2007-083 U.S. Highway 1 Corridor Study Phase II AmendmentRESOLUTION 2007-83 • A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE AGREEMENT WITH LAND RESEARCH MANAGEMENT FOR THE U.S. HIGHWAY ONE CORRIDOR PLANNING STUDY TO CHANGE THE SCOPE OF SERVICES FOR PHASE TWO; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Village Council retained Land Research Management, Inc. to perform a three phase planning study to implement the directives of the recently adopted Evaluation and Appraisal Report and to examine the potential redevelopment along the U.S. Highway One corridor; and WHEREAS, Land Research Management completed phase one of the study, the results of which were accepted by the Village Council; and WHEREAS, the Planning Commission has recommended certain changes to the Snipe of Services for phase two and the Village Council wishes to amend the agreement with Land Research Management to incorporate these recommendations. WHEREAS, the Village Council determines that such action in the best interests of the public health, safety and welfare. • NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA as follows: Section 1. The foregoing recitals are hereby ratified and incorporated herein. Section 2. The Village Council hereby approves an Amendment to the Agreement for Planning Services with Land Research Management relating to the U.S. Highway One corridor revising the scope of services for phase two. The Council further authorizes the Mayor and Village Clerk to execute the Amendment to the Agreement, a copy ofwhich is attached hereto as Exhibit "A" and incorporated herein by reference, on behalf of the Village. Section 3. All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 4. This Resolution shall take effect immediately upon adoption. ATTEST: 16G~~0~~ ~ ~~~ VILLAGE CLERK AMENDMENT TO AGREEIHEIti'T FOR PLANN[NG SERVICES THIS AMENDMENT is made as of thisa7~day of August, 2007, by and between the Village of North Palm Beach, Florida, a Florida municipal corporation ("Village") and Land Research Management, Inc., a Florida corporation ("Consultant"). RECITALS WHEREAS, the Village and Consultant entered into an Agreement for Planning Services dated 02/08/2007 (Resolution 2007-25) to implement a three phase planning study to examine potential redevelopment along the U.S. Highway One corridor ("Agreement"); and WHEREAS, the Agreement incorporated a Scope of Services dated January 10, 2007 detailing three separate phases; and WHEREAS, the Consultant has completed Phase One of the study, as set forth in the Scope of Services, and the Village and the Consultant wish to modify the Scope of Services for Phase Two. NOW, THEREFORE, in consideration of the mutual promises set forth herein, the receipt and sufficiency of which are hereby acknowledged, the parties hereto agree as follows: SECTION 1: The parties hereby amend Phase Two of the Scope of Services, which was incorporated into the Agreement by reference, to read as follows: Phase a Examine existing conditions, regulations and inconsistencies and make recommendations. Task 2.1 - Complete a survey of vacancy rates along the corridor. Task 2.2 - Lvaluate whether or not building height limitations need to be revised in order to encourage the construction of "Class A"office buildings. Task 2.3 - Review setback requirements for four story buildings adjacent to residential areas. Task 3.9 - Evaluate properties zoned CB to determine if the current height limits are appropriate. Task Z.S - Determine whether or not there are any inconsistencies between the Phase One recommendations and existing development and, if such inconsistencies exist, make recommendations to address them. SECTION 2: All other provisions of the Agreement for Planning Services, to the extent not modified herein, remain in full force and effect. Phis Amendment shall not increase the Cost to Complete the Scope of Services as set forth therein.
