Vice Mayor Moore called the Workshop Session to order at 9:05 p.m. ROLL CALL
All members of the Council and Staff were present except Mayor Marks,
Councilman Brown and Village Attorney Gildan.
A discussion was held concerning NPBOC delinquent accotnts being taken NPBCC DELINQUENT
to small claim's court. The Village Manager suggested that the staff ACODUNfS
prepare a general policy for Council's approval that gives the Village
an option on a case-by-case basis. This item will be placed on the
next Regular agenda of 4/24/80.
A discussion was held amceming the monitoring of golfballs coming
onto the tennis courts at the NPBCC. Vice Mayor Moore queried
Mr. Yeager as to whether, in legal terms, the Village has done
everything that is possible to correct the situation. Mr. Yeager's
response was that all necessary precautions had indeed been taken
including visible signs stating that the public should use caution
when in the area of stray golfballs upon approaching the tennis
courts. It was the amsensus of the Council that Village Attorney
Gildan need not respond to Larry Klein's letter of March 31, 1980.
7n a letter to Council fran Ray Howland, they ware advised that
Mr. Keldie had conducted the monitoring over a two week period;
that approximately 38 golfballs had landed in proximity of the
Fermis courts without injury to any person.
Council unanimously agreed with the Palm Beach County Municipal
League that Councilman Brown chair the coamittee to study the
{feasability and proper legislation for the establishment of a
Uniform Election Day and its acceptance by all municipal
governments. Cliff Burgess of Jupiter and James Cox of Lake Worth
will also serve on said conmittee. The Village Clerk was instructed
to advise Councilman Brawn of said action.
A discussion was held concerning clarification of Village employees'
annual leave. Councilwixnan Nolan stated that there exists a
Personnel Regulation adopted in 1977. Many Village employees were
hired under the Personnel Manual adopted in 1971. With reference
to Section 7.03 "Annual Leave," (1977), if an employee is hired
under the 1971 manual, and the 1977 manual tames up, if the fringes
are upgraded, that's terrific; if they are not, the people who were
hired under the original persormel manual should be grandfathered in;
their fringes should not be downgraded. Employees have told Council-
woman Nolan that they have to work 13 years before they receive 4
weeks leave, and 8 years before they receive 3 weeks leave. She
stated that as she interpreted the manual, the first day of their
13th year, they are entitled to 20 days leave; that they have to
work a full 7 years and the 1st day of their 8th year, they are
entitled to 15 days. Several people have told Councilwoman Nolan
that their annual leave will have to wait another year for that
extra week. She requested clarification fran the Village er.
Mr. Nicoletti stated that department heads have interpretedth s
to mean that instead of completion of 7 years service for the higher
amormt, that it dust meant being into the 7th year. At the completion
of 7 years service, employees begin to accrue days at a higher rate.
Vice Mayor Moore also disagreed with the interpretation. President
Pro Tem Valente suggested that Mr. Nicoletti prepare a revised version
in layman's terms and bring it back for Cota~cil to review at a later
date. (Mayor Marks returned to the meeting at 9:30 p.m.)
