ORDER ON VARIANCE APPLICATION

Legal Description: The South 318 of the East one -half of the Southeast quarter of the
Southeast quarter of the Northwest quarter of Section 17, Township
42 South, Range 43 East, less the East 40 feet for road right -of-
way, together with that part of the Southwest quarter of Section 17,
Township 42, Range 43 East lying north of the Earman River
(Canal C -17) less the 40 feet thereof (PCN: 68-43-42-17-00-000 -

Request: Variance from Section 45 -36(D) of the Village Code of Ordinances
to allow the replacement of an existing, non - conforming four foot
wood fence with a six foot chain link fence within the area between
the front yard setback and the street line.
THIS MATTER came before the Zoning Board of Adjustment on April 9, 2013.
After considering the testimony and other evidence presented during the course of a
properly noticed public hearing, it is hereby ordered and adjudged as follows:
1. Applicant's request for a variance does not meet the requirements of
Section 21 -21 of the Village Code of Ordinances and is hereby DENIED,
2. The Applicant failed to demonstrate the existence of special conditions
which are peculiar to the land, structure or building involved or that enforcement of the
Code provision at issue would work an undue non -self imposed hardship on the
Applicant.
