 -118 may be applied; provided however, a violation of this article may occur without the occasion of the measurements being made as hereinafter pro- vided if circumstances are such that a violation would be obvious to a reasonable, prudent person. (Code 1970, § 22 -15; Ord. No. 5 -75, § 1, 6- 12 -75; Ord. No. 34 -2000, § 2, 11 -9 -00) Sec. 19 -114. Periods of observation. All periods of observation made hereunder shall be determined with regard to the character of the noise being measured, and the particular instru- § 19 -114 NORTH PALM BEACH CODE ment used to make the measurement, and shall be made in accordance with the standards con- tained in ANSI S1.13 -1971, as amended, of the American National Standards Institute. (Code 1970, § 22 -16; Ord. No. 5 -75, § 1, 6- 12 -75) Sec. 19 -115. Voluntary compliance. The village will permit, whenever possible, those persons creating excessive and unusually loud noise to conform to the standards as pro- vided in this article through voluntary compli- ance within a reasonable time. (Code 1970, § 22 -17; Ord. No. 5 -75, § 1, 6- 12 -75) Sec. 19 -116. Enforcement—Authority. (a) The provisions of this article except those requiring the use of a decibel meter shall be enforced by the police department. (b) The provisions of this chapter involving stationary mechanical noise source control and complaints and any authority and responsibility specifically designated to the director of commu- nity development shall be investigated and en- forced by the department of community develop- ment. Specifically, where the use of a decibel meter is needed to determine sound levels, the department of community development shall in- vestigate and enforce the article. The department of public safety shall assist the department of community development when requested to do so. (Code 1970, § 22 -18; Ord. No. 5 -75, § 1, 6- 12 -75; Ord. No. 34 -2000, § 3, 11 -9 -00; Ord. No. 2006 -24, § 2.G.2,11-9-06; Ord. No. 2011 -21, § 16, 11- 10 -11) Sec. 19 -117. Same — Procedure. (a) Operating motor vehicle noise enforcement. The procedure for enforcing operating motor ve- hicle noise standards shall be established in F.S. §§ 316.272 and 316.293, and applicable rules and regulations of the state department of environ- mental regulation with the cooperation of the state department of highway safety and motor vehicles. (b) All other noises. In all other cases, the procedure for enforcing the provisions of this chapter shall be as follows: (1) A police officer or designated person in the department of community development shall investigate and determine if a viola- tion has or is occurring. Supp. No. 52 1234 (2) If the noise is found to be in violation of this article, a police officer or designated person in the department of community development may give a warning to the person or persons responsible for the un- necessary, excessive or offensive noise. (3) If enforcement action is deemed neces- sary by the police department, the person in possession or control of the cause of the unnecessary, excessive or offensive noise may be arrested by the police department and charged with violating this article. In the case of enforcement action by the department of community development, a notice of violation shall be issued requir- ing the responsible party to appear before the code enforcement special magistrate. The noise from any fixed mechanical equip- ment within the meaning of the applicable zoning district classifications of the village shall be deemed to be excessive, unnecessary and unusually loud if the total noise level as measured on the A -scale due to both ambient noise level and the alleged source of the unnecessary, offensive or excessive noise exceeds the noise levels which are herein prescribed, the measurement of which is based upon decibels, i.e. 0.0002 microbar, and day con- ditions referring to the time between 7:00 a.m. and 10:00 p.m. and night conditions referring to the time between 10:00 p.m. and 7:00 a.m. All such measurements as well as the method em- ployed shall be consistent with the regulations of the American National Standards Institute or its successor bodies and shall represent the A- weighted sound pressure level which is exceeded fifty (50) percent of the time (L50) during the observation period as described in the definition of "ambient noise" in section 19 -99 of this article. Possession. (a) No person shall wear under his clothes, or conceal about his person, or display in a threat- ening manner, any dangerous or deadly weapon including, but not by way of limitations, any slingshot, cross - knuckles, or knuckles of lead, brass or other metal, or any bowie knife, or any knife resembling a bowie knife, or any knife with a switchblade or device whereby the blade or blades can be opened by a flick of a button, pressure on the handle, or other mechanical contrivance. (b) This section shall not be construed to forbid United States marshals, sheriffs, constables and their deputies, and any regular, special or ex officio police officer, or any other law enforcement officer from carrying or wearing, while on duty, such weapons as shall be necessary in the proper discharge of their duties. (Code 1970, § 24 -73) Sec. 19 -185. Sales restricted. (a) Sale of switchblade knives prohibited. No person shall sell, offer for sale, or display any knife or knives having the appearance of a pocket knife, the blade or blades of which can be opened by a flick of a button, pressure on the handle, or other mechanical devices. Such knife is hereby declared to be a dangerous or deadly weapon within the meaning of section 19 -183, and shall be subject to forfeiture to the village as provided in this article. (b) Display and sale of specified weapons. No pawnbroker, secondhand dealer or other person engaged in business in the village shall display or place on exhibition in any show window or other window facing any street, any brass or metal knuckles, or any club loaded with lead or other weight, or any blackjack or billy club. Supp. No. 52 1236 (c) Record of sales required. Every secondhand dealer, pawnbroker or other person engaged in the sale, rental or exchange of any weapons described in sections 19 -183 and paragraph (b) of this section shall keep a record of each such weapon purchased, sold, rented or exchanged at retail. (1) Time of recordation. The record shall be made at the time of the transaction, in a book kept for that purpose, and shall include the name of the person to whom such weapon is sold or from whom such weapon is purchased; his or her age, phys- ical description, occupation, residence, and, if residing in a municipality, the street and number where he or she resides; the date of the purchase, sale, rental or ex- change of such weapon; and the name of the employee or other person making such purchase, sale, rental or exchange. (2) Daily reports. Daily reports shall be deliv- ered to the chief of police of every such purchase, sale, loan or gift. The report shall be on forms provided by the chief of police and shall set forth the name in full, the residents, age and physical descrip- tion and the occupation of the person to whom or from whom such dangerous or deadly weapon has been purchased, sold, loaned or given. (Code 1970, § 24 -74; Ord. No. 2011 -21, § 17, 11- 10 -11) Sec. 19 -186. Forfeiture; disposition. (a) Every person convicted of a violation of this article shall forfeit to the village such dangerous or deadly weapon so concealed or displayed. (b) Every police officer, upon making any ar- rest and taking a weapon used in violation of articles I through V and this article of this chap- ter, shall deliver the same to the judge to be held by him or her until the final determination of the prosecution for such offense; and, upon the find- ing of guilt, it shall then be the duty of such judge to deliver such weapon forthwith to the chief of police who shall make disposition of the weapon.
