Bock, CLERK b COMPTROLLER Pgs 0940 - 942; t3pgs) RESOLUTION OS-2003 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, APPROVING THE FINAL ASSESSMENT ROLL FOR CONSTRUCTION OF PUBLIC POTABLE WATER LINES ALONG CONROY DRIVE, LAKE PARK MANOR PLAT, WITHIN THE VILLAGE OF NORTH PALM BEACH, WHICH FINAL ASSESSMENT ROLL 1S ATTACHED AS EXHIBIT "A"; PROVIDING THAT SUCH ASSESSMENTS STAND CONFIRMED AND REMAIN LEGAL, VALID AND BINDING FIRST LIENS UPON THE PROPERTIES AGAINST WHICH SUCH ASSESSMENTS ARE MADE UNTIL PAID; CONFIRMING THE AMOUNT OF ASSESSMENTS AS SET FORTH IN RESOLUTION N0.21- 2001 AND AGAIN SET FORTH IN EXHIBIT "A" ATTACHED; PROVIDING THAT IF THE COST OF.CONSTRUCTION OF PUBLIC POTABLE WATER LINES EXCEEDS THE TOTAL ASSESSMENT SET FORTH IN EXHIBIT "A", THAT THE VILLAGE OF NORTH PALM BEACH SHALL PAY THE DIFFERENCE; PROVIDING THAT THE ASSESSMENTS SHALL BE PAID AND COLLECTED IN THE MANNER SET FORTH IN RESOLUTION N0.21-2001 OF THE VILLAGE AND CHAPTER 170 OF THE FLORIDA STATUTES; PROVIDING THAT THE ASSESSMENTS SHALL BE RECORDED BY THE VILLAGE CLERK IN A SPECIAL BOOK TO BE KNOWN AS THE "IMPROVEMENT LIEN BOOK"; AND, PROVIDING FOR AN EFFECTTVE DATE. WHEREAS, the Village Council of the Village of North Palm Beach, Florida, has met as an equalizing board to hear and consider any and all complaints as to the special assessments to consider adjustment and equalization of assessments on a basis of justice and right; and WHEREAS, the Village Council has determined that the assessments set forth in Resolution No. 21-2001 and as set forth in Exhibit "A" attached to this resolution are appropriate and final. BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: lion 1. The Village Council of the Village of North Palm Beach, Florida, does hereby approve the final assessment roll for construction of public potable water lines along Conroy Drive, Lake Park Manor Plat, within the Village of North Palm Beach, which final assessment roll is attached as Exhibit "A" and made part hereof. • Section 2. The assessments stand confirmed and shall remain legal, valid and binding first liens • upon the properties against which such assessments are made until paid, and the Village is authorized to collect the assessments in accordance with Resolution No. 21-2001 of the Village and in accordance with Chapter 170 of the Florida Statutes. Section 3. The preliminary assessment roll reflected an estimated cost of construction of public potable water lines of $75,850.00 with assessments shown in Exhibit "A" to be $3,034.00 each. The Village Council has determined that the total cost of construction of public potable water lines will exceed $75,850.00, and the Village shall pay and be responsible for the difference. Section 4. The assessments shall be paid and collected by the Village in the manner set forth in Resolution No. 21-2001 of the Village. Section 5. The assessments shall be recorded by the Village Clerk in a special book to be known as the "Improvement Lien Book" and the Finance Director of the Village shall hereafter maintain records and record assessments and provide accounting to the Village Clerk and otherwise operate in conjunction with the Village Clerk, as may be required by Chapter 170 of the Florida Statutes. Section 6. This resolution shall take effect immediately upon its adoption.
