01-11-2001 VC WS-MMINUTES OF THE WORKSHOP SESSION ~.... OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, JANUARY 11, 2001 Present: Joseph A. Tringali, Mayor Dr. Edward M. Eissey, Vice Mayor David B. Norris, President Pro Tem Donald G. Noel, Councilman Charles R. O'Meilia, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Kathleen F. Kelly, CMC, Village Clerk ROLL CALL: The meeting was called to order at 9:10 p.m. All members of Council were present. All members of staff were present. DOCK CODE AMENDMENT Discussion was held concerning a proposed ordinance change providing regulations for mooring pleasure boats, yachts and non-commercial water craft at docks and facilities located in R-1 and R-2 zoning districts. Seven residents were present to address the Council regarding this issue. The Council, by consensus, agreed to leave the dock code as is currently reads, with the exception of changing the word "owner" to "occupant". Village Attorney George Baldwin was directed to make that one provision only and bring it to the next Regular Session for first reading. ACTION MECHANICAL -SETTLEMENT Discussion was held concerning settlement between Cumberland Casualty & Surety regarding Action Mechanical; Contractors. Consensus of Council was to get our Consultant (Coburn & Associates) involved and find out what his position is on this matter before continuing on. Further consensus was to negotiate a settlement for $38,000 in hard costs plus half the liquidated damages. ADDITIONAL FEES -DREDGING PROJECT Discussion was held with the Village's Consulting Engineer Howard Searcy regarding additional fees in the amount of $19,000 for services rendered to analyze, design and prepare Phase I dredging bid specifications and permit applications; and, additional fees in the amount of $23,000 for additional testing and permitting for Phase II of the dredging design and permitting `'`.~ project. The request for $19,000 for Phase I (west of U. S. 1) was forwarded to the Regular Minutes of Workshop Session Held Thursday, January 11, 2001 Session of January 25, 2001. Additional funding requested for Phase II will be brought back to the next Workshop for further discussion. Due to approaching curfew, Items j. and k. were forwarded to the Regular Session of January 25, 2001 without discussion.
