2003-039 Lawsuit Settlement PolicyRESOLUTION 39-2003 • A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, SETTING FORTH A POLICY THAT IN ANY LAWSUIT WHEREIN THE VILLAGE OF NORTH PALM BEACH IS A DEFENDANT, NEITHER THE VILLAGE NOR THE INSURANCE ADMINISTRATOR UNDER THE VILLAGE'S SELF-INSURANCE PROGRAM SHALL ENTER INTO A SETTLEMENT INVOLVING AN EXPENDITURE IN EXCESS OF FIVE THOUSAND ($5,000.00) DOLLARS UNLESS THE TERMS OF THE SETTLEMENT HAVE BEEN THE SUBJECT OF A PUBLIC HEARING; PROVIDING AN EXCEPTION WHEN AN EMERGENCY EXISTS; AND, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. The Village Council of the Village of North Palm Beach, Florida, does hereby set forth a policy that in any lawsuit wherein the Village ofNorth Palm Beach is a defendant, neither the Village nor the insurance administrator under the Village's self-insurance program shall enter into a settlement involving an expenditure in excess of Five Thousand ($5,000.00) Dollars unless the terms of the settlement have been the subject of a public hearing held after the Village gives due public notice. Notice by publication in a newspaper of general circulation is not required. Section 2. The Village may settle a lawsuit that requires expenditure of public funds in excess of Five Thousand ($5,000.00) at a public meeting where the Village records in the minutes the reasons for which an emergency exists which preclude the Village from holding a public hearing on the settlement.
