• A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH
PALM BEACH, FLORIDA, RATIFYING A MEMORANDUM OF AGREEMENT
BETWEEN THE VILLAGE AND THE FEDERATION OF PUBLIC EMPLOYEES
(FPE) TO REFLECT AGREEMENT ON INTERPRETATION AND APPLICATION
OF THE PAID HOLIDAY PROVISION OF THE CURRENT COLLECTIVE
BARGAINING AGREEMENT;AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Village of North Palm Beach and the Federation of Public Employees (FPE)
entered into a Collective Bargaining Agreement that expires September 13, 2013; and
WHEREAS, an issue regarding the interpretation and application of compensation for task
employees who work on holidays has arisen which resulted in discussion and agreement between
Village and the FPE representatives; and
WHEREAS, the Village Council of the Village of North Palm Beach deems it to be in the best
interests of the employees, residents and citizens of the Village to ratify the Memorandum of
Agreement with the FPE.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF NORTH PALM BEACH, FLORIDA, THAT:
Section 1. The foregoing 'WHEREAS" clauses are true and correct and hereby ratified and
confirmed by the Village Council.
Section 2. The Village Council of the Village of North Palm Beach, Florida does hereby ratify
the attached Memorandum of Agreement between the Village of North Palm Beach and the
Federation of Public Employees addressing the holiday compensation. A copy of said
Memorandum of Agreement is attached hereto as Exhibit "A".
Section 3. This Resolution will become effective immediately upon passage.

MEMORANDUM OF AGREEMENT
This Memorandum of Agreement is entered into by the Village of North Palm Beach, hereinafter
referred to as the "Village" and the Federation of Public Employees, AFL-CIO hereinafter
referred to as the "Union".
Whereas, the Village and the Union are parties to a Collective Bargaining Agreement for a term
that ends September 30, 2013; and
Whereas, the Union filed a grievance questioning the City's interpretation and application of
Article 20 as it relates to task workers in the bargaining unit; and
Whereas, the City and the Union have discussed the interpretation and application of Article 20
and have reached agreement on an interpretation and application of Article 20 that conforms to
Section 9.02.03 of the Villages' Rules and Regulations which provides:
If the holiday falls on a Saturday, the previous Friday shall be designated as the
official holiday and if the holiday falls on a Sunday, the following Monday shall
be designated as the official holiday.
Now, therefore the City and Union agree:
1. The statements made in the foregoing Whereas clauses are true and correct.
2. The holidays listed in Article 20, Section 1 of the Village's/Union's Collective
Bargaining Agreement shall be observed on the same day of observance as the non-
bargaining unit employees of the Village, in accordance with 9.02.03 of the Villages'
Rules and Regulations.
3. This MOU will take effect when ratified by both the members of the Bargaining Unit and
the Village Commission.
4. On ratification, there will be a holiday pay adjustment (the employee will receive two and
a half (21/4) hours of pay at their prevailing straight time hourly rate of pay) for task
employees identified in Union Grievance #35-000-005 retroactive to December 25, 2011,
to be paid no later than the second pay period following ratification.
5. On ratification of this MOU by both parties Union Grievance #35-000-005 will be
deemed resolved and therefore withdrawn.
