2013-23 Harbour Isles Planned Unit Development ModificationRESOLUTION 2013 -23 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA APPROVING A MINOR MODIFICATION TO THE PROSPERITY HARBOR SOUTH (N /K/A HARBOUR ISLES) PLANNED UNIT DEVELOPMENT TO PROVIDE FOR AN INCREASE IN THE HEIGHT OF THE HEDGE ADJACENT TO PROSPERITY HARBOR; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, through the enactment of Ordinance No. 26 -96, the Village Council approved the Prosperity Harbor South Planned Unit Development, now know as the Harbour Isles Planned Unit Development ( "PUD "); and WHEREAS, Section 14 of Ordinance No. 26 -96 provides that the Village Council may approve minor modifications to the PUD without the necessity of review by the Planning Commission, advertisement or public hearing; and WHEREAS, the approved Master Development Plan for the PUD limits the height the hedge adjacent to Prosperity Harbor (located at the intersection of Allamanda Drive and Prosperity Farms Road) to three (3) feet; and WHEREAS the Homeowners Association of Harbour Isles, Inc. has requested a modification to the PUD to increase the height of the hedge adjacent to Prosperity Harbor to a maximum of eight (8) feet based on security concerns; and WHEREAS, the Village Council determines that the adoption of this Resolution is in the best interests of the Village and its residents. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA as follows: Section 1. The foregoing recitals are ratified as true and incorporated herein. Section 2. Pursuant to Section 14 of Ordinance No. 26 -96, the Village Council hereby approves a minor modification to the Prosperity Harbor South (Harbour Isles) Planned Unit Development to increase the maximum height of the hedge adjacent to Prosperity Harbor (located at the intersection of Allamanda Drive and Prosperity Farms Road) to eight feet, which shall represent the maximum height of all hedges along Prosperity Farms Road.
