A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA CLARIFYING AND CORRECTING THE
WAIVERS FOR THE MAJOR TENANT SIGNS AND THE SHOPPING
CENTER IDENTIFICATION SIGN WITHIN THE SHOPPES AT CITY
CENTRE COMMERCIAL PLANNED UNIT DEVELOPMENT; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, through the enactment of Ordinance No. 2010-22 on December 9, 2010 ("PUD
Ordinance"), the Village Council approved the Shoppes at City Centre Commercial Planned Unit
Development ("PUD"); and
WHEREAS, Section 8 of the PUD Ordinance provides that the Village Council may approve
minor modifications to the PUD by resolution without the necessity of review by the Planning
Commission, advertisement or public hearing; and
WHEREAS, Section 4 of the PUD Ordinance granted two waivers from the requirement of
Section 6-115(c)(2) of the Village Code of Ordinances that signs be placed no higher than
eighteen (18) feet above grade; and
WHEREAS, the waivers granted in the PUD Ordinance permitted the installation of the tenant
signs for Major Tenant A and B and the shopping center identification sign to be located twenty-
one feet (21) above grade; and
WHEREAS, the waivers requested by the applicant and approved by the Village Council were
inconsistent with the architectural elevations and building site data set forth therein, which
depicted the tenant signs for Major Tenant A and B at a height of twenty-five (25) feet, ten (10)
inches above grade and the shopping center identification sign at a height of thirty-five (35) feet,
eight (8) inches above grade; and
WHEREAS, the property owner is seeking a minor modification to the PUD Ordinance in order
to cure this inconsistency; and
WHEREAS, the Village Council determines that the adoption of this Resolution is in the best
interests of the Village and its residents.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF NORTH PALM BEACH, FLORIDA as follows:
Section 1. The foregoing recitals are ratified as true and incorporated herein.
Section 2. As authorized by Section 8 of Ordinance No. 2010-22, the Village Council hereby
approves a minor modification to the Shoppes at City Centre Planned Unit Development to
modify the waivers granted therein and amends Section 4 of the PUD Ordinance to read as
follows (new language is underlined and deleted language is °*r~°'~°r *'~~°~~rt'~):

In approving the Shoppes at City Centre PUD, the Village Council hereby grants
the following minor modifications or "waivers" from the requirements of the
Village's land development regulations:

B. Waiver from Section 6-115(c)(2) of the Village Code of Ordinances to
