03-28-2013 WS Memo and Order-Internet Vehicle Sales OfficeVILLAGE OF NORTH PALM BEACH COMMUNITY DEVELOPMENT TO: Mayor and Village Council FROM: Ed Green, Village Manager l BY: Jodi Nentwick, Interim Co unity Development Director DATE: March 28, 2013 SUBJECT: MOTION — Issuance of Special Permit for Similar Uses within Zoning District (David Cohen — Vehicle Internet Sales Office) The Village Administration received a Similar Use Special Permit request from David Cohen seeking approval to operate a vehicle internet sales office within the C -A Commercial District, at 712 U.S. Highway One, Suite 301 -35. The proposed use is similar to professional office, which is a permitted use by right within this zoning district. The business entails the selling and marketing of automobiles via the internet. There will be no outdoor storage or displays of the vehicles. No repairs or walk up business or the like will be conducted on site, and there will be no exterior signage. Staff has reviewed the application for compliance based on the guidelines of Section 45 -16.1 of the Village Code of Ordinances. This item was presented to Council at its March 14' 2013 Workshop Session and was moved to the Regular Session by consensus. Recommendation: Village Administration recommends Council consideration and approval by Motion of the Similar Use — Special Permit application by David Cohen allowing for the operation of an internet vehicle sales office located at 712 U.S. Highway One, Suite 301 -35 in accordance with Village Policies and Procedures. n� VILLAGE OF NORTH PALM BEACH ORDER ON APPLICATION FOR SPECIAL USE PERMIT Applicant: David Cohen Location: 712 U.S. Highway One, Suite 301 -35 Parcel ( "Premises ") Legal Description: 68- 43- 42- 09 -01- 071 -0020 YACHT CLUB ADDITION TO VILLAGE OF NORTH PALM BEACH LOTS 2, 3 & S 80 FT OF LOT 4 BLK 71 Zoning District: CA Commercial District Request: Special Use Permit for a Similar Use to Establish an Internet Vehicle Sales Office. This matter came before the Village Council for public hearing on March 28, 2013. Upon consideration of the recommendation of the Community Development Director and the statements presented by the Applicant, members of the public and other interested persons during the course of the public hearing, the Village Council hereby finds as follows: The Applicant's request satisfies the criteria and requirements set forth in Section 45 -16.1 of the Village Code of Ordinances for the grant of a special use permit for the establishment of similar use within the CA commercial zoning district. Based on the foregoing, it is hereby ORDERED by the Village Council that: 1. The Applicant's request to establish an Internet Vehicle Sales Office on the Premises is GRANTED subject to the following conditions: A. No outdoor display or repair of vehicles on site. B. No exterior signage permitted. C. The Applicant shall secure and maintain, at all times, a valid Business Tax Receipt issued by the Village of North Palm Beach. Page 1 of 2 2.
