08-23-2007 VC WS-M• MINUTES OF THE WORKSHOP SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA AUGUST 23, 2007 Present: Dr. Edward M. Eissey, Mayor William Manuel, Vice Mayor David B. Norris, President Pro Tem Darryl Aubrey, Councilman T.R. Hernacki, Councilman Jimmy Knight, Village Manager Leonazd Rubin, Village Attorney Melissa Teal, CMC, Village Clerk ROLL CALL Mayor Eissey called the Workshop Session to order at 8:38 p.m All members of Council were present. All members of staffwere present. LARGE-SCALE COMPREHENSIVE PLAN AMENDMENT - DOMANI PROJECT Ryan Thomas of Bohler Engineering, representing Kolter Communities, gave a presentation on • the large-scale comprehensive plan amendment requested for the Domani project. Mr. Thomas noted that the project was previously rezoned from C-1 to R-3 and approved for 77 residential units - 69 condominiums and 8 townhouse villas. Mr. Thomas explained that although the R-3 zoning district allows 24 units per acre, a special policy for the Domani project restricts density to 11 units per acre, thus requiring a text change to the Village's Comprehensive Plan and transmittal of a large-scale wmprehensive plan amendment to the Florida Department of Community Affairs (DCA) in order to change the special policy. Mr. Thomas related that the project as presently proposed increases the density to 24 units per acre, and includes 2 towers with a maximum height of 220 feet and 34 townhouses. Discussion ensued on the appeazance of the project. Mr. Thomas noted that Village staff, Planning Commission, and Village Council will review and approve the site plan. Mr. Rubin advised that site plan approval is contingent upon the land use change, and explained that if Council approves the lazge-scale comprehensive plan amendment, it is transmitted to the DCA for review and comment, and then comes back to Council for final adoption. Discussion took place wncerning the time frame for wnstruction. Mr. Thomas estimated 18-22 months for construction of amulti-family building and 12-15 months for the townhomes. Mr. Rubin advised that due to substantial changes from the Planned Unit Development (PUD) as formerly approved, the project will come before Council as a new PUD approval, rather than an amendment to the current PUD. Minutes of Village Council Workshop Session held August 23, 2007 Page 2 of 2 • It was noted that because the project never started, the Village has not received the $1,175,000 cash contribution, which was in lieu of dedicating 5% of the ]and for public use. Discussion ensued on sale of the property after the land use plan amendment is approved. Bob Vail of Kolter Communities reported that although there has been much interest in the property from potential buyers, Kolter is not interested in selling and plans to develop the property. Discussion ensued on tying the increased density to approval of a site plan. Mr. Rubin advised Council that land use matters aze issues of policy and Council must consider whether a density of 24 units per acres is appropriate for this location. Village Planning Consultant, Jim Fleischmann, explained that if adopted, the land use plan amendment assigns a high density residential land use category, which is a range of 11.01 to 24 units per acre. Mr. Fleischmann advised this does not guazantee 24 units per acre, but allows application to the Village through the site plan process to attain that density. Mr. Fleischmann reported that Comprehensive Plan Special Policy 5.2 encompasses both the Passionist Monastery property and Kolter's parcel, and the amendment moves the southern boundary of Special Policy 5.2 to encompass only the Passionist site and assigns a high density future land use category to the Domani pazcel. Mr. Vail expressed plans to address concerns raised by the Council when this item is placed on the Regular Session agenda. Mr. Rubin advised that after first reading, the amendment is transmitted to the DCA, with second reading coming after review and comment by the DCA. Council consensus was to place this item on the 9/27/07 Regular Session agenda, or whenever • the applicant is ready. Brief discussion ensued on the how the funds in lieu of land dedication may be used. OPTION TO MOVE MUNICIPAL ELECTION DATE Discussion took place concerning the option to move the date of the Municipal Election from March 11, 2008 to January 29, 2008 to coincide with the Presidential Preference Primary Election. Council consensus was in favor of keeping the March 11, 2008 date for the upcoming Municipal Election.
