ROLL CALL
Mayor Manuel called the meeting to order at 8:40 p.m. All members of Council were present, except
Councilman Norris, who was out of town. All members of staff were present.
EMERGENCY OVERTIME FOR EXEMPT EMPLOYEES
Discussion took place concerning a proposed ordinance providing for emergency duty compensation
for exempt employees who report to work during a local state of emergency.
Mr. Green explained that Village employees who are required to work extended hours during a
disaster or extreme emergency are usually senior staff who are classified by the Fair Labor
Standards Act ( "FLSA ") as exempt employees and not eligible for overtime. Mr. Green advised
that if a crisis is deemed an emergency by FEMA, an exception can be made and exempt employees
can be eligible for overtime as long as the overtime hours worked are disaster - related. Mr. Green
reported the funds for these overtime hours are reimbursable by FEMA, with proper documentation.
Mr. Green stated the proposed ordinance would amend the Village Pay Plan to allow exempt
employees to receive overtime pay in emergency situations.
Discussion took place concerning the number of employees that would be involved in
responding during an event and in post -event recovery, the estimated cost of overtime pay,
proper documentation, and the timeframe to receive FEMA reimbursement. Clarification was
requested regarding the key staff that would be required in the event of a disaster.
Mr. Rubin stated emergency overtime would be tied to the code procedure for declaring a state
of emergency, which is done by the Village Manager and ratified by the Village Council. Mr. Rubin
noted that the duration of emergency overtime would be subject to Council control because it
would end when the state of emergency was terminated by the Council.
This item will be brought back to another Workshop Session for further consideration.
