AN ORDINANCE, OF THE VILLAGE OF NORTH PALM BEACH, FLORIllA,
AMENDING CHAPTER 6 OF THE VILLAGE OF NORTH PALM BEACH CODE, IT
BEING 1'HE BUILDING CODE OF THE VILLAGE, BY AMENDING THE CRITERIA
' FOR LAND MANAGEMENT AND USE TO COMPLY WITH THE RULES AND REGULATIONS
OF TkiE NATIONAL FLOOD INSURANCE PROGRAM WITH REGARD TO THE FLOOD
PLAIN AREAS AS DELINEATED ON THE DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT, SPECIAL FLOOD HAZARD AREA MAP DATED NOVEMBER 30, 1977,

BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM
BEACH, FLORIDA:
Section 1. Section 6-41 of the Village of North Palm
Beach Code is hereby amended to read as follows;
Sec. 6-41. CRITERIA FOR LAND MANAGEMENT AND USE---
(1) For all zones designated on the Flood Insurance Rate
Map the Building Official shall;
' A. Require permits for all proposed development in
any area of special flood hazard. The term "development"
is defined to mean "any man-made change to improved or
tin improved real estate, including but not limited to
buildings or other structures, mining, dredging, filling,
grading, paving, excavation or drilling operations."
B. Review permits for proposed development to ass~ire
that all other necessary permits have been received from
those governmental agencies from which approval is required
by Federal or State Law.
C. Require that new construction (including prefabri-
cated buildings and mobile homes) be anchored to prevent
flotation and lateral movement, and be constructed with
flood resistant materials and methods.
D. Assure that subdivision proposals and proposals
for other developments, including their utilities and drainage,
are located and designed to be consistent with the need to
minimize flood damage.
F,. Require that all subdivision proposals and other
proposed new developments greater than 50 lots or 5 acres,
' whichever is less, include base flood elevation data.
F. Require new water and sewer systems (including
on-site systems) to be located and designed to avoid
impairment.
G. Obtain and maintain records of elevations and flood-
proofing levels for all new or substantially improved structures,
and whether or not such structures contain a basement.
(2) In unnumbered A zones designated on the Flood Insurance
Rate Map, the Building Official shall: obtain, review, and
reasonably utilize base flood elevation data from alternative
sources, prior to its being provided by Flood Insurance
Administration through its Flood Insurance Rate Study, as
criteria for requiring that all new residential structures and
substantial improvements to existing structures have their
lowest floor (including basement) elevated to or above the
base flood level, and that new nonresidential structures
and substantial improvements to existing structures have
the lowest floor (including basement) elevated or flood-
proofed to or above the base flood level.
(3) In zones Al-30 designated on the Flood Insurance Rate
Map, the Building Official shall;
A. Require that Residential structures have the lowest
floor (including basement) elevated to or above the base
flood level, unless the community is granted an exception
for the allowance of basements and/or storm cellars by the
Flood Insurance Administration.
B. Require that Nonresidential structures have the
lowest floor (including basement) elevated to or above the
base flood level; or be floodproofed to or above that level.
(4) In zone AO designated on the Flood Insurance Rate Map,
for new construction and substantial improvements, the
Building Official shall;
A. Require that Residential structures have the lowest
floor (including basement) elevated above the crown of the
nearest street to or above the depth number specified on the
community's Flood Insurance Rate Map.
B. Require that Nonresidential structures have the
lowest floor (including basement) elevated above the crown
or the nearest street to or above the depth number specified
on the community's Flood Insurance Rate Map; or be flood-
proofed to or above that level.
(5) In zones Al-30 and A0, where floodproofing is used in lieu
of elevation, the Building Official shall require that a
registered professional engineer or architect certify that
the floodproofing methods used are adequate to withstand
the forces associated with the base flood and submit suc}i
certification to the community; or submit to the Flood
Insurance Administration for approval, local regulations
containing detailed floodproofing specifications which meet
the watertight performance standards of Section 1910.3(c);

(G) In zones V1-30, the Building Official shall require that:

A. All new construction and substantial improvements
are elevated and secured to adequately anchored pilings and
coltunns so that the lowest portion of the structural members
of the lowest floor (excluding pillings or columns) is
elevated to or above the base flood level and is certified
by a registered professional engineer or architect that the
structure is secured to adequately anchored pilings or
colwnns in order to withstand velocity waters and hurricane
wave wash.
B. All new construction and substantial improvements }lave
space below the lowest floor free of obstruction or constructed
with "breakaway walls" intended to collapse under stress with-
out jeopardizing the structural support of the structure.
(7) In zones V1-30, the Building Official shall assure that
all new construction is located landward of the reach of
mean high tide.
(8) In zones V1-30, the Building Official shall prohibit the
placement of mobile homes, except in existing mobile home
parks or subdivisions.
(9) In zones V1-30, the Building Official shall prohibit the
alteration of sanddunes and mangrove stands which would
increase potentYal flood damage."
Section 2. This Ordinance shall take effect immediately upon
