09-26-2007 VC SP-MMINUTES OF THE SPECIAL SESSION • VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA SEPTEMBER 26, 2007 Present: Dr. Edward M. Eissey, Mayor William Manuel, Vice Mayor David B. Norris, President Pro Tem Darryl Aubrey, Councilman T.R. Hernacki, P.E., Councilman Jimmy Knight, Village Manager Len Rubin, Village Attorney Melissa Teal, CMC, Village Clerk ROLL CALL Mayor Eissey called the meeting to order at 7:00 p.m. All members of Council were present. All members ofstaffwere present. SECOND READING OF ORDINANCE 2007-14 ESTABLISHING FY 2007-2008 MILEAGE RATE Vice Mayor Manuel moved that Ordinance 2007-14 entitled AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM • BEACH, FLORIDA, ESTABLISHING AND ADOPTING THE VILLAGE OF NORTH PALM BEACH AD VALOREM TAX OPERATING MILEAGE RATE OF 6.100 MILS FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2007 AND ENDING SEPTEMBER 30, 2008 AND AN AD VALOREM DEBT SERVICE TAX MILEAGE RATE OF 0.000 MILS FOR A TOTAL AD VALOREM TAX MILEAGE RATE OF 6.100 MILS; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE be adopted and enacted on second reading. Councilman Hernacki seconded the motion. SECOND READING OF ORDINANCE 2007-15 ADOPTING FY 2007-2008 BUDGET President Pro Tem Norris moved that Ordinance 2007-15 entitled AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING THE ANNUAL BUDGET OF THE VILLAGE OF NORTH PALM BEACH FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2007 AND ENDING SEPTEMBER 3Q 2008 AND AUTHORIZING ALLOCATIONS, APPROPRIATIONS AND EXPENDITURES IN ACCORDANCE WITH THE BUDGET AND AS AUTHORIZED BY LAW; APPROVING A COMPREHENSIVE PAY PLAN AND AUTHORIZING THE VILLAGE MANAGER TO MAKE TEMPORARY APPOINTMENTS TO BUDGETED POSITIONS; PROVIDING PROCEDURES FOR BUDGET AMENDMENTS; PROVIDING FOR THE LAPSE OF OUTSTANDING ENCUMBRANCES AND THE RE-APPROPRIATION OF UNEXPENDED • APPROPRIATIONS FOR THE PRIOR FISCAL YEAR; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE be adopted and enacted on second reading. Vice Mayor Manuel seconded the motion. Minutes of Village Council Special Session Geld September 26, 2007 Page 2 of 2 Village Manager Jimmy Knight reviewed recommended changes to the General Fund Budget with • regazd to reorganization of the Community Development Department. Mr. Knight advised that the changes recommended can be funded with no budgetary change, because the cost of our insurance premium renewal was lower than anticipated. Mr. Knight detailed savings of approximately $185,000 in the General Fund budget, which will provide for salary and benefits for new positions in Community Development, as well as an additional $80,000 in Council contingency. President Pro Tem Norris moved to amend the budget to incorporate the recommended changes. The motion to amend was seconded by Councilman Hemacki and passed unanimously. PUBLIC HEARING ON AD VALOREM TAX MILEAGE RATE ORDINANCE AND BUDGET ORDINANCE Mayor Eissey opened the Public Heazing on the millage rate and budget. There were no comments from the public. Mayor Eissey closed the Public Heazing. DISCUSSION OF MILEAGE RATE AND BUDGET Councilman Aubrey moved to amend Ordinance 2007-14 to lower the millage rate to 6.0 mills using funds available in undesignated reserves. Vice Mayor Manuel seconded the motion. Mr. Knight • noted that funds aze available in Council contingency as well as undesignated reserves. Discussion ensued on the uncertainty of legislatively proposed property tax reform measures. Vice Mayor Manuel wmmented for the record that he would like to see Council adopt a lower millage rate, but until the uncertainty with regard to property tax reform is resolved, he is unable to support it. Subsequently, the motion failed 1 - 4, with Councilman Aubrey voting aye, and Vice Mayor Manuel, Councilman Hernacki, President Pro Tem Norris, and Mayor Eissey voting nay. Thereafter, the motion to adopt and enact Ordinance 2007-14 on second reading passed unanimously. The motion to adopt and enact Ordinance 2007-15 on second reading, as amended, passed unanimously.
