FLAG POLE HEIGHTS Consider a motion to adopt and enact on second reading Ordinance 2008-01, amending Section 6-115 of Chapter 6, Buildings and Building Regulations of the Code of Ordinances by increasing the maximum height of flag poles and maximum size of flags within specified zoning districts and providing for non-conforming status. ACTION PUBLIC HEARING AND 2ND READING OF ORDINANCE 2008-02 – CODE AMENDMENT – 2. GENERAL EMPLOYEES PENSION PLAN Consider a motion to adopt and enact on second reading Ordinance 2008-02, amending Section 2-148 of Division 3, Pensions and Certain Other Benefits for General Employees, of the Code of Ordinances to authorize early retirement for terminated vested participants. ACTION Regular Session Agenda Thursday, January 10, 2008 PUBLIC HEARING AND MOTION – SPECIAL USE PERMIT – ALL SMILES DENTAL 3. ASSISTING SCHOOL LLC Consider a motion to approve application for Similar Uses Special Permit to allow Scott G. Duff, DMD to operate a dental assistant school at 712 U.S. Highway 1, conditioned upon a maximum occupancy of 14 people and in accordance with Village policy. ACTION 1ST READING OF ORDINANCE 2008-03 – CODE AMENDMENT – ELECTIONS 4. Consider a motion to adopt on first reading Ordinance 2008-03, amending Chapter 10, Elections, of the Code of Ordinances to remove superseded language and otherwise conform to state law. ACTION 1ST READING OF ORDINANCE 2008-04 – CODE AMENDMENT – FLOATING DOCKS 5. Consider a motion to adopt on first reading Ordinance 2008-04, amending Sections 5-83 and 5-85 of Chapter 5, Boats, Docks and Waterways, of the Code of Ordinances to allow floating docks in Lake Worth and the Atlantic Ocean. ACTION D. CONSENT AGENDA The Consent Agenda is for the purpose of expediting issues of a routine or pro-forma nature. Councilmen may remove any item from the Consent Agenda, which would automatically convey that item to the Regular Agenda for separate discussion and vote. Resolution2008-01 1. directing Village Clerk to publish notice of General Election to be held 3/11/08; designating the PBC Supervisor of Elections to canvass absentee ballots and elections returns; designating the PBC Supervisor of Elections or his designee, as the Village’s representative for the Logic and Accuracy testing of the tabulating equipment for the General Election and the runoff election, should there be one 2. OTHER VILLAGE BUSINESS MATTERS RESOLUTION – SUPPORTING FLORIDA LEAGUE OF CITIES RESOLUTION 2007-12 1. Consider a motion to adopt a proposed resolution supporting Resolution 2007-12 of the Florida League of Cities, which urges citizens to consider the consequences of the proposed constitutional amendment concerning property taxes. ACTION 2 Regular Session Agenda Thursday, January 10, 2008 RESOLUTION – EMERGENCY REPAIR OF STORM DRAIN PIPE 2. Consider a motion to adopt a proposed resolution approving a contract award to D.S. Eakins Construction Corp. for repair of storm drain pipe on Eastwind Drive in an amount not to exceed $16,200. ACTION RESOLUTION – LIBRARY LONG-RANGE PLAN 3. Consider a motion to adopt a proposed resolution approving a long range strategic plan for the Village Library and authorizing the filing of supplemental documents in support of the Village’s State Aid to Libraries Grant application. ACTION RESOLUTION – SEACOAST UTILITY AUTHORITY AGREEMENT FOR GRAY WATER 4. Consider a motion to adopt a proposed resolution approving a Class “A” Reclaimed Water Agreement between the Village and Seacoast Utility Authority. ACTION RESOLUTION – INTERLOCAL AGREEMENT WITH SOLID WASTE AUTHORITY 5. Consider a motion to adopt a proposed resolution approving an Interlocal Agreement with the Solid Waste Authority of Palm Beach County for delivery of designated facilities and for a municipal recycling program. ACTION MOTION – PROSPERITY FARMS ROAD BEAUTIFICATION PROJECT CLOSEOUT 6. Consider a motion authorizing final payment to Delray Garden Center in the amount of $10,482 for Prosperity Farms Road Beautification Project, in accordance with Village policy. ACTION F. ADJOURNMENT Next Ordinance 2008-01 Next Resolution 2008-01 If a person decides to appeal any decision by the Village Council with respect to any matter considered at the Village Council meeting, he will need a record of the proceedings, and for such purpose he may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. This agenda represents the tentative agenda for the scheduled meeting of the Village Council. Due to the nature of governmental duties and responsibilities, the Village Council reserves the right to make additions to, or deletions from, the items contained in this agenda. 3
